MINUTES The Plainview City Council met in Regular Session on Tuesday, May 8, 1990 in the Council Chambers of City Hall at 7:30 P.M. with Mayor E.V. Ridlehuber presiding. The following Councilmembers were present: Alton Jackson, Bobby James, Barbara Dorman, Dwain Dodson and Ross Owen. Councilmembers John E. Kirchhoff and Don Dickson were absent. Staff Present: James P. Jeffers, City Manager; Bill Hogge, Director of Public Works; Mike McDonough, Director of Municipal Services; Norman Huggins, Director of Finance; Rolando Vela, Administrative Assistant; David Blackburn, City Attorney; Roy L. Osborne, Director of Public Safety; and Carla Reese, City Secretary. News Media Present: Richard Orr - Plainview Daily Herald. Guest Present: Pat Criswell, Peggy Spruiell, Sherry Akin, Chad Akin, Derrell Kunkel, Sara Kunkel, Jill Kirchhoff, Mary Jacq Kirchhoff, Velma Campbell, Susan Lowery, and Dorothy Bedwell. Councilmember Bobby James delivered the invocation. Mayor E.V. Ridlehuber welcomed the guest. Zone Case No. 563 - Specific Use Permit - Vicente Montoya. Ordinance No. 90-2826. An Ordinance amending Zoning Ordinance No. 89-2798 and the official zoning map of the City of Plainview so as to make the following changes: request of Vicente Montoya for a Specific Use Permit on Lots 5 and 6, Block 2, City Addition for the purpose of operating a Flea Market in a C2 (Retail District) Zoning District and located at 812 West 5th Street. Councilmember Dwain Dodson made a motion to deny Ordinance No. 90-2826. Motion was duly seconded by Councilmember Alton Jackson and carried by a unanimous vote. Mayor E. V. Ridlehuber presented the following Consent Calendar for approval. a) Minutes b) Department Reports c) Budget Expenditures d) Property Re-Sell. Resolution No. R90-132. A Resolution of the City Council of the City of Plainview, Texas, to exercise its option authorized by ~ 34.05 of the Texas Property Tax Code to re-sell property which has previously been struck off to the City of Plainview pursuant to ~ 34.01(C) of the Texas Property Tax Code. 1 of 3 e) Parks - Frisco (Lizzie Merriman Trust). Resolution No. R90-136. A Resolution of the City Council of the City of Plainview, Texas, recognizing the need to execute a deed to return the land conveyed to the City of Plainview by Vivian O. Graham as trustee of the Lizzie Merriman Trust to the successors to the title of Vivian O. Graham, that being Douglass C. Graham, Jr., Donald Clyde Graham and Daniel Carl Graham and authorizing the Mayor to execute a deed therefore. f) Open Meetings. Resolution No. R90-137. A Resolution of the City Council of the City of Plainview, Texas, addressing the need for a policy statement in regard to open meetings. g) Emergency Management. Ordinance No. 90-2827. An Ordinance establishing a program including mitigation preparedness, response and recovery phases of comprehensive emergency management; acknowledging the office of emergency management director; authorizing the appointment of an emergency management coordinator; and providing for the duties and responsibilities of those offices; identifying an operational organization; granting necessary powers to cope with all phases of emergency management which threaten life and property in the City of Plainview; authorizing cooperative and mutual aid agreements for relief work between this and other cities or counties and for related purposes; prohibiting unauthorized warning and all clear signals and making violations a misdemeanor punishable by a fine not to exceed $1,000; and repealing all Ordinances and conflicts hereto. Motion was made by Councilmember Barbara Dorman to adopt the Consent Calendar as stated. Motion was duly seconded by Councilmember Dwain Dodson and carried by a unanimous vote. Election Return - Canvass. Resolution No. R90-139. A Resolution of the City of Plainview, Texas, ordering the canvass of the election returns and declaring the results of the General and Special Election held on May 5, 1990. Motion was made by Councilmember Bobby James to adopt Resolution No. R90-139. Motion was duly seconded by Councilmember Ross Owen and carried by a unanimous vote. Oaths of Office were taken by Mayor E.V. Ridlehuber and Councilmembers Alton Jackson, Mary Virginia Kirchhoff and Medlin Carpenter. Mayor Pro-Tem Appointment. Resolution No. R90-135. A Resolution of the city of Plainview, Texas, appointing a Mayor Pro-Tem. Mayor E.V. Ridlehuber made the motion to appoint Councilmember Barbara Dorman as the Mayor Pro-Tem. Motion was duly seconded by Councilmember Ross Owen and carried by a unanimous vote. Sanitar~ Landfill - Tires - Medical Waste. Bill Hogge, Director of Public Works presented Ordinance No. 90-2828. An Ordinance amending Chapter 12, Garbage and Trash of the Code of Ordinances of the City of Plainview, Texas, by adding an article dealing with 2 of 3 the collection of certain regulated special waste and solid waste and disposal of such waste in the sanitary landfill of the City of Plainview; and providing a penalty and an effective date. Motion was made by COuncilmember Medlin Carpenter to adopt Ordinance No. 90-2828. Motion was duly seconded by Councilmember Ross Owen and carried by a unanimous vote. Executive Session to discuss personnel as authorized by Article 6252-17 2(g) V.T.C.S. (City Attorney Evaluation) Motion was made by Councilmember Ross Owen to adjourn into Executive Session. Motion was duly seconded by Councilmember Alton Jackson and carried by a unanimous vote. Mayor E.V. Ridlehuber adjourned the meeting from Executive Session at 9:25 P.M. City Attorney Appointment. Resolution No. R90-138. A Resolution of the City of Plainview, Texas, reappointing David Alan Blackburn as City Attorney. Motion was made by Councilmember Barbara Dorman to adopt Resolution No. R90-138. Motion was duly seconded by Councilmember Dwain Dodson and carried by a unanimous vote. Adjournment. Councilmember Barbara Dorman made the motion to adjourn. Motion was duly seconded by Councilmember Ross Owen and carried by a unanimous vote. There being no further business Mayor E.V.
