HomeMy WebLinkAbout73 1119 minMINUTES CITY COUNCIL REGULAR MEETING November 19, 1973 The City Council of the City of Plainview met in regular session at 7:40 p.m. in the Council Chambers of the City Hall with Mayor John D~ Stoneham p~residing and the following Aldermen present: Keltz Garrison, Medlin Carpenter, Neal Williams, Richard Cross, and Jack Oswald. Also present were Marshall Pharr-City Manager, Joe Sharp-City Attorney, M. L. Rea-City Clerk, Wm. R. Hogge.-Director of Public Works, Harold Gladman- Director of Planning, Johnnie Ballew-Director of Public Safety, Norman Huggins- Director of Finance, Robert Barnett-Director of Parks & Recreation, Mike McGregor-Administrative Assistant, Mike Jackson-Traffic Safety Coordinator, Bob Richards-Building Inspector, and Linda Fisch-AdmJ~istrative Secretary. Visitors included Kanit Smutrat, Mrs. Mary A. Nye, A. C. Swarmer, Willard Brymer, Mrs. ~Pat Ryan, Etpidio Renteria, W. W. Allen, James Robison, Jack Williams, Calvin Brow, John C. Anderson, Romey Fermell, Jr., Lawrence Lowe, Oscar Butlar, Jack Skaggs, Jesse Richardson, Kelly Mack Sears, L. Jack Payne, Obed Foote, and Wendell Holloman-Plainview Da~ily Herald. Invocation was given by Alderman Cross. ~-Jack Skaggs was administered the oath of office as a member of the Canadian River Municipal Water Authority by 'City AttOrney, Joe Sharp. ~ The following were presented a certificate of appointment to various boards and committees: Canadian River Municipal Water Authority - Jack Skaggs; Board of Adjustment - Oscar Butlar; Plainview Housing Authority - John Anderson, Romey Fennell, Jr., and Jack Payne; Community Improvement Committee - Jack. Swanner; and Neighborhood Improvement Committee Calvin Brow, Elpidio Renteria, Willard Brymer,' Mrs.. Mary A. Nye, Mrs. Pat Ryan, Lawrence Lowe, Jack Williams, Kelly Mack Sears, and Obed Foote. It was moved by Alderman Carpenter, seconded by Alderman Williams, to 'adopt Ordinance No. 73-1443, an ordinance amending the Zoning Map of the City of Plainview as proposed~in Zone Case No[ '241, request of Jesse Richardson for rezoning of Lots 6, 7, and 8, Block 79, Alexander-Westmoreland Addition from a R-2 Zone to a R-3 Zone for use of multi-d~ellings located at 703-705 Fresno. Motion carried unanimously. The bid was awarded to-Mr. B. C. 'Goree ~with a high bid of $31,550'.00. - Received for filing was a tabulation of bids for Water and sewer extensions for the Cit3T of Plainview to the north Plainview Industrial Foundation Park. At the speCial. Cbfin¢il meeting on,Thursday, November 15th, it was moved by. Alderman Cross, seconded-By. Alderman Garrison, to award the bid to Holloway Contracting Company in the amount of $73,319.45. Motion carried unanimously.. A bidW~ receive'~ for the sale of property owned by the City. of Plainvi.ew in trust for the Unger Memorial Library in the vicinity of 707 Broadway. A bid of $9,000 was .made~'by Mr. 'Joe Don Hancock. The;bid was not accepted since it was under the appraised value of $10,500-and state.law prohibits the City to accept a bid in thi~ manner. It was moved by Alderman Garrison, seconded by Alderman Williams, to adopt Ordinance No. ~73-1444, an ordinance prohibiting the sale of alcoholic beverages where the place of business of any such dealer is within 300 feet of any church, public school~ or public hospital in the City of Plainview. Motion carried unanimously. . It was moved by Alderman Oswald, seconded by Alderman Cross, to adopt Ordinance No. 73-1445, an ordinance regulating traffic pertaining to fUnerJl processions or parades or other processions within the city limits of the City of Plainview.. Motion carried unanimously. ReceiYed for filing was a copy of the administrative policy concerning conservation of fuel and energy. It was moved by Alderman Carpenter, seconded by Alderman Cross, to authorize an environmental impact study be included in the proposed Airport Master Plan as recommended by a joint meeting of the City/County Airport Board, the Federal Aviation Administration, the Chamber of Commerce Airport Committee, and Parkhill, Smith & Cooper, Inc. Motion carried unanimously. It was moved by Alderman Oswald, seconded by Alderman Garrison, to approve an amendment to the City of Plainview Personnel Rules and Regulations'for the increase to 12~ per mile for the map distance plus a reasonable mileage figure for in-town travel where the use of a private automobile is approved. Motion carried unanimously. It was moved by Alderman Williams, seconded by Alderman cross, to app~ve the following reorganization of the Youth Advisory Committee as. established by the Prioities of the 70's: The Youth Advisory Committee shall consist of a nine member committee to be composed of three representatives' from Wayland Baptist College, three representatives from Plainview High School, and three being at large and each member being under the age of 21 years. MINO~FES CITY COUNCIL REGULAR MEETING November 19, 1973 Page 5 It was moved ~Y Alderman Willia~ns, seconded by Alderman Garrison, to approve a resoluti°n providing for an easement for the following to be~ constructed al0hg the sidewalk area on the south boundary line of Sixth Street and on the west side of AustJ_n~-Street adjacent to the Hale County State Bank building: 1o A planting area to be 4 feet wide on the east and north sides of the building, 2.A sidewalk freight elevator to be located on the north side of the building, and 3. A concrete veneer brick wall adjacent to the north and east wall of the present building. Motion carried unanimously. It was moved by Alderman Williams, seconded by Alderman Garrison, to approve the increase of the $10.00 l~t on Instant Payment Orders to $25.00. Motion carried unanimously. Discussion was held on a request Of Luther Bain for the exchange of property owned by .MRS. S. E. Curry and Mr. Bain consisting of approximately 15 acres in the John Kiser Addition for the property owned by the City of Plainview lying east of the~ Chamber of Commerce building. It was moved by Alderman Garrison, s9conded by Alderman Williams, to authorize an appraisal to be made on the Curry property for consideration of exchange. Motion carried unanimously. It was moved by Alderman Oswald, i seconded by Alderman Williams, to adopt Appropriation Ordinance No. 73-1446 from the Pro Rata Construction Account-434 in the amount of $1,999.31 payable to Can-Tex Industries for clay pipe for stock purposes. Motion carried unanimously. It was moved by Alderman Williams, seconded by Alderman Cross, to approve a release on Lot 17, Block 7, Montrose Addition lo ~cated at 606 West 20th for a mowing assessmeht. Motion carried unanimously. It was moved, by Alderman Garrison, seconded by Alderman Oswald, to authorize permanent electzical outlets to be installed at the Broadway Stre-~t park to accommodate travel trailers. We are also sending a copy to Hale County State Bank Plainview, Texas and in the event there are any c! the Bank or either of you, please call that we can make the changes, correcti, before the next Council meeting. STATE OF TEXAS ~ : COUNTY OF HALE ~( : CITY OF PLAINVIEW ~ BE IT KNOWN that on this the /~-J day of November, 1973 at a regular meeting of the City Council of the City of Plainview held in the City Hall of said City a quorum being present the following Resolution was introduced and on motion duly made and seconded that it was unanimously passed by the City Council of the City of Plainview; said Resolution as follows: A RESOLUTION BE IT RESOLVED that the City of Plainview grant and convey to Hale County State Bank, Plainview, Texas the easement and permission for the use of that part of the sidewalk area existing along the South boundary line of 6th Street and adjacent to the bank building of Hale County State Bank and existing along the West side of Austin Street and adjacent to the bank building of Hale County State Bank for the uses and purposes as set out in the form of the easement attached to this Resolution which said form of easement attached to this Resolution is hereby made a part of this Resolution for all intents and purposes so as to more particularly describe the easement to be granted and hereby granted to the said Hale County State Bank, Plainview, Texas. BE IT FURTHER RESOLVED that the Mayor of the City of Plainview be and he is hereby authorized and directed to execute said easement and the City Clerk is hereby authorized and directed to Attest the same and deliver the same to the Hale County State Bank, Pla~view, Texas. The same will be located adjacent to the building, but extending out on the sidewalk area 6 feet North and South and 6 feet East and West. The same to be equipped with an automatic closing cover which will remain closed at all times when the elevator is not in use. And,~ WHEREAS, the plans of the architect call for cast concrete veneer to be erected adjacent to the brick wall Which will extend 5 1/2 inches over onto the present sidewalk whic~ is-on the street right-of-way and, WHEREAS, Hale County State Bank Plainview, Texas has petitioned the City Council of the City of Plainview for an easement over and on said sidewalk area on that part of 6th Street and that part of Austin Street along the North and East sides of the'building for the purposes aforesaid. And said Bank has agreed to indemnify and hold the City harmless from any and all damages, causes of action, expenses or attorney fees or damages or expenses of any kind caused by the erection, maintenance, or operation of said elevator, or by reason of the granting of this easement, planter area and cast concrete veneer to be placed along the side of said building as hereinabove set out; NOW THEREFORE in consideration of the premises the City of Plainview does grant and convey to Hale County State Bank, Plainview, Texas an easement t.o erect, maintain or operate, on the said sidewalk area on the South boundary line of 6th Street and adjacent to the Hale County State Bank building hereinabove described, and on the West side of Austin Street and adjacent to Hale County State Bank building hereinabove described; A planting area to be 4 feet wide on the East and North sides of said building and, A sidewalk freight elevator to be located on the North side of the Bank building on the sidewalk herein on the South boundary line of 6th Street approximately 49 feet West of the Northeast corner of the building, but extending out on the s{dewalk area 6 feet North and South and 6 feet East an~ West.
