The Plainview City Council mot in a regular Council Meeting, August
13, 1985 at 7:30 p.m. in the Council Chamber of City Hall with Mayor
Ridlehuber presiding and the following Councilmembers present: Barbara
Dorman, Andy Taylor, Junior Brown and Bobby James. Staff present: Ctiy
Manager Jim Jeffers, Tom Hamilton, Bill Hogge, Mike McDonough, Buddy
Dodson, and Sheryl Owen.
Invocation was given by Councilwoman Barbara Dorman.
Mayor Ridlehuber opened the meeting and welccmed the guests.
Mayor call for a public hearing on Zone Case No. 513; · Request of
Medlin Carpenter on behalf of the Plainview Industrial Foundation, Inc.
for rezoning a 97.56 acre tract of land consisting of 17.994 acres zoned
R-2 (Single-family Residential) and 79.566 acres zoned R-1 (Single-
Family Residential) located in the 3000-3200 blocks of N. Quincy St.
Mike McDonough explained the zone case. It was moved by Alderman James
seconded by Alderman Taylor to open the public hearing. Mayor asked for
cc~-~nts. Medlin Carpenter spoke in favor of the zone request. With
no further re~rks made, it was moved by Alderwoman Dorman seconded by
Alderman Taylor to close the public hearing.
Mayor present for consideration on second and final reading,
Ordinance No. 85-2598, entitled, "An Ordinance amending zoning ordinance
no. 82-2478 and the official zoning map of the City of Plainview so as
to make the following changes: Zone Case No. 513; Request of Medlin
Carpenter on behalf of the Plainview Industrial Foundation, Inc. for
rezoning a 97.56 acre tract of land consisting of 17.994 acres zoned R-2
(Single-family Residential) and 79.566 acres zoned R-1 (Single-
Family Residential) located in the 3000-3200 blocks of N. Quincy St."
It was moved by Alderrmtn James seconded by Alderman Brown to approve the
zone case. Motion carried unanimously.
Mayor called a public hearing on Zone Case No. 514; Request of Bill
Ccokston for rezoning Lot 10, Block 65, College Hill Addition, located
at 512 Wayland Street, Plainview, Hale County, Texas, frc~ an MF-2
(Multi-Family Residential) zoning district to a CRD (Ccrarercial R~tail
District) zoning district. Mike McDonough explained the zone case. It
was then moved by Alderwoman Dorman seconded by Alderman Taylor to open
the public hearing. Mr. Ed Self spoke on behalf of Mr. Bill Cookston .
With no further remarks to be made, it was moved by Alderman Brown
seconded by Alderman Taylor to close the public hearing.
Mayor presented for consideration on second and final reading
Ordinance No. 85-2599 entitled, "An Ordinance amending Ordinance No.
82-2478 and the official map of the City of Plainview so as to make the
following changes: Zone Case No. 514; Request of Bill Cookston for
rezoning Lot 10, Block 65, College Hill Addition, located at 512 Wayland
St., Plainview, Hale County, Texas, frc~ an MF-2 (M~lti-family
Residential) zoning district to a CRD (Con~ercial Retail District)
zoning district." It was moved by Alderman Taylor seconded by Alderman
Brown to approve the ordinance. Fbtion carried unanimously.
Mayor called public hearing on abandonment of a portion of
right-of-way along the north edge of east 8th Street, Plainview, Texas.
It was moved by Alderwcman Dorman seconded by Alderman Taylor to open
the public hearing. Mr. Bob Bass explained the right-of-way that was to
be abandoned. With no further remarks, it was moved by Alderwoman
Dorman seconded by Alderman James to close the public hearing.
Mayor presented for consideration on second and final reading
Ordinance No. 85-2596 entitled, "An Ordinance to abandon a part of the
right-of-way in Blocks 1 and 2, A.L. Maupin sub-division, Plainview,
Hale County, Texas; declaring that the abandonment of said part of the
right-of-way is in the public interest and providing for a right-of-way
easement for ingress and egress to portions of Blocks 1 and 2, A.L.
Maupin sub-divison, Lots 0,1,2,3,4,5,6,7 & 8." It was moved by
Alderwc~m~ Dorman seconded by Alderman Brown to approve the ordinance.
FDtion carried unanimously.
Mayor presented for consideration on second and final reading
Ordinance No. 85-2600 entitled, "An Ordinance repealing ordinance No.
77-2173, 77-2171, 77-2172, and 77-2108 and establishing the fees to be
charged for Building, Electrical, and Plumbing peri, its, and Zoning and
Board of Adjustment applications." Mike McDonough explained the new
fees that were proposed and explained that they had be explained to each
of the Boards. It was then moved by Adlerman James seconded by Alderman
Brown to approve the fee change. Motion carried unanimously.
Mayor presented for consideration, Resolution No. R85-887 entitled,
"R~solution of the City Council of the City of Plainview, Texas calling
for a public hearing to be conducted in order to receive input
concerning the proposed designation of a reinvestment zone."
It was moved by Alderwcman Dorman seconded by Alderman Taylor to call a
public hearing concerning the proposed reinvestment zone. Mction
carried unanimously°
Mayor presented for consideration, Resolution No. R85-871 entitled,
"Resolution of the City Council of the City of Plainview, Texas,
approving the final plat of Watergate Addition, Unit No. 2, Plainview,
Hale County, Texas. Tom Hamilton explained that this resolution was
tabled at the last meeting due to the one of the residents on Jefferson
Drive, he explained that several attempts had been made to contact their
Attorney by phone and letter but was unable to. It was then moved by
Alderman James seconded by Alderwoman Dorman to approve the resolution.
Motion carried unanimously.
The City Council then approved the following items as a Consent

Consideration of Resolution No. R85-878 entitled, "Resolution of the
City Council of the City of Pla/nview, Texas, appointing a member to
the Planning and Zoning Commission due to a vacancy."

Consideration on first reading, Ordinance No. 85-2601 entitled, "An
Ordinance of the City of Plainview, Texas repealing Sections 6-16
through 6-46, inclusive, of the PlainviewCode." (Public Dances)
F)
Consideration of Resolution No. R85-882 entitled, "AResolution of
the City Council of the City of Plainview, Texas authorizing the
Mayor to execute MutualAidAgreementswiththe Cities of Hale
Center, Kress, Lockney, Floydada, Petersburg, Olton, Abernathy,
Tulia and Silverton."

Consideration of B~solution No. R85-888 entitled, "A Resolution of
the City Council of the City of Plainview, Texas authorizing the
paving of a portion of the alley at 708 Lexington Street, at the
cost of the owD~r of the property."

Consideration of Resolution No. R85-883 entitled, "AResolution of
the City Council of the City of Plainview, Texas appropriating $1,200
to the Energas Gas Steering Cc~mittee."

Consideration of Resolution No. R85-886 entitled, "A R~solution of
the City Council of the City of Plainview, Texas, authorizing final
payment to Espey, Hutson and Associates, Inc., for providing
statistical/analytical support for Plainview's CityCouncil
redistricting effort."

Consideration of Resolution No. R85-889 entitled, "AResolution of
the CityCouncil of the City of Plainview, Texas establishing a date
for a public hearing for the 1985-86 Budget and the relationship of
general revenue sharing funds tot/sat budget." Council called a
work session forBudget preparation for Thursday, August 15, 1985,
at the Holiday Inn at 11:30 a.m.

Consideration on first reading, Ordinance No. 85-2603 entitled, "An
Ordinance repealing portions of Section 32 of the Plainview Code;
Establishing a defense for operating a vehicle with a carrying
capacity in excess of one ton upon certain streets within the City
of Plainview; and defining c~,~rcial purpose and person as used
herein."

Consideration of Resolution No. R85-880 entitled, "AResolution of
the City Council of the City of Plainview, Texas, authorizing the
Mayor to execute an AirportGroundLeaseAgreementwithDr. Dana
Segler."
Consideration of Resolution No. R85-890 entitled, "A Resolution of
the City Council of the City of Plainview, Texas reappointing No~man
Wright as a member of the Board of Directors of the Canadian River
Municipal Water Authority."

Consideration of Resolution No. R85-881 en%itled, "A Resolution of
the City Council of the City of Plainview, Texas agreeing to the
termination of a contract with Perdue, BrandDn, Blair and Fielder,
Attorneys at Law, for the collection of delinquent taxes."

Consideration of Resolution No. R85-891 entitled, "A Resolution of
the City Council of the City of Plainview, Texas urging the United
States Congress to enact no Legislation to tax or restrict the
continued issuance of tax-exempt obligations by State and Local
Governments."

Consideration on first reading, Ordinance No. 85-2604 entitled, "An
Ordinance amending the budget of the City of Plainview for the fiscal
year October 1, 1984 ~hrough September 30, 1985, by making certain
changes in funds in specified amounts as more fully described herein,
and providing for an effective date."

Consideration of Resolution No. R85-879 entitled, "A Resolution of
the City Council of the City of Plainview, Texas authorizing the
preparation of specifications for roof repairs to Unger Memorial
Library, Police/M~nicipal Court Building and City Hall and
authorizing the City Staff to proceed with advertising for bids on
the three (3) buildings; authorizing City Staff to proceed to
negotiate for roof repairs at the City Service Center, Central Fire
Station, and Chamber of Coam~rce Building which are not required to
be bid as the repairs to the individual buildings do not exceed
$5,000 each; and authorizing an appropriation for these roof
repairs."
Mayor Ridlehuber explained that on Item "D" that Mr. Jim Porter had
been appointed to the Planning and Zoning Board, and that Ite~ "L" had
been tabled until further notice. The request was made that Item "R" be
lifted from the Consent Calendar. Mr. J.B. Roberts then explained that
the need for adequate housing in Plainview was a very serious problem
and that a in depth study for master housing and finding sc~e relief ~
from the zoning and building restrictions were needed.
It was moved by Alderman TaYlor seconded by Alderwcman Dorman to
approve the C~nsent Calendar with the above stated exceptions.
Motion carried unaimously.
R) Consideration of Resolution No. R85-892 entitled, "A Resolution of
the City Council of the City of Plainview, Texas approving the final
plat of Wal-Mart Addition, Plainview, Hale County, Texas." Tcm Hamilton
explained that the Resolution could be passed at the present time but
would not go in to effect until the deed was approved. It was then
moved by Alderwoman Dorman seconded by Alderman James to approve the
resolution based on Mr. Hamilton's rec~endation. Motion carried
unanimously.
Mayor Ridlehuber called for an executive session for the discussion
of pending litigation as authorized by Article 6252-17, Section 2 (e),
V.T.C.S.
The City Council returned to the Council Chambers from an executive
session at 8:49 p.m. and it was moved by Adl~ Dorman seconded by
Alderman James. Motion carried unanimously.
With no further business pending the meeting adjourned.
