Pre-session The Plainview City Council met in regular meeting on Tuesday, March 25, 1986 at 7:30 p.m. in the Council Chambers of City Hall with Mayor Ridlehuber presiding and the following present: Councilmembers: Andy Taylor, Bobby James, Tom Aday, and Larry McEachern. Staff present: Bill Hogge, Mike McDonough, Roy Osborne and Norman Huggins. Mayor opened meeting and had the candidates introduce themselves. Mike McDonough explained the zone change on Ordinance No. 86-2644 entitled, "An Ordinance amending Ordinance No. 82-2478 entitled, 'The City of Plainview Zoning Ordinance' more specifically Section 26:2 entitled, 'Specific Use Permit Regulations' Subpart 7, and establishing an effective date." Councilman Taylor moved, seconded by Councilman Aday to call for a public hearing. Motion carried unanimously. No comments were made either for or against the zoning change. Councilman Aday moved, Councilman Taylor seconded, to close the public hearing. Motion carried unanimously. Mayor presented Ordinance No. 86-2644 on second and final reading, entitled, "An Ordinance amending Ordinance No. 82-2478 entitled, 'The City of Plainview Zoning Ordinance' more specifically Section 26:2 entitled, 'Specific Use Permit Regulations' Subpart 7, and establishing an effective date." Councilman Taylor moved, seconded by Councilman Aday to approve Ordinance No. 86-2644. MotiOn carried unanimously. Mike McDonough explained Ordinance No. 86-2646 entitled, "An Ordinance amending Zoning Ordinance No. 82-2478 and the official zoning map of the City of Plainview so as to make the following changes: Zone Case No. 530; request of the City of Plainview for rezoning a 28.866 acre tract of land from a R-2 (Single Family Residential) Zoning District to MF-2 (Multiple Family Residential) Zoning District located in the 3300 Block of North Quincy." Councilman Taylor moved, seconded by Councilman Aday to call for a public hearing. T.C. Wall, 1310 Itasca, spoke in favor of the proposed zone change. John Oathout, 1401 Portland, also spoke in favor of the proposed zone change. Orville Stafford, 1302 W. 32nd, spoke in opposition of the zone change. Councilman James moved, seconded by Councilman Taylor, to close the public hearing. Motion carried unanimously. Mayor presented Ordinance No. 86-2646 on second and final reading, entitled, "An Ordinance amending Zoning Ordinance No. 82-2478 and the official zoning map of the City of Plainview so as to make the following changes: Zone Case No. 530; request of the City of Plainview for rezoning a 28.866 acre tract of land from a R-2 (Single Family Residential) Zoning District to MF-2 (Multiple Family Residential) Zoning District located in the 3300 Block of North Q~in~y." councilman Aday moved, seconded by Councilman James to approve the zone change request. Motion carried unanimously. Mike McDonough explained Ordinance No. 86-2647 entitled, "An Ordinance amending Zoning Ordinance No. 82-2478 and the official zoning map of the City of Plainview so as to make the following changes: Zone Case No. 531; request of the City of Plainview for rezoning several lots R-1 (Single Family Residential) Zoning District to MF-2 (Multiple Family Residential) Zoning District and located on Twenty-Eighth, Twenty-Ninth, Thirtieth, and Thirty-First Streets east of North Ennis Street." Councilman Taylor moved, seconded by Councilman Aday to call for a public hearing on the request. Motion carried unanimously. Paul Wright asked for a clarification of the zone change request. Councilman Aday moved, seconded by Councilman James to close the public hearing on the request. Motion carried unanimously. Mayor presented Ordinance No. 86-2647 on second and final reading, entitled, "An Ordinance amending Zoning Ordinance No. 82-2478 and the official zoning map of the City of Plainview so as to make the following changes: Zone Case No. 531; request of the City of Plainview for rezoning several lots R-1 (Single Family Residential) Zoning District to MF-2 (Multiple Family Residential) Zoning District and located on Twenty-Eighth, Twenty-Ninth, Thirtieth, and Thirty-First Streets east of North Ennis Street." Councilman Taylor moved, seconded by Council Aday to approve the ordinance. Motion carried unanimously. Mike McDonough explained Ordinance No. 86-2648 entitled, "An Ordinance amending Zoning Ordinance No. 82-2478 and the official zoning map of the City of Plainview so as to make the following changes: Zone Case No. 532; request of Blake Gooch for rezoning of Lot 7 and the South 45 feet of Lot 8, Block 22, College Hill Addition from a R-2 (Single Family Residential) Zoning District to a TF (Attached Residential) Zoning District located at 708 Portland Street." Mr. Gooch spoke on the proposed zone change. Councilman Taylor moved, seconded by Councilman James to call for a public hearing. Motion carried unanimously. No comments were made either for or against the proposed change. Councilman Aday moved, seconded by Council James to close the public hearing. Motion carried unanimously. Mayor presented Ordinance No. 86-2648 on second and final reading, entitled, "An Ordinance amending Zoning Ordinance No. 82-2478 and the official zoning map of the City of Plainview so as to make the following changes: Zone Case No. 532; request of Blake Gooch for rezoning of Lot 7 and the South 45 feet of Lot 8, Block 22, College Hill Addition from a R-2 (Single Family Residential) Zoning District to a TF (Attached Residential) Zoning District located at 708 Portland Street." Councilman Aday moved, seconded by Councilman Taylor to approve the ordinance. Motion carried unanimously. Mike McDonough explained Ordinance No. 86-2645 entitled, "An Ordinance amending Zoning Ordinance No. 82-2478 and the official 2 zoning map of the City of Plainview so as to make the following changes: Zone Case No. 529; request of James R. Odom for rezoning of a three (3) acre tract of land from a C.R.D. (Commercial Retail District) Zoning District to a C.G.B. (Commercial General Business) Zoning District for commercial uses located in the 2400 Block of North Ennis." Councilman Taylor moved, seconded by Councilman Taylor to open public hearing. Motion carried unanimously. James Odom spoke on the proposed zone change. Councilman Taylor moved, seconded by Councilman James to close the public hearing. Motion carried unanimously. Mayor presented Ordinance No. 86-2645 on second and final reading, entitled, "An Ordinance amending Zoning Ordinance No. 82-2478 and the official zoning map of the City of Plainview so as to make the following changes: Zone Case No. 529; request of James R. Odom for rezoning of a three (3) acre tract of land from a C.R.D. (Commercial Retail District) Zoning District to a C.G.B. (Commercial General Business) Zoning District for commercial uses located in the 2400 Block of North Ennis." Discussion was held on the rezoning of said tract of land and what might possibly go there should the zone change be approved. Councilman Aday moved, seconded by Councilman James for said request to be denied. Motion carried unanimously. Mayor presented Resolution No. R86-995 entitled, "A Resolution of the City Council of the City of Plainview, Texas authorizing the City Manager to enter into a three year contract with Lloyd C. Woods for Risk Management and Insurance Consulting Service." Councilman Aday moved, seconded by Councilman James to approve the resolution with the performance of Mr. Woods to be reviewed at the end of each year of the three year contract. Motion carried with Councilman Taylor opposed. Councilman Aday moved, seconded by Councilman Taylor to approve the Consent Calendar. a) Minutes b) Department Reports c) Budget Expenditures d) Consideration of Ordinance No. 86-2641 on second and final reading, entitled, "An Ordinance amending Section 5-4 Minimum Equipment; Section 5-5 Trained Personnel; and Section 5-6 Warning Devices of Chapter 5 entitled, 'Ambulances' of the Code of the City of Plainview, Texas and providing for a severability clause." e) Consideration of Ordinance No. 86-2649 entitled, "An Ordinance of the City of Plainview, Texas amending Article VI entitled, Central Plains Higher EducationAuthorit¥ of the Code of the City of Plainview, Texas; providing for a severability clause; and declaring an emergency." f) Consideration of Resolution No. R86-993 entitled, "A Resolution of the City Council of the City of Plainview, Texas appointing individuals to serve on the Central Plains Higher Education Authority as authorized by Chapter VI of the Code of the City of Plainview, Texas." g) Consideration of Ordinance No. 86-2642 on first reading, entitled, "An Ordinance of the City of Plainview, regulating the erection, construction, enlargement, alteration, repair, moving, removal, demolition, conversion, occupancy, equipment use, height, area and maintenance of all buildings and/or structures in the City of Plainview, Texas; providing for the issuance of permits and collection of fees thereof; providing penalties for the violation thereof; declaring and establishing fire zones; repealing Ordinance No. 82-2498 of the City of Plainview, and all other Ordinances and parts of Ordinances in conflict herewith. Providing for the adoption of the 1985 Edition of the Uniform Building Code, Volume 1, as copyrighted in 1985 by the International Conference of Building officials, Whittier, California, with certain amendments thereto; directing publication of the descriptive caption of this Ordinance, with the penalty provisions of the Uniform Building Code, 1985 Edition and providing an effective date of this Ordinance. h) Consideration of Ordinance No. 82-2643 on first reading, entitled, "An Ordinance of the City of Plainview regulating and controlling the design, quality of materials, construction, location, electrification, and maintenance of all signs and signs structures located within a building; providing for the adoption of the 1985 Edition, Uniform Sign Code as copyrighted in 1985 by the International Conference of Building Officials of Whittier, California with certain amendments thereto; providing for the violation thereof; providing a severability clause; directing publication of the descriptive caption of this Ordinance together with a penalty provision of the 1985 edition, Uniform Sign Code as amended, and providing an effective date." i) Consideration of Ordinance No. 86-2650 on first reading, entitled, "An Ordinance of the City of Plainview regulating and controlling the maintenance of buildings and premises; to safeguard life, health, property and public welfare by regulating the storage, use and handling of dangerous and hazardous materials, substances and processes, and by regulating the maintenance of adequate egress facilities, providing for the repealing of Ordinance No. 82-2497 of the City of Plainview, proViding for the adoption of the Uniform Fire Code, 1985 Edition addition as copyrighted in 1985; the International Conference Building Officials of Whittier California, providing for certain amendments thereto; providing penalties for the violation thereof; providing a severability clause; directing publication of the descriptive caption of this Ordinance, together with a penalty provision, and providing an effective date of this Ordinance." j) Consideration of Resolution No. 86-994 entitled, "A Resolution 4 of the City Council of the City of Plainview, Texas accepting the lowest and best bids and awarding purchase contracts for materials for street seal coating." k) Consideration of Resolution No. 86-996 entitled, "A Resolution of the City Council of the City of Plainview, Texas authorizing the expenditure of up to $6,000.00 from the Parks Bond Fund in order to correct a drainage problem in Give~s Park. Mayor called for an Executive Session: Discussion of personnel as authorized by Article 7252-17, Section 1 (g), V.T.C.S. and discussion of pending litigation in accordance with Article 6252-17, Section 1 (e), V.T.C.S. It was moved by Councilman Aday, seconded by Councilman Taylor to adjourn the meeting. PASSED AND APPROVED this the 8th day of April , 1986. E.V.
