HomeMy WebLinkAbout72 1120 minMINUTES CITY COUNCIL REGULAR MEETING November 20, 197-2 The City Council o£ the City'of Plainview met in-regular session at 7:30 p.m. in the CoUncil Chambers of'~the City Hall with Mayor Johm D. Stoneham presiding and the following Aldermen present: Keltz Garrison,. Neal Williams, Medlin Carpenter, Richard Cross, and Jack Oswald. Also present were Marshall PharrZCity Manager, Joe Sharp-City Attorney, M. L. Rea-City Clerk, Wm. R. Hogge-Director of Public Works, Harold Gladman- Director of Planning, Johnnie Bal~ew-Director of Public Safety, Robert Barnett- Director of Parks & Recreation, Norman Huggins-Director of Finance, and Larry Martin-Administrative Assistant. .Visitors included James Pe.terson, J. C. Cobb, and W. J. McCourt. Invocation was given by Mayor Stoneham. Discussion was held on Zone Case No. 229, request of Mr. J. D. Cobb for rezoning of the West 100 feet of Lot 16, all of Lot 18, Block 1, Grandview Addition Revised, from a R-2 Zone to a R-3 Zone for multi-family use, located. at 3610 and 3611 Grandview Drive. It was moved by Alderman Williams, seconded by Alderman Carpenter, to adopt Ordinance No. 72-1293, an ordinance amending the Zoning Map of the City of Plainview as proposed in Zone Case No. 229. Motion carried unanimously. Discussion was held on Zone Case No. 230, request of Mr. J. D. Cobb for rezoning of Lots 1 & 2, Hilltop Addition and a tract of land out of the Northeast quarter of Section Number twenty-eight (28), Block JK-2, Hale County, Texas, from a R-1 Zone to a C-1 Zone for commercial use located at 3211 Olton Road. It was moved by Alderman Garrison, seconded by Alderman Oswald, to adopt Ordinance No. 72-1294, an ordinance amending the Zoning Map of the City of Plainview as proposed in Zone Case No. 230. Motion carried unanimously. Discussion was held on Zone Case No. 231, request of Mr. Dee Martin, for rezoning of the West 6 inches of Lot 2, all of Lot 3, Block 54, College Hill Addition, from a C-1 Zone to a C-2 Zone for commercial use, located at 2103 West 5th. It was moved by Alderman Oswald, seconded by Alderman Cross, to adopt Ordinance No. 72-1295, an ordinance amending the Zoning Map of the City of Plainview as proposed in Zone Case No. 231. Motion carried unanimously. MINUTES CITY COUNCIL REGULAR MEETING November 20, 1972 Page 2 Discussion was held on the public hearing conducted on the proposed transfer of the taXicabfranchise from Jimmy L. Douglas to Robert L. Kernell. It was moved by Alderman Carpenter,. seconded by Alderman Garris~n,.~to 'postpone action until further study and investigation can be made. Motion carried unanimously. It was moved by AldermanWilliams, seconded by Alderman Garrison, to adopt a Resolution .approving the request of Bass Broadcasting Company for the assignment of the Cable TV franchise in Plainview to Teleservice Corporation of America. Motion carried unanimously. It was moved by Alderman Garrison, seconded by Alderman Williams, to authorize the City Manager to advertise for bids to be received on December 14th for the purchase of refuse collection equipment, to approve the specifications for the purchase of this equipment, and to accept a contract with the local banks for payment of this equipment with Certificates of Obligation. Motion carried unanimously. It was moved by Alderman Oswald, seconded by Alderman Carpenter, to approve upon receipt of the federal revenue sharing funds the following percentages for payment of amortization of the solid waste collection and disposal system and for code enforcement: 45% for solid waste collection and 45% for solid waste disposal (or 90% to be used on whichever project is needed most at the~ time the funds are received), and 10% for code enforcement. Motion carried unanimously. It was moved by Alderman Garrison, seconded by Alderman Oswald, to authorize the advertising of bids to be received December 18th for the purchase of a street sweeper for the Street Department and a tractor mower for the Water Treatment Plant. Motion carried unanimc~sly. It was moved by Alderman Carpenter, seconded by AldermanWilliams, to approve the minutes of the regular City Council meeting held November 6, 1972. Motion carried unanimously. Received for filing were copies of the minutes of the Board of Adjustment meeting held October 24th, minutes of the Planning and Zoning Commission meeting held November 9th, and minutes of the Community & Neighborhood Improvement MINUTES CITY COUNCIL REGULAR M~ETING November 20, 1972 page 3 Committee meeting held November 14, 1972.' .It was moved by Ald~rman Williams, seconded by AldermanCros~ ~o~adopt' Ordinance No. 72-1296, an ordinance providing for-two hour park~, ~,?~ the south side of that part of East 7th Street beginning 15 feet eas~ the east curb line of Ash Street and extending east 140 feet to the ai~' .... Motion carried unanimously. It was moved by ~Alderman Cross, seconded by Alderman G~rrison,'to adopt Ordinance No. 72-1297, an ordinance providing that motor vehicles shall be parked at a 25© angle on 'both sides of that portion of West 3rd Street betWeen Broadway Street and Austin Street in the City of Plainview. Motion Carried unanimously. Discussion was held on a request from Southwestern Public Service Company for a rate increase applicable to municipal general lighting and power services except for street ~ighting services under the present contract. Action was deferredUntil further study can be made. Discussion was held on the proposed neighborhood analysis and inventory in cooperation with the Community Improvement Council and Neighborhood Improve- ment Con~nittee and also on the proposed guidelines for ~ode enforcement through use of revenue sharing funds. It was moved by Alderman Cross, seconded by Alderman Oswald, to approve the appointment of Argie Mae Evans to the Neighborhood Improvement Committee, Area 2, replacing Garland Ray. Motion carried unanimously~ Received for filing was a current printout of the present board, committee, and commission members and a cgpy of the City of Plainview Newsletter, Volume III, Issue 24. It was moved byAldermanWilliams, seconded by Alderman Cross, to authorize the advertising of a notice of a public hearing to be held December~4th on the request of Mr. Orville Atkinson for annexation of 8.89 acres of land southeast of ~estridge Addition on Kirchwood Road. Motion carriedunanimously. (GOVERNING BODY) RESOLUTION RESOLUTION APPROVING APPLICATION FOR PRELIMINARY LOAN FOR LOW-RENT PUBLIC HOUSING WHEREAS, it is the policy of this locality to eliminate substandard and other inadequate housing, to prevent the spread of slums and blight, and to realize as soon as feasible the goal of a decent home in a suitable living environment for all of its citizens; and WHEREAS, under the provisions of the United States Housing Act of 1937, as amended, the Department of Housing and Urban Development is authorized to provide financial assistance to local public housing agencies for undertaking and carrying out preliminary planning of low-rent housing projects that will assist in meeting this goal; and WHEREAS, the Act provides that there shall be local determination of need for low-rent housing to meet needs not being adequately met by private enter- prise and that the Department of Housing and Urban Development shall not make any contract with a public housing agency for preliminary loans for surveys and planning in respect to any low-rent housing projects unless the governing body of the locality involved has by resolution approved the~application of the public housing agency for such preliminary loan; and WHEREAS, the Housing Authority of the City of Plainview , Texas (herein called the "Local Authority")_ is a public housing agency and is applying to the Department of Housing and Urban Development for a preliminary loan to cover the costs of surveys and planning in connection with the development of low-rent housing. NOW, THEREFORE, be it resolved by the City Council of the ~ City of Plainview .., Texas, as follows: I. There exists in the City of Plainview , Texas a need for such low-rent housing at rents within the means of low-income families; 2. The application of the Local Authority to the Department of Housing and Urban Development for a preliminary loan in an amount not to exeeed $400 per d.u. for surveys and planning in connection with low-rent housing projects of not to exceed approximately 200 dwelling units is hereby approved. (Closing Minutes -- Governing Body) The Resolution was read in full, considered and discussed. Mr. Carpenter moved its adoption and Mr. Cross seconded the motion. On roll call the following vote was recorded: AYES: Richard Cross, Medlin Carpenter, Neal Williams, Keltz Garrison, and NAYS: (Names) None Jack Oswald (Names) Thereupon the Resolution was declared duly adopted and passed. D. 1972, with all members present, the following resolution was introduced by the Mayor and on Motion duly made and seconded was passed and adopted by unanimous vote of the City Council. A RESOLUTION WHEREAS, the Bass Broadcasting Company has requested an assignment of all of its interests and rights granted by the City of Plainview by Ordinance No. 795 for the CATV franchise in the City of Plainview, which Ordinance is dated September 16, 1963, as amended by Ordinance No. 64-814 and Ordinance No. 67-986 to Teleservice Corporation of America, a Texas corporation~ NOW THEREFORE; "BE IT RESOLVED, by the City Council of the City of Plainview that the Mayor of the ~ity of Plainview is hereby authorized and directed to sign a transfer of such rights, Conditioned upon the agreement by Teleservice Corporation of America to abide by and be. bound by all of the terms and conditions of the said franchise granted by the Ordinances of the City of Plainview, above referred to, together with all of the terms and conditions of said Ordinances; and that the said Teleservice Corporation of America shall, either contemporaneous with or prior to the transfer and assignment, file an instrument bind- lng upon said corporation agreeing to be bound by said conditions and provisions and agreeing to perform all of the obligations as may be provided in said franchise as granted and provided for in the above mentioned Ordinances".
