MINUTES The Plainview City Council met in Regular Session on Tuesday, June 12, 1990 in the Council Chambers of City Hall at 7:30 P.M. with Mayor E.V. Ridlehuber presiding. The following Councilmembers were present: Alton Jackson, Mary Virginia Kirchhoff, Don Dickson, Medlin Carpenter, Barbara Dorman, Dwain Dodson and Ross Owen. Staff Present: James P. Jeffers, City Manager; Mike McDonough, Director of Municipal Services; Norman Huggins, Director of Finance; Rolando Vela, Administrative Assistant; David Blackburn, City Attorney; Roy L. Osborne, Director of Public Safety; Barbara Sullivan, Municipal Court Judge; Janice Anderson, Planning Department Secretary and Carla Reese, City Secretary. News Media Present: Richard Orr - Plainview Daily Herald and Roxanne Carter - KVOP/KATX. Guest Present: Mr. J.C. Bullick, Mrs. J.C. Bullick, Nina Morris, Judy Hartley, J.C. Armstrong, Jr., Joseph Ruiz, Gwen Wesley, J.C. Funderburk, James Funderburk, Gary Garrison, Dovie Gilleland, John A. Deisher, Pat Thornton, Kelvin Heath, Albert Perez, Anna Perez, Rick Graves, and Bill Weaks. Mayor E.V. Ridlehuber delivered the invocation. Mayor E.V. Ridlehuber welcomed the guest. Public Hearing - Sign Ordinance. Councilmember Barbara Dorman made a motion to open the public hearing. Motion was duly seconded by Councilmember Ross Owen and carried by a unanimous vote. Mike McDonough, Director of Municipal Services reviewed the proposed amendments to the Sign Ordinance. Those speaking in opposition of proposed amendments to the Sign Ordinance were: Gary Garrison, Diane Dowdy, Ken McCormick, Ron Welch, Bob Crawford, Judy Hartley, Robert Edwards, Joe Ruiz, Robert Moore, Mark Sullivan, Dovie Gilleland, Bill Weaks, Bob Roberson, Richard Ligon, J.C. Armstrong, James Skains, Tex Edwards and Glen McLaurin. There were no persons present speaking in favor of the proposed amendments to the Sign Ordinance. Councilmember Don Dickson made a motion to close the public hearing. Motion was duly seconded by Councilmember Barbara Dorman and carried by a unanimous vote. After comments by the Council, Councilmember Don Dickson made the motion to delete Section 3.10 from the amendments 1 of 4 to the Sign Ordinance. Motion was duly seconded by Councilmember Mary Virginia Kirchhoff. Councilmember Ross Owen amended the motion to deny any action on the amendments to the Sign Ordinance and to further study Section 312 - Removal of Signs. Amendment was accepted by Councilmember Don Dickson. Motion was duly seconded by Councilmember Don Dickson and carried by a vote of 6 ayes and 1 nay. Previous motion made by Councilmember Don Dickson carried by a unanimous vote. Public Hearing - Zone Case No. 564 - J.B. Roberts, Edgemere Shopping Center and Robert Cory. 2600 N. 1-27. Councilmember Barbara Dorman made a motion to open a public hearing. Motion was duly seconded by Councilmember Ross Owen and carried by a unanimous vote. Mike McDonough, Director of Municipal Services advised this request is to change the zone of the northern part of the Edgemere Shopping Center to a C-3 (Commercial General Business District) and apply for a Specific Use Permit for the operation of a one week carnival. It was noted that the Planning and Zoning Commission has reviewed and recommends the approval of Zone Case 564. Councilmember Barbara Dorman made a motion to close the public hearing. Motion was duly seconded by Councilmember Dwain Dodson and carried by a unanimous vote. Audit - 1989-1990. Resolution No. R90-147. A Resolution of the City of Plainview accepting the 1989-1990 Audit. Mayor E.V. Ridlehuber stated that Resolution No. R90-147 was being tabled until George Meriwether could be present. Landfill - review of procedures for processing tires. Jim Jeffers City Manager noted that due to federal and state mandates that the City could no longer accept whole tires in the landfill. -Tires must be shredded, quartered or slit before they can be deposited into the landfill. RiCk Graves with Daffern Steel and Supply advised they are making the necessary arrangements to handle storing tires until an assessment can be made on the best procedure for disposing of the tires. Reciprocal Governmental Agreement. Resolution No. R90-149. A Resolution of the City Council of the City of Plainview Texas, authorizing the Mayor to execute and enter into on behalf of the City a Reciprocal Governmental Agreement between Hale County and the City of Plainview for Intergovernmental Services. Roy Osborne, Director of Public Safety advised that the agreement is to allow the County to begin housing City prisoners, when the jail addition is completed, in trade for the City assisting the County with emergency Calls, outside the city limits, Monday through Friday, assistance in emergency calls to eastside clubs and the animal control department shall provide service to specified areas of the County. Motion was made by ~Councilmember Medlin Carpenter to adopt Resolution No. R90-149. Motion was duly seconded by Councilmember Ross Owen and carried by a unanimous vote. Zone Case 558. Resolution No. R90-150. A Resolution of the City of Plainview, Texas, acting on the request of J.C. Funderburk to extend the six month time limit for completing specific use permit 2 of 4 O0 conditions. Mike McDonough, Director of Municipal Services reviewed the approval of a Specific Use Permit through Ordinance No. 89-2811. It was noted that all restrictions, which had been placed in the Ordinance, had been met except for the issuance of the Alcoholic Beverage Permit. Gwen Wesley advised they are requesting an extension of the Specific Use Permit due to delays in receiving their Alcoholic Beverage Permit. Those present speaking in opposition of the extension for the Specific Use Permit were, David Criswell, Betty Criswell, J.C. Armstrong and Joe Ruiz. Motion was made by Councilmember Barbara Dorman to deny the request for the extension of the Specific Use Permit. Motion was duly seconded by Councilmember Medlin Carpenter. Motion failed with a vote of 3 ayes and 4 nays. Motion was made Councilmember Ross Owen to approve a sixty day extension of the Specific Use Permit. Motion was duly seconded by Councilmember Alton Jackson and carried by a vote of 4 ayes and 3 nays. Tax Sale - Real Property. Resolution No. R90-152. A Resolution of the City of Plainview, Texas authorizing the Mayor to execute deeds and necessary documents to convey the sale of real property. Motion was made by Councilmember Dwain Dodson to adopt Resolution No. R90-152. Motion was duly seconded by Councilmember Don Dickson and carried by a unanimous vote. Mayor E.V. Ridlehuber presented the following Consent Calendar for approval. a) Minutes b) Department Reports c) Budget Expenditures d) Council Liaison - Appointment. Resolution No. R90-144. A Resolution of the City of Plainview, Texas, confirming the appointments of Councilmembers to serve as committee Liaisons for the various Boards, Commissions and Committees of the City of Plainview. e) Minimum Housing Board - Appointments. Resolution No. R90-148. A Resolution of the City of Plainview, Texas, making appointments to the Minimum Housing Board. f) Parks - Acceptance Of Deed - J. B. Roberts. Resolution No. R90-145. A Resolution of the City of Plainview, Texas, authorizing acceptance of a Warranty Deed from J.B. Roberts for property located at 100 S. Date. g) Electrical Code - 1990 National Electrical Code. Ordinance No. 90-2832. An Ordinance of the City of Plainview, Texas, adopting the 1990 Edition of the National Electrical Code (NFPA 70-1990) and rePealing all previous editions of the National Electrical Code heretofore adopted; providing penalties for violation of this ordinance; providing a severability clause; directing publication of the descriptive caption together with penalty provisions of this Ordinance; and providing an effective date. 3 of 4 077 h) Plat - Preliminary - Ferrellwood Subdivision Unit No. 2. Resolution No. R90-151. A Resolution of the City of Plainview, Texas, approving the Preliminary Plat of the Ferrellwood Subdivision, Unit No. 2, Part of Lot 6, Block 6, East College Heights Addition to the City of Plainview, Hale County, Texas. i) Indemnification and Defense Plan. Ordinance No. 90-2833. An Ordinance of the City of Plainview, Texas, amending Chapter 2, "Administration", Article XIV, "Officer and Employee Liability Plan'!, of the Plainview City Code, as amended; amending a provision regarding the limits of coverage as such are set forth by State law; and providing an effective date. j) Library - West Texas Library System Lay Representative. Resolution No. R90-146. A Resolution of the City of Plainview, Texas, appointing the lay representative for the City of Plainview Unger Memorial Library in the West Texas Library System, for fiscal years 1990 and 1991. Motion was made by Councilmember Barbara Dorman to adopt the Consent Calendar as stated. Motion was duly seconded by Councilmember Dwain Dodson and carried by a unanimous vote. Executive Session. Motion was made by Councilmember Barbara Dorman to table the Executive Session until the meeting of June 26, 1990. Motion was duly secondsd by Councilmember Don Dickson and carried by a unanimous vote. Adjournment. Motion was made by Councilmember Ross Owen to adjourn. Motion was duly seconded by Councilmember Alton Jackson and carried by a unanimous vote. There being no further business Mayor E.V. Ridlehuber adjourned the meeting at 10:10 P.M.
