The Plainview City Council met on October 24, 2006 at 7:00 p.m. in the City Council
Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting
was posted in City Hall at 4:30 p.m. on October 20, 2006. Mayor John C. Anderson
presided. Councilmembers present were: Kelvin Tipton-District 1, Cathy Waggoner-
District 2, Belinda Pena-District 3, Ron Truster-District 5, Wendell Dunlap-District 6 and
Roland Nash-District 7. Councilmember John N. Bertsch-District 4 was absent.
Staff members present were: Greg Ingham-City Manager, John Castro-Director of
Community Services, John Berry-Director of Public Works, Gary Glass-Fire Chief, Will
Mull-Police Chief, Dale Simpson-Civil Service Director, Brice Clements-Engineer and
Belinda Hinojosa-City Secretary.

Councilmember Belinda Pena delivered the invocation.
Mayor John C. Anderson led in the Pledge of Allegiance.
Councilmember Wendell Dunlap moved to adopt the consent calendar. The motion was
duly seconded by Councilmember Kelvin Tipton and carried by unanimous vote. Items
approved on the consent calendar included approval of the minutes of September 26,
2006, September 28, 2006 and October 5, 2006; the granting of an excused ab§ence
to Councilmember John N. Bertsch; and the approval of the financial reports.
Brice Clements, Engineer presented for consideration Ordinance No. 06-3475, an
Ordinance Amending the Zoning Map of the City of Plainview, Texas for Closing of a
Twenty Foot Alley Located South of and Adjacent to the East 17.5 Feet of Lot 17 and
all of Lots 18-27, White's Subdivision of Blocks 31 and 42, College Hill Addition to the
City of Plainview, Hale County, Texas; Cumulativeness Clause; Conflict Clause;
Severability Clause; And Effective Date. He stated the applicant is CVS Pharmacy.
The property is located south of Highway 70 and west of Quincy. The alley is between
Lots 17 through 27. The alley is closed to ingress and egress and this ordinance closes
the utility easement under this surface. The previous alley has been abandoned and
moved to the dedicated alley. City staff recommends the alley be closed.
Mayor Anderson asked for public comment. There was no public comment.
Councilmember Pena moved to approve Ordinance No. 06-3475 upon first reading.
The motion was duly seconded by Councilmember Waggoner and carried by
unanimous vote.
Brice Clements, Engineer presented for consideration Ordinance No. 06-3476, an
Ordinance Amending the Zoning Map of the City of Plainview, Texas for Closing of a
Twenty Foot Alley Located as Being a 0.27 Acre Portion of the South Leg of Two Alley
Dedications out of the NE Part of Survey 29, Block JK-2, Plainview Christian Academy
Addition to the City of Plainview, Hale County, Texas; Cumulativeness Clause; Conflict
Clause; Severability Clause; And Effective Date. The applicant is Plainview Christian
Academy. The area is located south of Southwest Third and just west of Ennis. It is
bordered on the west side by Garland Street. This is a request to close a portion of the
alley. The requested alley does not have any utilities and all utility companies have

approved the closing of this portion of the alley. The 2"d reading of this ordinance along
with the replat of this property will be on the November 14th agenda. He stated staff
recommends approval to close this portion of this alley.
Mayor Anderson asked for public comment. There was no public comment.
Councilmember Truster moved to approve upon second reading Ordinance No. 06-3476.
The motion was duly seconded by Councilmember Tipton and carried by unanimous vote.
There being no further business, Mayor Anderson adjourned the meeting at 7:15 p.m.
