The City Council of the City of Plainview met on September 13, 2022 at 6:30 p.m., at City
Hall, 202 W. 5th Street, Plainview, Texas.
Mayor Charles Starnes presided. Council Members present were Mary Elizabeth
Dickerson -District 1, Mike McDonough -District 3, Gary House -District 4, Susan
Blackerby-District 5, and Lorie Rodriguez -District 7. Council Members Steve Martinez -
District 2 and Evan Weiss -District 6 were absent.
Staff members present were: Jeffrey Snyder -City Manager, Matthew Wade -City Attorney,
Jeff Johnston -Assistant City Manager, Isauro Gutierrez -Director of Information

6. An Ordinance of the City of Plainview, Texas, Adopting and Approving the Budget
for the Fiscal Year Beginning October 1, 2022 and Terminating September 30, 2023, a
Classification and Compensation Plan for all Employees, and Making Such
Appropriations for Each Department, Protect and Account; Authorizing the City Manager
to Make Certain Transfers of Funds: (Ordinance No. 22-3731 — First Readina)

7. An Ordinance of the Citv of Plainview. Texas. Settina and Levvina the Municipal
Ad Valorem Tax Rate for The Year 2022; Apportioning Said Levy Amongst the Various
Funds and Items for Which Revenue Must Be Raised; Fixing The Times in Which Said
Taxes Shall Be Paid; Providing for A Penalty, And Interest and Any Additional Penalty On
Taxes Not Timelv Paid: (Ordinance No. 22-3732 — First Readina)

Motion: Move that the property tax rate be increased by the adoption of a tax rate
of $0.8165 per $100 valuation, which is effectively a 5.98 percent increase in the tax rate.

8. An Ordinance of the City of Plainview, Texas, Amending Chapter 13, "Utilities" Of
The Code of Ordinances of the City of Plainview, Texas Increasing the Rates and
Charges for Water and Sewer Service Applicable to Residential and Commercial
Customer Classes; (Ordinance No. 22-3733 — First Reading)
Presenter: Jeffrey Snyder, City Manager
The Proposed budget incorporates a three percent increase to each of the steps in the
Water Conservation Step Rate Structure and Sewer Step Rate Structure. This will result
in an increase of $0.51 per month on a utility customer that uses 5,000 gallons per month.
There are no changes to the base rate.

9. An Ordinance of the Citv of Plainview Amendina Ordinance No. 21-3718 To
Appropriate Funds in The General Fund and Various Revenue and Capital Funds
Pursuant to Section 5.07 (A) And (D) Of The Plainview City Charter Allowing for
SUDDlemental Appropriations in The 2021-2022 Budaet: (Ordinance No. 22-3734 — First
Reading)

This Ordinance would amend the FY 2021-2022 Current Budget.

10. An Ordinance of the City Council of the City of Plainview Texas Approving a
Negotiated Settlement Between the Executive Committee of Cities Served By Atmos
West Texas ("Cities") and Atmos Energy Corp. West Texas Division Regarding the
Company's 2022 Rate Review Mechanism Filing; Declaring Existing Rates to be
Unreasonable; Adopting Tariffs That Reflect Rate Adjustments Consistent with the
Negotiated Settlement; Finding the Rates to be Set by the Attached Settlement Tariffs to
be Just and Reasonable and in the Public Interest; Approving an Attachment Establishing
a Benchmark for Pensions and Retiree Medical Benefits; Approving an Attachment
Regarding Amortization of Regulatory Liability; Requiring the Company to Reimburse
Cities' Reasonable Ratemaking Expenses; (Ordinance No. 22-3730 — Second Reading

11. Public Hearing on Annexation of approximately 8.00 (+/-) acre tract of land

This is a voluntary petition to be annexed into City Limits of Plainview for property at Andy
Taylor and Highway 70 on Northwest corner.

12. An Ordinance of the City of Plainview, Texas, Annexing the Territory Described
Herein to the City of Plainview, Hale County, Texas, and Extending the Boundary Limits
of the City of Plainview, Texas So As To Include the Property Described in the Ordinance
Within the City Limits, Granting to all the Inhabitants of Said Property all the Rights and
Privileges of Other Citizens and Binding Said Inhabitants by all of the Acts, Ordinances,
Resolutions, and Regulations of Said City Including Obligating Each Property Situated
Therein to Bear Its Pro Rata Share of Taxes Levied; Adopting a Plan for Municipal
Services for the Annexed Property. (Ordinance No. 22-3735 — First Reading)

13. Consider Award of Bid and Authorize the Purchase of a 2023 Mid -Size Commercial
Pickup for Community Development

Staff recommends Award of Bid to Smith Ford in the amount of $28,413.59.

Motion: Move to Authorize Purchase of a 2023 Mid -Size Commercial Pickup in the
amount of $28,413.59 with Smith Ford.

14. A Resolution of the City Council of the City of Plainview and Commissioners Court
of Hale County Authorizing the Submittal of a Grant Application for Funding Through the
Economic Development Administration, United States Department of Commerce
Planning and Technical Assistance Program; Designating Authorized Officials and
Authorizing Such Officials to Execute All Documents Necessary; and Pledging
Compliance to The Awarded Grants Program (Resolution R22-576)

The Resolution would authorize the submittal of a grant application to the Economic
Development Administration US Department of Commerce for the Plainview/Hale County
Airport terminal building and east ramp improvements.

15. Convene into closed session pursuant to Texas Gov't Code § 551.087 to discuss
or deliberate regardinq an offer of a financial or other incentive to a business prospect
that the City seeks to have locate, stay, or expand in or near the territory of the City of
Plainview.

16. Consideration of a Chapter 380 Agreement with GGHS Inc., properties, for the
demolition of 3002 W 4th Street, and 401 Canyon, Street.

Request is to demolish two dilapidated structures to build two two -bedroom duplexes at
$480,000 each. They are planning to purchase 90% of materials locally in Plainview.
