R22-558 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS, DESIGNATING THE USE OF CORONAVIRUS STATE AND LOCAL FISCAL RECOVERY FUNDS; AUTHORIZING THE MAYOR AND CITY MANAGER TO SUBMIT ANY NECESSARY PAPERWORK RELATED THERETO AND ACT AS AUTHORIZED REPRESENTATIVES; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, a novel coronavirus (COVID-19) has been recognized globally as a contagious respiratory virus; and WHEREAS, on March 19, 2020, pursuant to the authority provided him by Texas Government Code § 418.108, the Mayor of the City of Plainview issued a Declaration of Local Disaster, placing certain restrictions and procedures in place in order to protect and preserve the public health, safety and welfare and consistent with the national and state declarations of emergency that was continually renewed and extended by the City Council up to Resolution No. R22-549; and WHEREAS, Congress passed the American Rescue Plan Act, Pub. L. No. 117-2 (March 11, 2021), that provides $350 billion in emergency funding for eligible state, local, territorial, and Tribal governments to respond to the COVID-19 emergency; and WHEREAS, Sections 602(b) and 603(b) of the Social Security Act, as added by section 9901 of the American Rescue Plan Act, authorizes the U.S. Treasury Department to make payments to certain recipients from the Coronavirus State Fiscal Recovery Fund and the Coronavirus Local Fiscal Recovery Fund; and WHEREAS, non -entitlement units of local government are defined in section 603(g)(5) of the Social Security Act, as added by section 9901 of the American Rescue Plan Act, are local governments typically serving populations of less than 50,000 and are eligible to receive Coronavirus Local Fiscal Recovery Fund payments through their state government; and WHEREAS, the Coronavirus State and Local Fiscal Recovery Funds provide substantial flexibility for each government to meet local needs including replacing lost public sector revenue to strengthen support for vital public services and help retain jobs; and WHEREAS, the Coronavirus State and Local Fiscal Recovery Funds can be used to for street infrastructure, public health, water system weatherization, public safety and quality of life projects; and WHEREAS, the State of Texas has received and will receive specific allocations of Coronavirus Local Fiscal Recovery Funds from the U.S. Treasury Department for the above mentioned purposes and are responsible for distributing these funds to non - entitlement units of local governments within Texas and must distribute these funds to its non -entitlement units of local government; and Resolution R22-558 Page 1 of 3 WHEREAS, the City of Plainview is considered a non -entitlement unit of local government and has been identified to receive an allocation of funds of approximately $4,991,152.00 to be disbursed in two tranches approximately twelve months apart; and WHEREAS, the City Council of the City of Plainview held two workshops that were open to the public on January 6, 2022 and February 17, 2022, received public comment from February 21, 2022 through March 11, 2022 and conducted two public hearings at their Council Meetings on March 1, 2022 and March 7, 2022 to receive public input and comment regarding the use of the Coronavirus State and Local Fiscal Recovery Funds as authorized under the American Rescue Plan Act; and WHEREAS, the City Council of the City of Plainview believes it to be in the best interest of the citizens of the City of Plainview to obligate and use the Coronavirus State and Local Fiscal Recovery Funds as authorized under the American Rescue Plan Act to replace lost public service revenue. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS, THAT: SECTION 1. The Coronavirus State and Local Fiscal Recovery Funds received by the City of Plainview are hereby obligated to replace lost public sector revenue and to be ' used for such eligible projects involving street infrastructure, public health, water system weatherization, public safety and quality of life projects. 1 SECTION 2. The Mayor and/or the City Manager are hereby authorized, to the extent required, to complete any and all necessary documents to receive the City of Plainview's allocation of Coronavirus State and Local Fiscal Recovery Funds and either may be designated as an authorized representative of the City of Plainview. SECTION 3. The City Manager is hereby authorized to administer and oversee all matters relating to the receipt and expenditure of Coronavirus State and Local Fiscal Recovery Funds. SECTION 4. This Resolution shall be effective immediately upon its passage. Approved by the City Council of the City of Plainview, Texas, this 22nd day of March, 2022.
