HomeMy WebLinkAbout86 1014 minCITY COUNCIL MEETING October 14, 1986 Council Chambers 7:30 p.m. MINUTES The Plainview City Council met in a regular session on Tuesday, October 14, 1986, at 7:30 p.m. in the Council Chambers of City Hall with the following Councilmembers present and Mayor Ridlehuber presiding: Alton Jackson, Terry Clements, Bobby James, Junior Brown, and Don Dickson. Staff present: City Manager Jim Jeffers, Norman Huggins, Roy Osborne, David Blackburn, Mike McDonough, Bill Hogge, and Sheryl Owen. Invocation was given by Councilman Terry Clements. opened the meeting and welcomed the guest. Mayor Ridlehuber Mayor Ridlehuber presented for consideration Resolution No. R86-167 entitled, "A Resolution of the Mayor and City Council of the City of Plainview, Texas authorizing the Director of Municipal Services to file a petition for rezoning frOm an R-i, A-O and P.D. to CRD (Conmmercial Retail), the properties located on the west side of North Interstate 27 in the 1300 through the 2300 blocks." Mike McDonough, Director of Municipal Services explained this Resolution. It was then moved by Councilman Clements seconded by Councilman Brown to approve said Resolution. Motion carried unanimously. Mayor Ridlehuber Presented for consideration on second reading Ordinance No. 86-2666 entitled, "An Ordinance authorizing and allowing under the act governing the Texas Municipal Retirement System, "updated service credits" in said system for service performed by qualifying members of said system who are presently in the employment of the City of Plainview; providing for increase prior and current annuities for retirees and beneficiaries of deceased retires of the City; and establishing an effective date for such actions." It was moved by Councilman James seconded by Councilman Brown that this Ordinance be tabled. Motion carried unanimously. Mayor Ridlehuber presented for consideration on first reading Ordinance No. 86-2657 entitled, "An Ordinance providing for a public policy on discrimination; creating a Conmmission on Human Relations; establishing terms of members; defining powers and duties; defining the organizational structure; and establishing a policy on expenditures." Councilman Junior Brown explained the Human Relations Committee. It was then moved by Councilman Clements seconded by Councilman Jackson to approve said Ordinance. Motion carried unanimously. Mayor Ridlehuber presented for consideration of Resolution No. R86-169 entitled, "A Resolution of the City Council of the City of Plainview, Texas establishing a policy for the recovery of court cost and Attorney fees by the City of Plainview in litigation." Councilman James explained said Resolution. It was then moved by Councilman Brown seconded by Councilman James to approve said Resolution. Motion carried unanimously. 1 of 4 Mayor Ridlehuber presented the public hearing on the proposed Airport Annexation, and explained this was the first public hearing of two to be held. City Manager Jim Jeffers explained the proposed Airport Annexation. It was then moved by Councilman Clements seconded by Councilman Dickson to open the public hearing. Motion carried unanimously. The following spoke in opposition to said Airport Annexation: J.B. Roberts, Mike Hutcherson, June Edgar, Norman Goen, Jarvis Nowell, Marlin Miller, Roger Horan, Dewayne Mitchell, Roy Uptergrove, Jim Platt, Pete McDonough, Matt Bailey, Ray Purcell, Jimmy Holmes, Medlin Carpenter, J.B. Wheeler, Norman Wright, Mike Ford, Warren Mirtshing, Bill Hardage, David DeBusk, Gail Zigler, Meredith Ruiz, Charles Hornsby, Bob Bitnell, W.C. Gunter, Joe Ruiz, Hall Nall, and Lee Kramer. J.B. Roberts explained to the Council the Airport Board's opposition to the proposed annexation. It was then moved by Councilman Clements, seconded by Councilman James to close said public hearing. Motion carried unanimously. Mayor presented the following Consent Calendar for approval. CONSENT CALENDAR: A) Minutes B) Department Reports C) Budget Expenditures D) Consideration of Resolution No. R86-171 entitled, "A Resolution of the City Council of the City of Plainview, Texas establishing a policy for the conducting of public hearings for zone cases before the Planning and Zoning Commission and the City Council." E) Consideration of Resolution No. R86-172 entitled, "A Resolution of the City Council of the City of Plainview, Texas appropriating $4,975.00 from the General Fund of the City of Plainview to pay one-half of the relocation cost of Energas facilities on Southwest 3rd." F) Consideration of Resolution No. R86-173 entitled, "A Resolution of the City Council of the City of Plainview, Texas establishing procedures for conducting public hearings before governmental entities of the City of Plainview." G) Consideration of Resolution No. R86-174 entitled, "A Resolution of the City Council of the City of Plainview, Texas appropriating $264.00 from the General Fund of the City of Plainview to pay one-half of the relocation cost of Southwestern Bell Telephone facilities on Southwest 3rd." H) Consideration on first reading, Ordinance No. 86-2668 entitled, "An Ordinance amending Chapter XX, Plainview Code to repeal provisions therein concerning notice to Abate a Nuisance." I) Consideration on first reading, Ordinance No. 86-2669 entitled, "An Ordinance amending Chapter II, Article VII, Plainview Code 2 of 4 providing for the inclusion of appraisal fees and advertising cost in the evaluation of surplus real property upon disposition: providing for deposit by the requesting party: and providing for forfeiture of said deposit in the event the surplus real property is not sold." J) Consideration on first reading, Ordinance No. 86-2670 entitled, "An Ordinance amending zoning ordinance No. 82-2478 and the official zoning map of the City of Plainview so as to make the following changes: Zone Case No. 538; request of Durwood O. Jones and The Carter Company for rezoning of the north 15 feet of the south 2.5 acres of the west 5 acres of Block 41, Lakeside Addition from R-2 (Single-family residential) zoning district to a CGB (Commercial General Business) zoning district and located adjacent to 2301 Portland and calling for a public hearing to be conducted on October 28, 1986." K) Consideration of Ordinance No. 86-2671 entitled, "An Ordinance amending zoning ordinance No. 82-2478 and the official zoning map of the City of Plainview so as to make the following changes: Zone Case No. 539; request of Patty Winters on behalf of Wilson Daffern for rezoning of Lots 13, 14, 15 and south 24 feet of Lot 12, Block 2, High School Addition from a R-1 (Single-family residential) zoning district to a CNS (Neighborhood Service District) zoning district for commercial uses and located at 1701 Quincy; and calling for a public hearing to be conducted on October 28, 1986." L) Consideration on first reading, Ordinance No. 86-2672 entitled, "An Ordinance amending zoning ordinance No. 82-2478 and the official zoning map of the City of Plainview so as to make the following changes: Zone Case No. 540; request of David Ramirez, Jr. for a specific use permit for a day care center in a R-2 (Single-family residential) zoning district being Lots 13 and 14, Block 1, Slaughter Sub-division and located at 106 Zephyr," and calling for a public hearing to be conducted on October 28, 1986. M) Consideration on first reading, Ordinance No. 86-2673 entitled, "An Ordinance amending zoning ordinance No. 82-2478 and the official zoning map of the City of Plainview so as to make the following changes: Zone Case No. 541; request of Dr. Jeff Davis for rezoning of the west one-half of east one-half of Lots 7 & 8, Block 1, Alabama Addition from R-2 (Single-family residential) zoning district to a CGB (Commercial General Business) zoning district for commercial uses and located in the 600 block West 24th," and calling for a public hearing to be held on October 28, 1986. N) Consideration on first reading, Ordinance No. 86-2674 entitled, "An Ordinance amending zoning ordinance No.~ 82-2478 and the official zoning map of the City of Plainview so as to make the following changes: Zone Case No. 542; request of Lewis I. Cole for PTC, Ltd. II and others for a specific use permit for the purpose of amending the specific use permit restrictions granted under Zone Case No. 491 as it effects Lots 1, 2, 3, .4, 5 and 7, Mesa Verde Addition, Unit No. 1, located at 1001 N. 1-27," and calling for a public hearing to be held on October 28, 1986. 3 of 4 It was moved by Councilman Clements seconded by Councilman James to approve the proposed Consent Calendar. With no further business pending it was moved by Councilman James seconded by Councilman Clements to adjourn said meeting. PASSED AND APPROVED this the llth day of November, 1986. E,V.
