RESOLUTION NO. R22-574
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW,
TEXAS, CALLING AND ORDERING A SPECIAL ELECTION TO AMEND
THE CODE OF ORDINANCES OF THE CITY OF PLAINVIEW BY
ENACTING AN ORDINANCE OUTLAWING ABORTION WITHIN THE
CITY OF PLAINVIEW AND DECLARING PLAINVIEW A SANCTUARY
CITY FOR THE UNBORN; SETTING THE DATE FOR THE SPECIAL
ELECTION; DESIGNATING POLLING PLACES; DESIGNATING EARLY
VOTING DATES, HOURS, AND LOCATIONS; AND POSTING NOTICE OF
ELECTION.
WHEREAS, on February 10, 2022, in accordance with Article X, Section 10.02 of
the Plainview City Charter, the City Secretary received a citizen initiative petition seeking,
by ordinance, to outlaw abortion within the municipal limits of Plainview and to declare
Plainview a sanctuary city for the unborn; and
WHEREAS, on February 25, 2022, in accordance with Article X, Section 10.04 of
the Plainview City Charter, the City Secretary certified that the citizens had obtained the
requisite verified signatures on the petition and the City Council accepted such
certification by Resolution No. R22-556; and
WHEREAS, on March 22, 2022, in accordance with Article X, Section 10.06, the
City Council voted to submit the proposed ordinance to a general city election to be held
on November 8, 2022; and
WHEREAS, in accordance with the statutes of the State of Texas and the Charter
of the City of Plainview, an election shall be held in and for the City of Plainview to be
held on the first Tuesday following the first Monday in November, the same being
November 8, 2022; and
WHEREAS, any political subdivision holding an Election on the November uniform
election date must use county election precincts and county polling places where that
political subdivision is located; and
WHEREAS, Section 85.001(a) provides that for an election held on the uniform
election date in November, the period for early voting by personal appearance begins on
the 17th day before election day and continues through the fourth day before election
day; and
WHEREAS, Section 85.005 (a) of the Texas Election Code further requires that in
an election ordered by a city, early voting by personal appearance at the main early voting
polling place shall be conducted for at least 9 hours each day of early voting; and
WHEREAS, all persons qualified to vote in said election under the Election Laws
of the State of Texas shall be allowed to vote therein.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLAINVIEW, TEXAS, THAT:

SECTION 1
An election shall be held in the City of Plainview, Texas on the 8th day of November,
2022. Said election shall be for the purpose of voting for or against the following
proposition:
THE CODE OF ORDINANCES OF THE CITY OF PLAINVIEW SHALL BE
AMENDED BY ENACTING AN ORDINANCE OUTLAWING ABORTION,
DECLARING PLAINVIEW A SANCTUARY CITY FOR THE UNBORN,
MAKING VARIOUS PROVISIONS AND FINDINGS, PROVIDING FOR
SEVERABILITY, AND ESTABLISHING AN EFFECTIVE DATE.

SECTION 2
All electors shall vote in the voting precinct district in which said voter resides, and
at the polling place provided for voting as designated in Section 3 of this Resolution.
SECTION 3
The election shall be held within the municipal limits of the City of Plainview
between the hours of 7:00 a.m. and 7:00 p.m. on November 8, 2022. The Election shall
occur at the following designated polling place(s), and with election officers to be
appointed by the Hale County Clerk to hold said Election:

SECTION 4
Early voting by personal appearance will be conducted each weekday at the
following locations:
Justice Center -Assembly Room- 225 Broadway, Plainview
Abernathy City Hall-811 Ave D, Abernathy
Lemond Community Center-110 Stevenson, Hale Center
Petersburg City Hall-1524 Main St, Petersburg
between the hours of 8:00 a.m. and 5:00 p.m. beginning on October 24, 2022 and ending
on Friday, November 4, 2022.
SECTION 5
A copy of this resolution shall also be served upon the election officials designated
to hold the election.
SECTION 6
Notice of this election shall be given in accordance with the provisions of the Texas
Election Code and returns of such notice shall be made as provided for in said Code.
