A Resolution of the City of Plainview authorizing the use of an accessible
voting system in each polling place as required by Section 61.012 of the
Texas Election Code; changing the election date to the second Saturday of
May as required by Section 41.001(a) of the Texas Election Code; and
conducting early voting by personal appearance for at least twelve hours on
certain days as required by Section 85.006 of the Texas Election Code.
WHEREAS, Section 61.012 of the Texas Election Code requires that the City of Plainview
must provide at least one accessible voting system in each polling place used in a Texas
election on or after January 1, 2006. This system must comply with state and federal laws
setting the requirements for voting systems that permit voters with physical disabilities to
cast a secret ballot; and
WHEREAS, the Office of the Texas Secretary of State has certified that the eSlate System
v. 5.0 provided by Hart InterCivic, Inc. is an accessible voting system that may legally be
used in Texas elections; and
WHEREAS, Section 123.032 and 123.035 of the Texas Election Code authorizes the
acquisition of voting systems by local political subdivisions and further mandate certain
minimum requirements for contracts relating to the acquisition of such voting systems; and
WHEREAS, Section 41.001(a) of the Texas Election Code states each general or special
election in this state shall be held on one of the following dates: (1) the second Saturday in
May; (2) the first Tuesday after the first Monday in November; and
WHEREAS, City Charter provides the regular election shall be held on the first uniform
election date in May in each even-numbered year in the manner provided by law;
WHEREAS, Section 85.005 of the Texas Election Code states that in an election ordered
by a city, early voting by personal appearance at the main early voting polling place shall
be conducted for at least 12 hours: (1) on one weekday, if the early voting period consists
of less than six weekdays; or (2) on two weekdays, if the early voting period consists of six
or more weekdays.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLAINVIEW, TEXAS, THAT:
1. As chief elections officer of the City of Plainview, the City Secretary shall provide at
least one eSlate System v. 5.0 in each polling place in every polling location used to
conduct any election ordered on or after January 1, 2006. The eSlate System v. 5.0 may
be acquired by any legal means available to the City of Plainview, including but not limited
to lease or rental from the County of Hale or from any other legal sources, as authorized or
required by Sections 123.032 and 123.035, Texas Election Code.

2. In accordance with Section 41.001(a) of the Texas Election Code and accordance
with City Charter, each general or special election shall be held on the second Saturday in
May.
3. In accordance with Section 85.005 of the Texas Election Code, early voting by
personal appearance at the main early voting polling shall be conducted for at least 12
hours on one weekday, if the early voting period consists of less than six week days; or on
two weekdays, if the early voting period consists of six or more weekdays. The 12 hour
election days for the May 13, 2006 election will be Tuesday, May 2, 2006 and Tuesday,
May 9, 2006.
