CITY COUNCIL MEETING
OCTOBER 23, 1990
MINUTES
The Plainview City Council met in Regular Session on Tuesday,
October 23, 1990, in the Council Chambers of City Hall at 7:30
P.M. with Mayor E.V. Ridlehuber presiding. Councilmembers present
were: Alton Jackson - Precinct 1; Mary Virginia Kirchhoff -
Precinct 2; Don Dickson - Precinct 3; Medlin Carpenter - Precinct
4; Dwain Dodson - Precinct 6; and Ross Owen - Precinct 7.
Councilmembers absent were: Barbara Dorman - Precinct 5.
Staff Present: David Blackburn, City Attorney; Terry Powers,
Director of Human Resources; Jerry Austin, Assistant Chief of
Police; Norman Huggins, Director of Finance; Bill Hogge, Director
of Public Works; Jim Sewell, Zoning Administrator; Janice
Anderson, Zoning Secretary and Carla Reese, City Secretary.
News Media present: Richard Orr - Plainview Daily Herald; John
Rigg - Lubbock Avalanche Journal and Randy Ballinger - KKYN.
Guest Present: James Funderburk, Gwen Wesley, J.C. Funderburk,
Randy Ballinger, Betty Criswell, Don Criswell, Jim Ferrell, David
Criswell, David Harris, Bill Stanford, Michael Carter, Sharon
Latham, Bennie Ferguson, Ora Adcock, Ronald Lockridge, Chris
Campbell, James Thomas and Albert Perez.
Zone Case 568 - Specific Use Permit - Funderburk. Ordinance No.
90-2843. An Ordinance amending Zoning Ordinance No. 89-2798 and
the Official Zoning Map of the City of Plainview so as to make the
following changes: request of J.C. Funderburk for a Specific Use
Permit - club serving alcoholic beverages in a C3 (Commercial
General Business) Zoning District, for commercial uses and located
at 1301 S. 1-27. David Blackburn, City Attorney reviewed the
previous restrictions that had been placed on the prior Specific
Use Permit. Blackburn also noted according to State Law, and the
City of Plainview Zoning Ordinance, that if twenty percent of the
owners of the land in the area protest the issuance of the
permit, then the vote for approval must be three-fourths of the
entire Council. After some discussion motion was made by
Councilmember Ross Owen to adopt Ordinance No. 90-2843. Motion
was duly seconded by Councilmember Alton Jackson. The vote was
four ayes and 2 nays, therefore, the Specific Use Permit was
denied due to lack of a three-fourths majority of the Council.
~{otel/Motel Tax - Reserve Fund. Mayor E.V. Ridlehuber introduced
Resolution No. R90-189. A Resolution of the City of Plainview,
Texas, acting on a request of the Plainview Chamber of Commerce to
expend Hotel/Motel Tax Reserve Funds for remodeling the Chamber of
Commerce Meeting Room, two restrooms, hall and kitchen. Don
Williams, President of the Plainview Chamber of Commerce reviewed
the request for the remodeling of the Chamber of Commerce Meeting
Room and presented the following three points: proposal as
presented is higher than when originally presented due to higher

bids and the purchase of stackable chairs; Chamber is going to
expend a major amount of money to remodel the offices of the
Chamber; and the Chamber is willing, but is not aware of a
facility at this time to house the Chamber and the Industrial
Foundation in one building. Councilmember Don Dickson made a
motion to amend the budget to approve up to $17,500 for the
remodeling of the Chamber of Commerce Meeting Room, with the
Chamber agreeing to remodel the office portion of the Chamber
building, within one year, at a cost of $14,000, and that a search
committee be formed with representatives from the City, County,
Chamber and Industrial Foundation to explore the possibilities of
locating a larger facility. Motion was duly seconded by
Councilmember Medlin Carpenter and carried by a unanimous vote.
Mayor E.V. Ridlehuber presented the following Consent Calendar for
approval noting that Item h) Board and Commission Appointments -
Minimum Housing Standards, that Lester W. James, Jr. and John
Speck, Jr. ~have been recommended as applicants on the Minimum
Housing Standards Board.

d) Custom Benefit Plan - Section 125. Resolution No.
R90-188. A Resolution of the City of Plainview, Texas, adopting
restated provisions for the Custom Benefit Plan for employees of
Plainview; said restatement to bring the plan as adopted in 1986
into compliance with Section 125 of the Internal Revenue Code as
amended.
e) Retirement - T~RS. Ordinance No. 90-2844. An Ordinance
of the City of Plainview to increase the rate of deposits to the
Texas Municipal Retirement System by the employees of the City of
Plainview.
f) Retirement - TMRS - Updated Service Credits. Ordinance
No. 90-2845. An Ordinance of the City of Plainview authorizing
and allowing under the Act governing the Texas Municipal
Retirement System, "Updated Service Credits" in said system for
service performed by qualifying members of such system who
presently are in the employment of the City of Plainview;
providing for increased prior and current service annuities for
retirees and beneficiaries of deceased retirees of the City; and
establishing an effective date for such actions.
g) Civil Service - Adoption. Ordinance No. 90-2846. An
Ordinance of the City of Plainview, Texas, implementing Chapter
143, Local Government Code for the City of Plainview Fire
Department in accordance with State Law.
h) Board and Commission Appointments - Minimum Housing
Standards. Resolution No. R90-190. A Resolution of the City of
Plainview, Texas, appointing individuals to serve on the Minimum
Housing Standards Board.

i) Fire Department - Department ~ead. Ordinance No. 90-2847.
An Ordinance amending Chapter 10 of the Plainview City Code
entitled "Fire Protection and Prevention"; providing for the
designation of a Department head and Chief of the Fire Department;
and providing for an effective date.
Motion was made by Councilmember Medlin Carpenter to approve the
Consent Calendar as stated. Motion was duly seconded by
Councilmember Don Dickson and carried by a unanimous vote.
Adjournment. Motion was made by Councilmember Don Dickson to
adjourn. Motion was duly seconded by Councilmember Ross Owen.
There being no further business Mayor E.V. Ridtehuber adjourned
the meeting at 8:30 P.M.
