MINUTES
The Plainview City Council met in a regular City Council meeting at
7:30 p.m. on Tuesday, March 12, 1985 at City Hall in the Council
Chambers with Mayor Ridlehuber presiding and tb~ following
Councilmembers present: Junior Brown, Bobby James and Tom Aday. Staff
present: City Manager Jim Jeffers, Larry McEacb~rn, Norman Huggins, Tom
Riney, Bob Richards, Mike McDonough, Johnnie Ballew, Buddy Dodson, and
Larry McEachern.
Visitors present: Angela Cramor, Joe Jacob, Ric Woodward, Kathy
Baker, Richard Orr, Paul Wright and Darlene Wright.
Invocation was given by Norman Huggins, Director of Finance.
Bo~_ rd of Minimum Housing Standards. Mayor presented for
consideration on second and final read4.~g Ordinance No. 85-2591
entitled, "An Ordinance pr~iding a minimum standard of building
construction for existing cc~nercial and industrial buildings and a
rain/mum standard of construction for existing hen-residential buildings
within the City of Plainview, Texas; declaring its purpose; the method
of enforcement; providing for definitions; providing for structural
standard; space and occupancy standards, proper exists, fire standards,
delapidation or obsolescence, deteriorations or damage to existing
structures and buildings; defining dangerous buildings; providing for
the duties of the Code Enforcement Officer with the City of Plainview;
providing for the Board of Minimum N~using Standards to constitute the
board of appeals for this code; Providing for the Board of Minimum
StanSards to determine mininum standards for dangerous buildings ~thin
the City of Plainview; providing for performance of demolition and other
work by the City of Plainview; providing for the recovery of cost of
demolition and other works; providing for administrative remedies for
enforcement of mininum re~3~rements; providing for final appeal to the
District Court of Hale County, Texas; providing for Code Enforcement
search warrants; providing for a penalty; providing a severability
clause; providing an effective date for this ordinance; repealing
Ordinance No. 71-1159 and all former dangerous building codes
conflicting with the provisions of this ordinance." Bob Richards,
Director of Planning explained the ordinance. It was then moved by
Alderman Aday seconded by James to approve the ordinance on second and
final reading. Motion carried unanimously.
MiNIMD~4 HOUSING STANDARDS CODE. Mayor presented for consideration
on second and fin~l reading Ordinance NO. 85-2592 entitled, "An
Ordinance amending Ordinance NO. 83-2511; increasing the peD~lties for
violation of the Minimum Housing Standards Code frc~ a maximum fine of
$200 to a maxiaum fine of $1,000; deleting from the Minimum Housing code
the provision relating to the establishment of a special project
demolition fund for payment of the cost of repair and demolition of
sub-standard housing; Providing tb~t all delinquent asses~n~nts shall
bear interest at the highest rate allowed by law; Providing for a
severabilitY clause and an effective date of this ordinance." Bob
Richards explained the ordinance. It was then moved by Alderman ~lay
seconded by Alderman Brown to approve the ordinance on second and final
reading. Motion carried unanimously.
CONSENT CALENDAR: The Mayor presented the following to be approved
on consent:
a) Minutes of Previous Meetings.
b) Departmental Reports.
c) Budget expenditures.
d) GARDENVILLE SUB-DMSION. Consideration of Resolution No. R85-810
entitled, "Resolution o% the City Council of the City of Plainview,
Texas, approving the final plat of C~nrdenville sub-division, Unit No.
2, Plainview, Hale County, Texas."
e) C.B. JONES - PRELIMINARY PLAT. Consideration of Resolution No.
R85-811 entitled, "Resolution of the City Council of the City of
Plainview, Texas, approving the preliminary plat of C.B. Jones,
Unit No. 2, Plainview, Hale County,Texas."
f) Zone Case No. 503. Consideration on first reading Ordinance No.
85-2593 entitled, "An Ordi~nce amending zoning ordinance No. 82-2478
and the official zoning map of the City of Plainview so as to make
the following changes: Zone Case No. 503; P~quest of Martha Taylor
for a specific use permit, to operate a Day Care Center more than six
(6) children in an R-1 (Single-Family Residential) zoning district,
being Lot 9, Block 7, Junior High Addition, located at 2303 W. 20th
and calling a public hearing at 7:30 p.m. on March 27, 1985.
g) T.F~zNSE A6~F~N~i~T - CITY PROPER~Y. Consideration of Resolution No.
R85-812 entitled, "Resolution bf the City Council of the City of
Plainview, Texas, authorizing the Mayor to execute a lease agreement
with Loyd R. Mitchell for City property located at 1305 Austin St.
h) NOON OPTIMIST CIL~. Consideration of Resolution No. R85-813
entitled, "Resol~{ion of the City Council of the City of Plainview,
Texas granting to the Noon Optimist Club permission to lease space
for and to operate concessions in designated park areas of the City
of Plainview, precribing the conditions of such permission and
term for which said permission is granted."
i) COUNCIL MEETING. Consideration of Resolution No. R85-814 entitled,
"Resolution of the City Council of the City of Plainview, Texas,
changing a regularly scheduled_meeting date frcm March 26, 1985 to
March 27, 1985.
j) ~TE~N BRLI. TELEPHONE RATE CASE. Consideration of Resolution
No. R85-815 entitled, Resolution of the City Council of the City of
Plainview authorizing the Participation as an intervenor in the
anticipated rate increase request of Southwestern Bell Telephone.
It was moved by Alderman Aday seconded by Alderman Brown to approve
the Consent Calend~r as presented. Motion carried unanimously.
With no further business pending, it was moved by Alderman Aday
seconded by Alderman James to adjourn the meeting. Motion carried
~animously.
