MINUTES The Plainview City Council met on Thursday, June 7, 1990, at 11:30 A.M., at the Plainview Country Club with Mayor E.V. Ridlehuber presiding. Councilmembers present were: Don Dickson, Alton Jackson Barbara Dorman, Ross Owen, Mary Virginia Kirchhoff and Medlin Carpenter. Councilmember Dwain Dodson was absent. Staff present: James P. Jeffers, City Manager; Mike McDonough, Director of Municipal Services; Bill Hogge, Director of Public Works; Norman Huggins, Director of Finance; Rolando Vela, Administrative Assistant; Roy L. Osborne, Director of Public Safety; Barbara Sullivan, Municipal Court Judge and City Secretary, Carla Reese. Guest Present: Richard Orr, Plainview Daily Herald; Travis Hart, First Baptist Church and Dale Durham, First Baptist Church. The City Council reviewed the following agenda items for the upcoming meeting on June 12, 1990. 1) 12) INVOCATION OPENING OF COUNCIL: This meeting of the Plainview City Council is being conducted in compliance with the Texas Open Meetings Law. 3) PUBLIC HEARINGS a. Sign Ordinance ZONE CASE NO. 564 - J.B. Roberts, Edgemere Shopping Center and Robert Cory. 2600 N. 1-27. 4) AUDIT - 1989-1990. Resolution No. R90-147. A Resolution of the City of Plainview accepting the 1989-1990 Audit. 5) LANDFILL - review of procedures for processing tires. 6) RECIPROCAL GOVERNMENTAL AGREEMENT. Resolution No. R90-149. A Resolution of the City Council of the City of Plainview Texas, authorizing the Mayor to execute and enter into on behalf of the City a Reciprocal Governmental Agreement between Hale County and the City of Plainview for Intergovernmental Services. 7) ZONE CASE 558. Resolution No. R90-150. A Resolution of the City of Plainview, Texas, acting on the request of J.C. Funderburk to extend the six month time limit for completing specific use permit conditions. 1 of 4 ALL MATTERS UNDER ITEM 8 CONSENT CALENDAR ARE CONSIDERED TO BE ROUTINE BY THE CITY COUNCIL AND WILL BE ENACTED ON A MOTION IN THE FORM LISTED BELOW. THERE WILL BE NO SEPARATE DISCUSSION ON THESE ITEMS OTHER THAN THE ASKING OF QUESTIONS FOR SIMPLE CLARIFICATION. ON OBJECTION BY ANY PARTY TO THE INCLUSION OF ANY ITEM ON THE CONSENT CALENDAR, THAT ITEM SHALL BE REMOVED FROM THE CONSENT CALENDAR. SUCH OBJECTION MY BE RECORDED ANY TIME PRIOR TO THE TAKING OF A VOTE ON THE MOTION TO APPROVE THE CONSENT CALENDAR. ALL SUCH ITEMS SHALL BE CONSIDERED INDIVIDUALLY IN THE ORDER IN WHICH THEY ARE OBJECTED TO, IMMEDIATELY FOLLOWING THE CONSIDERATION OF THE CONSENT CALENDAR. 7) CONSENT CALENDAR a) Minutes b) Department Reports c) Budget Expenditures d) COUNCIL LIAISON - APPOINTMENT. Resolution No. R90-144. A Resolution of the City of Plainview, Texas, confirming the appointments of Councilmembers to serve as committee Liaisons for the various Boards, Commissions and Committees of the City of Plainview. e) MINIMUM HOUSING BOARD - APPOINTMENTS. Resolution No. R90-148. A Resolution of the City of Plainview, Texas, making appointments to the Minimum Housing Board. f) PARKS - ACCEPTANCE OF DEED - J. B. ROBERTS. Resolution No. R90-145. A Resolution of the City of Plainview, Texas, authorizing acceptance of a Warranty Deed from J.B. Roberts for property located at 100 S. Date. g) ELECTRICAL CODE - 1990 NATIONAL ELECTRICAL CODE. Ordinance No. 90-2832. An Ordinance of the City of Plainview, Texas, adopting the 1990 Edition of the National Electrical Code (NFPA 70-1990) and repealing all previous editions of the National Electrical Code heretofore adopted; providing penalties for violation of this ordinance; providing a severability clause; directing publication of the descriptive caption together with penalty provisions of this Ordinance; and providing an effective date. h) PLAT - PRELIMINARY - FERRELLWOOD SUBDIVISION UNIT NO. 2. Resolution No. R90-151. A Resolution of the City of Plainview, Texas, approving the Preliminary Plat of the Ferrellwood Subdivision, Unit No. 2, Part of Lot 6, Block 6, East College Heights Addition to the City of Plainview, Hale County, Texas. i) INDEMNIFICATION AND DEFENSE PLAN. Ordinance No. 90-2833. An Ordinance of the City of Plainview, Texas, amending Chapter 2, "Administration", Article XIV, "Officer and Employee Liability Plan", of the Plainview City Code, as amended; amending a provision regarding the limits of coverage as such are set forth by State law; and providing an effective date, 2 of 4 ©0 O?3 9) EXECUTIVE SESSION to discuss pending and/or possible litigation as authorized by Article 6252-17, Section 2 (e). (Barnett v. City of Plainview), (Laney Law Offices et al v. City of Plainview), (Willis R. Winters), (Burkett Outdoor Advertising), Marcelino Flores), (Michael Smiley), (Wanda Warrick Jones), (Jimmy Garcia). 10) Adjournment. Streets - Curb and Gutter Repair. Jim Jeffers, City Manager advised the Council that First Baptist Church has requested the City replace the curb and gutter on Austin and Baltimore Streets and 7th and 8th Streets. The City submitted a proposal to First Baptist Church to make the curb and gutter repairs over a three year pe:~iod. First Baptist Church has indicated that the repairs being m.~de over a three year period would not be a good plan for the Chu]ch. Council was reminded for the past three years $10,000 has bee] set aside for curb and gutter repairs, to date $6,000 has been ex ~ended on curb and gutter repair leaving $4,000 in the budget. Dr. Travis Hart, Pastor of First Baptist Church, was present and submitted to the Council their proposal, asking that the repLirs of the curb and gutter on Austin, Baltimore, 7th and 8th Streets be completed all in one phase. Councilmember Don Dickson recommended that City staff begin advertising for bids to make the requested repairs of the curb and gutter and amending the budget. All the Council was in agreement with this recommendation. Plating Require~nents - review of Wee Care Day Care project. Jim Jeffers, City Manager advised that no discussion was necessary due to fact that there had been no developments on the project. Code ViolatiOns. Mike McDonough, Director of Municipal Services reviewed the procedures of the Code Enforcement Department and the laws governing the department by which they can enforce the violations of City ordinances. McDonough noted that the Code Enforcement Department is divided into three sections, by which each Code Enforcement Officer take care of inspections, minimum housing structures and environmental violations. Private Prisons of America. The Council was provided with a copy of the written response from Ray Hutchinson, stating that the City should decline entering into the private prison agreement with PPA. The Council was also advised that David Blackburn, City attorney has prepared a first draft of the letter to the Attorney General's Office presenting the following two questions: does a municipality have authority under Section 361.065 of the Local Government Code, to accept assignment of a county agreement for the development and operation of a private prison and for professional private prison management; and under what other terms and conditions, if any, may a municipality enter into an agreement to provide for the design, development, financing, operation and administration of an incarceration facility. -It was noted that Blackburn had suggested that the City may not want to request the 3 of 4 Attorney General's opinion, as the letter from Ray Hutchinson has addressed the same questions in his letter of May 22, 1990. Council was of the consensus to proceed with the Attorney General's opinion. Boards and Co~mission Appointments. Jim Jeffers, City Manager advised that applications were needed for the vacancies on the boards, commissions and committees. Plat Request - Franklin Ebeling. Councilmember Medlin Carpenter advised in his attempts to contact Franklin Ebeling he had been unable to do so, therefore, he had no information on the plat request. Effective Tax Rate. Norman Huggins, Director of Finance presented to the Council a report on the current years tax rate and next years proposed effective tax rate along with an effective tax rate report from Hale County Central Appraisal District. It was noted that the current tax rate is .5074 and the proposed effective tax rate for 1990-1991 is .4519. Huggins also reviewed with the Council the determining factors in computing the effective tax rate. Swimming Pool. The Council was advised of a letter from Mike Northcutt advising that the volunteer committee no longer wished to be involved in the 16th Street Swimming Pool. Council was asked if they had any problems with the City responding to the letter advising that the City would continue to operate the swimming pool on a yearly basis. Council was of the consensus to proceed with the letter. Carnival/Circus Permitting. Council was advised that Joe Walker with the Jaycees was still working in trying to obtain the old Gibson's building parking lot for the Carnival which the Jaycees are sponsoring. Adjournment. Motion was made by Councilmember Ross Owen to adjourn. Motion was duly seconded by Councilmember Alton Jackson. There being no further business Mayor E.V.
