R23-608 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS APPOINTING THE MEMBERS OF THE BOARD OF DIRECTORS OF TAX INCREMENT REINVESTMENT ZONE NUMBER ONE (TIRZ #1), HISTORIC DOWNTOWN PLAINVIEW, TEXAS; APPOINTING ONE MEMBER OF THE BOARD TO SERVE AS CHAIRPERSON FOR THE CURRENT YEAR; AND PROVIDING FOR OTHER MATTERS RELATING TO SUCH BOARD. WHEREAS, on May 8, 2018, the City Council of the City of Plainview, Texas adopted Ordinance No. 18-3677, which created Tax Increment Reinvestment Zone #1, Historic Downtown Plainview, Texas (the "Zone") and established a Board of Directors for the Zone as authorized and in accordance with the Tax Increment Financing Act (the "Act"), Chapter 311 of the Texas Tax Code, Vernon's Texas Code Annotated; and WHEREAS, Section 3 of Ordinance No. 18-3677 creating the Zone states: Section 3. Board of Directors A board of directors ("Board") for the Zone is hereby created. The Board shall consist of seven (7) members who shall serve for terms of two (2) years each. The Board shall be appointed as follows: 3.1 Of the seven (7) Board members, Council shall appoint five (5) members, with three (3) of the five (5) Council appointees being specifically comprised of one (1) member from each of the following organizations: Plainview Downtown Association, Main Street Board and the Plainview -Hale County Economic Development Corporation. Hale County may, but is not required to, appoint two (2) members. Council shall appoint members as is necessary to fill the remaining positions, if Hale County does not appoint their allotment. All members appointed to the Board shall meet the eligibility requirements as set forth in Section 311.009 of the Texas Tax Code. Such members may be members of the City Council. 3.2 Council shall annually designate a member of the Board to serve as chairperson of the Board, and the Board shall elect from its members a vice chairperson or other officers as it considers appropriate. Resolution R23-608 TIRZ #1 Board Appointment Page 1 of 3 356 WHEREAS, Section 311.009(e) of the Texas Tax Code states that "To be eligible for appointment to the board by the governing bod of the municipality, an individual must be at least 18 years of age and: (A) be a resident of the county in which the zone is located or a county adjacent to that county; or (B) own real property in the zone, whether or not the individual resides in the county in which the zone is located or a county adjacent to that county. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Plainview that: The City Council of the City of Plainview hereby appoints the following individuals and accepts Hale County's appointments, all meeting the requirements of Section 311.009(e) of the Texas Tax Code, to the Board of Directors of the Zone until June 30, 2023, commencing on the effective date of this resolution: Position 1 (City Appointee) Mary Elizabeth Dickerson Position 2 (City Appointee) _Steve Martinez Position 3 (City Main St. Appointee) _Phyllis Wall Position 4 (City EDC Appointee) Hari Krishna Position 5 (Hale County Appointee) Judge David Mull Position 6 (Hale County Appointee) Vicki Milner Position 7 (Citizen Appointee) _Bob Copeland Bob Copeland is hereby designated to serve as Chairperson of the Board of Directors of the Zone, serving until June 30, 2024, and that each year thereafter, the City Council of the City of Plainview shall appoint one voting member of the Board of Directors of the Zone to serve as Chairperson for a one- year term that begins on July 1 sc 1 Resolution R23-608 TIRZ #1 Board Appointment Page 2 of 3 357 1 1 HL This resolution shall take effect immediately from and after its final date of passage, and it is accordingly so ordered.
