MINUTES
The Plainview City Council met in a Council Meeting on Tuesday
October 28, 1986 at 7:30 p.m. in the Council Chambers of City Hall.
Mayor Ridlehuber presided with the following Councilmembers present:
Alton Jackson,. Terry Clements, Don Dickson, Bobby James, Barbara
Dorman, Junior Brown and Tom Aday. Staff present: City Manager Jim
Jeffers, Mike McDonough, Bill Hogge, Roy Osborne, and Sheryl Owen.
Mayor Ridlehuber opened the meeting and welcomed the guest.
Mayor Ridlehuber presented for consideration on second reading
Ordinance No. 86-2666 entitled, "An Ordinance authorizing and
allowing under the act governing the Texas Municipal Retirement
System, "updated service credits" in said system for service
performed by qualifying members of such system who presently are in
the employment of the City of Plainview; providing for increased
prior and current service annuities for retirees and beneficiaries
of deceased retirees of the City; and establishing an effective
date for such actions." It was moved by Councilman Clements
seconded by Councilwoman Dorman to approve Ordinance No. 86-2666.
Motion carried unanimously.
Mayor Ridlehuber presented for consideration on second reading
Ordinance No. 86-2657 entitled, "An Ordinance providing for a public
policy on discrimination; creating a Commission on ~Human Relations;
establishing terms of members; defining powers and duties; defining
the organizational structure; and establishing a policy, on
expenditures." It was moved by Councilman Brown seconded by
Councilman Jackson to approve Ordinance No. 86-2657. Motion carried
unanimously.
PUBLIC HEARING: Zone Case No. 538. Mike McDonough Director of
Municipal Services explained Zone Case No. 538. It was moved by
Councilman Clements seconded by Councilman Dickson to call the
Public Hearing. Motion carried unanimously. Elmer East, Attorney
representing Durwood Jones and the Carter Company spoke on behalf of
Mr. Jones for the zone change. It was then moved by Councilwoman
Dorman seconded by Councilman Clements to close the Public Hearing.
Motion carried unanimously.
Mayor Ridlehuber presented for consideration on second reading
Ordinance No. 86-2670 entitled, "An Ordinance amending zoning
ordinance No. 82-2478 and the official zoning map of the City of
Plainview so as to make the following changes: Zone Case No. 538;
request of Durwood O. Jones and the Carter Company for rezoning of
the north 15 ft. of the south 2.5 acres of the west 5 acres of Block
No. 41, Lakeside Addition from an R-2 (Single-Family Residential)
zoning district to a CGB (Commercial General Business) zoning
district and located adjacent to 2301 Portland." It was moved by
Councilwoman Dorman seconded by Councilman Clements to approve the
Ordinance. Motion carried unanimously.

PUBLIC HEARING: Zone Case No. 539. Mike McDonough Director of
Municipal Services explained Zone Case No. 539, It was moved by
Councilman Jackson seconded by Councilman Brown to open the Public
Hearing. Motion carried unanimously. Patty Winters spoke on behalf
of Wilson Daffern and explained that the proposed zone change would
be used for land for an office. Mr. J.B. Guthrie spoke against the
zone change and explained that he felt the majority of the people
were against this zone change. Mrs.. O.C. Collins spoke against the
zone change and requested if such change must be made that
restrictions be put on this change. It was moved by Councilwoman
Dorman seconded by Councilman Clements to close the Public Hearing.
Motion carried unanimously.
Mayor Ridlehuber presented for consideration on second reading,
Ordinance No. 86-2671 entitled, "An -Ordinance amending zoning
ordinance No. 82-2478 and the official zoning map of the City of
Plainview so as to make the following changes: Zone Case No. 539;
Request of Patty Winters on behalf of Wilson Daffern for rezoning of
Lots 13, 14, 15 and south 24 feet of Lot 12, Block 2, High School
Addition from an R-1 (Single-Family Residential) zoning district to
a CNS (Neighborhood Service District) zoning district for commercial
uses, and located at 1701 Quincy." It was moved by Councilman James
seconded by Councilwoman Dorman to approve said Ordinance. Motion
carried unanimously.
PUBLIC HEARING: Zone Case No. 542. Mike McDonough Director of
Municipal Services explained Zone Case No, 542. It was moved by
Councilman Clements seconded by Councilwoman Dorman to call the
Public Hearing. Motion carried unanimously. No comments were made.
It was moved by Councilwoman Dorman seconded by Councilman Brown to
close the Public Hearing. Motion carried unanimously. Mr.~ Ray
Pinkerton spoke on behalf of DWC on the requested zone change for
the sign.
Mayor Ridlehuber Presented for consideration on second reading
Ordinance No. 86-2674 entitled, "An Ordinance amending .zoning
ordinance No. 82-2478 and the official zoning map of the City of
Plainview so as to make the following changes: Zone Case No. 542;
Request of Lewis I. Cole for PTC, ltd. II and others for a Specific
Use Permit for the purpose of amending the Specific Use Permit
restrictions granted under Zone Case No. 549 as it effects Lots 1,
2, 3, 4, 5, and .7, Mesa Verde Addition, Unit No. 1, located at 1001
North Interstate ~ighwa¥ No. 27." The motion was made by
Councilman Clements seconded by Councilwoman Dorman to approve said
Ordinance. Councilman Dickson, Clements, and Dorman for the Zone
change; Councilman Jackson, James, Brown, and Aday against the zone
change.
PUBLIC REARING: Zone Case No. 540. Mike McDonough Director of
Municipal Services explained Zone Case No. 540. It was moved by
Councilwoman Dorman seconded by Councilman Jackson to open the
Public Hearing. Motion carried unanimously. David Ramirez
explained the zone change was for plans to open a Day Care Center at
this site. It was. then moved by Councilwoman Dorman seconded by
Councilman Brown-to close the Public Hearing. Motion carried
unanimously.

Mayor Ridlehuber presented for cOnsideration on second reading,
Ordinance No. 86-2672 entitled, "An Ordinance amending zoning
ordinance No. 82-2478 and the official zoning map of the City of
Plainview so as to make the following changes: Zone Case No. 540;
request of David Ramirez, Jr. for a Specific Use Permit for a Day
Care Center in an R-2 [Single-Family Residential) zoning district
being Lots 13 and 14, Block 1, Slaughter Sub-division and located at
106 Zephyr." It was moved by Councilwoman Dorman seconded by
Councilman Brown to approve said Ordinance. Motion carried
unanimously.
PUBLIC HEARING: Zone Case No. 541. It was moved by Councilwoman
Dorman seconded by Councilman Clements to call the Public Hearing.
Motion carried unanimously. Mike McDonough Director of Municipal
Services explained Zone Case No. 541. No comments were made. It was
then moved by Councilwoman Dorman seconded by Councilman Brown to
close the Public Hearing. Motion carried unanimously.
Mayor Ridlehuber presented for consideration on second reading,
Ordinance No. 86-2673 entitled, "An Ordinance amending zoning
ordinance No. 82-2478 and the official zoning map of the City of
Plainview so as to make the following changes: Zone Case No. 541;
Request of Dr. Jeff H. Davis for rezoning of the west one-half of
Lots 7 and 8 and west one-half of east one-half of Lots 7 and 8,
Block 1, Alabama Addition from an R-2 (Single-Family Residential)
zoning district to a CGB (Commercial General Business) zoning
district for commercial uses and located in the 600 Block of West
24th." It was moved by Councilman Jackson seconded by Councilman
Brown to approve said Ordinance. Motion carried unanimously.
PUBLIC HEARING: EMCO EConomic Development Program Application.
Mayor Ridlehuber explained the filing of an Economic Development
Program Application to the Texas Department Community Affairs in
November. It was moved by Councilwoman Dorman seconded by
Councilman DiCkson to call the Public Hearing. No comments were
made. It was then moved by Councilwoman Dorman seconded by
Councilman Brown to close the Public Hearing. Motion carried
unanimously.
Mayor Ridlehuber presented for consideration of Resolution No.
R86-175 entitled, "A Resolution of the City Council of the City of
Plainview, Texas authorizing the filing of an Economic Development
Program Application to the Texas Department of Community Affairs and
authorizing the Mayor to act as the City's Chief Executive Officer
and Authorized Representative in all matters pertaining to 'the
City's participation in the Texas Community Development Program,"
It was moved by-Councilwoman Dorman seconded by Councilman Jackson
to approve said Resolution. Motion carried unanimously.
Mayor Ridlehuber presented the following Consent Calendar for
approval. Mayor indicated that Mrs. Ailene Arnold had been
appointed to serve on the South Plains Association of Governments
Procurement Assistance Center Board of Directors as a representative
from Plainview.

"An Ordinance amending Chapter XX, Plainview Code to repeal
provisions therein concerning notice to Abate a Nuisance."
e) Consideration on second reading Ordinance No. 86-2669 entitled,
"An Ordinance amending Chapter II, Article VII, Plainview Code
providing for the inclusion of appraisal fees and advertising cost
in the evaluation of surplus real property upon disposition;
providing for a deposit by the requesting party; and. providing for
forfeiture of said deposit in the event surplus real property is not
sold."
f) Consideration of Resolution No. R86-178 entitled, "A Resolution
of the Mayor and City Council of the City of Plainview, Texas
awarding a bid for six police package vehicles for the Police
Department."
g) Consideration of Resolution No. R86-176 entitled, "A Resolution
of the Mayor and City Council of the City of Plainview, Texas
outlining what vehicles will be taxed for 1987."
h) Consideration of Resolution No. R86-177 entitled, "A Resolution
of the Mayor and City Council of the City of Plainview, Texas
nominating an individual to serve on the South Plains Association of
Goverr~ents Contract Procurement Assistance Center Board of
Directors."
i) Consideration'of Resolution No. R86-180 entitled, "A Resolution
of the Mayor and City Council of the City of Plainview, Texas
authorizing the Mayor to execute a Memorandum of Agreement and Lease
with the Plainview Chamber of Commerce." (Word Processing
Equipment)
j) Consideration of Resolution No. R86-179 entitled, "A Resolution
of the Mayor and City CoUncil of the City of Plainview, Texas
awarding bids for protective clothing for the Plainview Fire
Department."
k) Consideration of Resolution No. R86-181 entitled, "A Resolution
of the City Council of the City Plainview, Texas authorizing the
Mayor to enter into an Agreement with the Plainview Industrial
Foundation concerning funding toward a salary for and Industrial
Foundation Director."
ADJOURNMENT:
It was moved by Councilwoman Dorman seconded by Councilman Clements
to approve the Consent Calendar as presented. Motion carried
unanimouSly. ~

to adjourn the meeting. Meeting adjourned.
