A RESOLUTION OF THE CITY OF PLAINVIEW, CITY COUNCIL
AUTHORIZING THE FILING OF A GRANT APPLICATION WITH THE
OFFICE OF THE GOVERNOR, CRIMINAL JUSTICE DIVISION
THROUGH THE SOUTH PLAINS ASSOCIATION OF GOVERNMENTS
FOR THE EMERGENCY OPERATIONS CENTER (EOC) FURNITURE
AND EQUIPMENT PROJECT; AUTHORIZING THE MAYOR AND/OR
CITY MANAGER TO ACT ON BEHALF OF THE CITY OF PLAINVIEW IN
ALL MATTERS RELATED TO THE APPLICATION; AND AGREEING TO
COMPLY WITH THE TERMS AND CONDITIONS OF THE GRANT IF
AWARDED.
WHEREAS, Federal Funds have been authorized under 34 U.S.0 §10152 Edward
Byrne Memorial Justice Assistance Grant Program (JAG) and made available through a
Congressional appropriation to the U.S. Department of Justice, Bureau of Justice
Assistance; and
WHEREAS, the announcement of the availability for these funds has been made
on December 13th, 2021 by the Office of the Governor of the State of Texas and through
the South Plains Association of Governments; and
WHEREAS, the City of Plainview's current Emergency Operations Center (EOC)
is located in the basement of the Plainview Police Department at 108 W. 9th Street in
Plainview, Hale County, Texas; and
WHEREAS, Construction is currently underway on the new Police Department for
the City of Plainview located in the former City Hall building at 901 North Broadway,
Plainview, Hale County, Texas, the designs of which do not include space and equipment
specifically for the purpose of serving as an Emergency Operations Center (EOC); and
WHEREAS, the City of Plainview shares possession and use of the facility located
at 1108 South Interstate 27 in Plainview, Hale County, Texas with the Hale County
Sherriff's Department and is intended to be renovated to serve the people of Plainview
and Hale County as a training facility; and
WHEREAS, a designated portion of the building at 1108 S. Columbia would serve
effectively as an emergency operations center if furnished and equipped properly; and
WHEREAS, The City of Plainview agrees that there are no applicable matching
funds for the said project as required by the grant application; and
WHEREAS, The City of Plainview agrees that in the event of loss or misuse of the
Office of the Governor funds, The City of Plainview assures that the funds will be returned
to the Office of the Governor in full.

WHEREAS, The City of Plainview designates Chief Derrick Watson as the
grantee's authorized official. The authorized official is given the power to apply for, accept,
reject, alter or terminate the grant on behalf of the applicant agency.
WHEREAS, the City Council of the City of Plainview believes it to be in the best
interest of the citizens of the City of Plainview to authorize the Mayor and/or City Manager
to apply for such funds from the Office of the Governor to an Emergency Operations
Center to be located in the northeast corner of 1108 S. Columbia in Plainview Texas.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS,
HEREBY RESOLVES:
1. THAT the Mayor and City Manager are authorized to request funding from the
Edward Byrne Memorial Justice Assistance Grant Program through the Office of the
Governor, and act on behalf of the City of Plainview in all matters related to the grant
application and any subsequent grant contract and grant project that may result.
2. THAT the Mayor and/or City Manager of the City of Plainview are hereby
authorized to administer and oversee all matters relating to such grant application and to
execute all necessary documents related to such grant application and grant acceptance.
3. THAT in the event the City of Plainview is awarded such grant, the City of
Plainview, to the best of its ability, agrees to comply with the terms and conditions of the
grant.
