A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW,
TEXAS AUTHORIZING THE CITY MANAGER TO CONTRACT WITH SMC, INC.
FOR THE RECODIFICATION OF THE "CODE OF THE CITY OF PLAINVIEW,
TEXAS."
WHEREAS, in order to simplify the bookkeeping on City
ordinances, codification is a necessary and important tool; and
WHEREAS, it has been determined that it would be to the
advantage of the City of Plainview both economic and organizational
for the existing City Code to be recodified; and
WHEREAS, the City Manager has solicited proposals from three
firms that provide codification and reeodification services; and
WHEREAS, SMC, Inc. of Canyon Texas has provided the best
proposal.
NOW THEREFORE BE IT RESOLVED by the Mayor and the City
Council of Plainview, Texas that the City Manager is hereby
authorized to contract with SMC, Inc. of Canyon, Texas to reeodify
the "Code of the City of Plainview, Texas" for a total cost estimated
at $5,200.00.

Dear Mr. Jeffers:
Thank you for the opportunity to offer this proposal for the
updating and recodification of the Code of Ordinances of the City
of Plainview.
We have reviewed the existing Code and the permanent, general
ordinances passed by the City Council since the most recent update
of your Code. It appears that there might be several Places in the
Code which could be modified or amended which would give you a more
viable working document for the City's governance. We would offer
a complete, comprehensive recodification ofyour ordinances and
current Code for a fee of $5,200. This fee includes the delivery
of fifty copies of a .new Code of Ordinances in hard binders of an
appropriate type. If additional numbers of code books will be re-
quired, additional copies will be supplied at a nominal fee (not
to exceed $15.00 per copy)~ The format of our proposed code will
be a bit different from the MCC Codes. Several formats are avail-
able; you may choose the one which you believe would best suit the
needs of the City of Plainview. ~Whgn it becomes desirable to pro-
vide supplements (as a result of amendatory, supplementary and/or
repeal actions), our charge is $~2.00 per page.

Dear Mr. Jeffers:
This will acknowledge receipt of Ordinance Nos. 84-2546 through
86-251 to be considered for inclusion in Supplement No. 9 to the
Plainview Code. We appreciate your noting for us those
ordinances not included in the transmittal but carrying an
included number. All numbers were accounted for with the
exception of Ordinance No. 2633.
Please advise us if Ordinance No. 85-26]_7, which amends the
Charter, was approved at the referendum held November 5, 1985.
In addition, we had some duplication of numbers in the ordinances
received and would appreciate your advising us with regard to the
following:
A) Two ordinances numbered 84-2573
(1) adopted December 11, 1984; deals with rezoning property
(2) adopted December 18, 1984; penalty provisons/plumbing code
B) Two ordinances numbered 85-2586
(1) adopted February 12, 1985; speed limit
(2) adopted April 9, 1985; deals with parallel parking
C) Two ordinances numbered 85-1591
(1) adopted March 12, 1985; deals with dangerous buildings
(2) adopted June 11, 1985; deals with rezoning property
Pursuant to your letter of April 21, 1986, we are pleased to
submit the following estimates of cost for the publication of
Supplement No. 9:

The above estimate includes the Charter amendment contained in
Ordinance No. 85-2617. If the Charter amendment did not pass,
the Supplement will constitute an estimated 236 pages.
The cost for publishing a supplement is reached by multiplying
the per page rate (which includes editing, indexing, proofing and
printing) by the number of pages therein. For example, a
supplement containing 100 pages and a per page rate of $13.75
would result in a cost of $1,375.00 (100 pages x $13.75). A
supplement containing 200 pages and a per page rate of $13.75
would result in a cost of $2,750.00 (200 pages x $13.75).
Please keep in mind that the estimate figures are approximations
only. It is virtually impossible to determine the exact number of
pages any given manuscript will constitute until it is
actually set in type.
We appreciate the opportunity to be of service to the City of
Plainview in the upkeep of its Code and look forward to hearing
from you regarding the publication of Supplement No. 10.

Dear Mr. Jeffers:
Enclosed are our proposals to provide codification services to the city
of Plainview, Texas.
The first proposal is for 50 supplements to the existing code. Based
upon the material we received from the city and the instructions not to
codify zoning ordinances, we estimate it will require approximately 160
pages to supplement the Plainview Code. (As we already have copies of
your ordinances, all we need to begin producing your supplement is a
signed copy of the contract for our records.)
The second contract sets forth our charges for completely recodifying
the Plainview Code. The charges include a thorough legal analysis of
your code, reorganization, repagination, renumbering, reindexing,
footnoting and resetting 50 copies of the entire code into an 8½" x 11"
two-column composer page style. We estimate that your new code will
require approximately 520 pages in the new format. (Again, all we need
to begin the code review and recodification is a signed copy of the
contract.)
To supplement and then convert your code into our 8½" x 11" page size,
two-column composer format, our base price is $7500 for 500 pages.
Additional pages are $15 each. (We estimate it will require
approximately 520 pages to complete your code.) Tab and binder prices
remain the same as specified in our recodification contract. If you
wish, you may also contract for a complete code review by our legal
staff for a fee of $1500.

Dear Mr. Jeffers:
Here is a sample of a municipal code we prepared in our two-col-mn
composer format. The code is organized by subject matter, following our
standard organization and layout. We have found the logical arrangement
of this system to be very practical and convenient for a wide variety of
cities.
Other features you may wish to review include:
Reserved chapters within the code. This allows you the flexibility
to expand your code as the needs of your city change.
Three-step decimal-numbering system. This, too, is designed to
accommodate new provisions without disturbing the existing code.
General clauses. We can furnish your city attorney sample language
for a general penalty ordinance and a general provisions ordinance
in order to reduce the bulk of the code while increasing its
uniformity.
Ordinance history notes. We provide history notes tracing the
derivation, of your new code from the prior code and ordinances.

Statutory references. Where applicable, references are made to
state statutes which pertain to or affect specific subjects in your
code.
Disposition table. A list at the end of the code records the
disposition of every ordinance adopted by the city. We will also
publish a prior code cross-reference table for your convenience.
7. Index. Our comprehensive, multi-entry index is extensively
cross'referenced.

Format. The two-column format is neat, orderly, and easier to read
~han many typical single-column page styles.
Binders. Our post binder is sturdy enough to withstand years of
service and will expand to accommodate future changes in your code.
I hope you will have a chance to review the sample code soon. I will

for a code conversion and for a complete recodification.
