HomeMy WebLinkAboutR87-230O45 RESOLUTION NO. 87-230 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS, AUTHORIZING THE DIRECTOR OF MUNICIPAL SERVICES TO SOLICIT PROPOSALS FOR UPDATING AND REVISING OF THE CITY OF PLAINVIEW COMPREHENSIVE MASTER PLAN AND ZONING ORDINANCE. WHEREAS, a Comprehensive Master Plan' should be reviewed and updated from time to time; and WHEREAS, the Comprehensive Master Plan of the City of Plainview is ten years old; and WHEREAS, the City Council of the City of Plainview has determined that if a consultant is hired to update the Comprehensive Master Plan, the Zoning Ordinance of the City of Plainview should also be reviewed and revised at the same time: NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Plainview, Texas, that the Director of Municipal Services be authorized to solicit proposals for the Updating of the City of Plainview Comprehensive Master Plan and Zoning Ordinance by means of a "Request For Proposal" and review said proposals from Consultants for the purpose of making recommendations to the City Council. I, Sheryl Owen, City Secretary for the City of Plainview, hereby certify that the above Resolution was adopted by the Plainview City Council on March 24, 1987. ~ 0WEN~, Ci y Secretary ~RQUEST FOR PROPOSAL Purpose: Scope: The City of Plainview, Texas seeks a qualified planning consultant to develop improved Zoning regulations based upon the latest state-of-the-art regulatory techniques and mechanisms, and to prepare an updated Comprehensive Master Plan. To evaluate the effectiveness of the City of Plainview Zoning Ordinance No. 82-2478, to make recommendations to revise said Ordinance as needed, and to prepare a draft Ordinance based upon such evaluation and recommendations thereof. This Ordinance should be complete with text, zone districts or classifications, district regulations, and zoning map amendments, and supporting documents. To develop a Master Comprehensive Plan wherein a number of proposals, recommendations, and development alternatives are presented for making decisions in guiding the future growth and development of the City. This plan should contain goals and objectives which repreSent a general policy framework of priorities for future directions of growth for the City as developed by City officials and citizens through guidance of the consultant. These goals and objectives must not only be realistic and attainable, but must also present a challenge requiring vision and effort for their attainment to reflect the prevailing values in the overall physical, economic and social development of the City. The Plan, should contain all necessary text, statements, reports, studies, maps, or other material to support such a workable plan. Solicitation To be considered, ten (10) copies, plus the original should be submitted to: Mike McDonough Director of Municipal Services City of Plainview P.O. Box 1870 Plainview, Texas 79072 Responses must be received by no later than 5:00 'P.M. May 15, 1987. Clarification of any matters in this request shall be made only in writing by the City of .Plainview Municipal Services Division with copies to all interested parties. II. Type of Contract · The agreement resulting from this request for proposal will be a negotiated fee contract, with payments made in accordance with the terms agreed upon during contract negotiations. III. Format Ail written material submitted in response to this request should be double spaced. Elaborate brochures and presentation aids beyond those necessary to communicate the substance of the proposal are discouraged. IV. Limitation This request for proposal does not commit the City Council of the City of Plainview to award a contract or to pay any cost incurred as a result of preparing such a proposal. The City Council reserves the right to accept or reject any or all proposals received in response to this request, to negotiate with all qualified respondents, or to cancel in part or in its entirety this request for proposal if it is in the best interest of the City of Plainview. The City Council may require consultant participation in negotiations the result of which may require revisions (technical or otherwise) to the proposal as submitted. The selection will, in part, be based upon the most favorable terms to the City in terms of technical expertise and staffing capabilities, with limited reliance upon City staff resources. -4- Contract The City Council of the City of Plainview may select a consultant based solely upon the proposals received without a formal presentation bY or discussion with said consultant. Each proposal should therelore be as clear and self-explanatory as possible. Additional information, as determined by the City Council may be required in support of any written proposal. Any sub-contractual agreement for a part or all of the work to be performed, must have approval by the City Council. VI. Period of Performance The period of performance of this contract is anticipated to run from July 7, 1987, to July 7, 1988. (1 year period) Final contract schedule will be determined in contract negotiations. VII. Schedule and Statement of Work The selected consultant must submit a detailed monthly schedule of performance for the time period specified in paragraph VI above. Additionally, the estimated man-hours required and the availability of all technical staff members and subcontractors for the project, by percent of time shall be included. The Statement of Work should itemize all of the work to be performed. Finally, any specific concerns with the scope of work called for in this request should be identified with potential solutions provided to resolve such. VIII. Consultant's Authorized Signature The proposal shall be signed by an official authorized to bind the consultant in a contractual agreement. The consultant shall provide the following information: name, address, and telephone number Of the individual(s) with authority to negotiate and contractually bind the selected consultant. It is also necessary that the name of a contact individual be provided, should questions arise during the proposal evaluation process. IX. Evaluation Criteria Prospective consultants are advised that the selections of a consultant will only be made after review of all of the proposals received with particular attention to: -5- 1. The consultant's understanding of the technical aspects of the RFP, the responsiveness to the requirements of the RFP, the perceived effectiveness, quality and level of detail demonstrated in the RFP, and reasonableness of recommendations set forth in the RFP. 2. The consultant's ability to balance creativity with practical solutions in addressing the tasks outlined in this request. X. Consultant Qualifications Ail consultants submitting proposals shall provide the following information: 1. Staff organization; 2. Resumes, biographies, or other relevant information for for each key staff member to be assigned to this project; 3. Office locations(s); 4. General background and history of the firm's experience in planning and the development of land use regulations for local government (within the last five (5) years); 5. Specific background and history of the firm's experience during the last five (5) years in developing and/or revising Comprehensive Master Plans and Zoning Ordinances for Texas cities with similar land area and population characteristics (Land Area: 12.6 square miles; Population (1980): 22,187; 6. Reference analogous projects, particularly any which have undergone litigation. Briefly explain Court's decision or ruling; 7. Support services available through consultant (i.e. computer capabilities, legal, etc. as applicable); 8. If subcontractors are to be retained, provide information as above in 1-7 on said subcontractee(s). XI. Project Coordination The selected consultant shall work most closely with the City of Plainview Municipal Services Division and its Planning, Zoning and Code Enforcement Departments and the City Attorney's Office. --6-- XII. Project Budget Consultants are encouraged to submit proposals that adequately satisfy all tasks identified in Section XIV. An estimate of the cost range of such contracted services to complete the project is requested. A breakdown by major task is requested should the availability of funding require limiting the scope of the project. The prime interest is the development of a more comprehensive, flexible, Zoning Ordinance, which is legally sound and which will fulfill the goals and objectives of the Updated Comprehensive Master Plan. XIII. Project Monitoring This project will be monitored and evaluated by the City of Plainview Municipal Services Division. Regular reports will be required. The selected consultant will be required to submit one (1) or more of the following: 1. Performance status report at 60 day intervals; 2. Financial status report at 60 day intervals; Final performance and financial status reports upon completion of the project; and 4. Request for payment statements. XIV. Project Requirements or Scope A. Identified Problems To assist in focusing the consultant's attention, the following has been prepared to highlight some of the concerns with and perceived limitations of the current Zoning Ordinance and Master Plan Comprehensive Plan. All elements of the text, district regulations, zoning map and plan are affected. Specifically, the following represents City Council and staff concerns: 1. Current format of ordinance - group all regulations for a given district together. 2. Phase out of non-conforming uses. -7- 3. Conditional zoning - how and where it can be used in both specific use permits and rezoning. 4. Zoning Districts too Broad - incompatible uses grouped together. 5. Introduction of innovative techniques, such as: (a) (b). (c) Performance Zoning. Transfer of Development Rights (TDR), or Other new techniques of zoning which might allow for some flexibility while retaining some forms of desirable controls. 6. Elimination of certain districts: Be (a) Excessive strip commercial zones. (b) Spot zoning of small commercial tracts. (c) Restrictive Commercial Zones-too restrictive for most uses thus making them undesirable to applicants. Establishment of new districts: (a) Areas where alcoholic beverages might be legally sold. (b) Office, Professional and Institutional Zone to act as a buffer between commercial and residential uses. (c) Zones where uses are compatible with each other. (d) Possible variations of residential zones (multi-family). (e) Airport zoning. (f) Transitional zone for newly annexed lands. Specific potential uses problems: (a) Intermingling of mobile with single-family homes. (b) Allowing new residential in commercial. (c) Permitted uses need to be more restrictive. (d) Congregate living facilities. (e) Accessory apartments or additional housekeeping units. (f) Flea Markets and sidewalk vendors. (g) Multi-family dwellings not permitted use but have been allowed in commercial zones. (h) Home Occupations. (i) Junk yards and junk dealers. (j) Excavation, fill or alteration of the natural grade. (k) Private clubs (establishments Selling alcohol). (1) Multi-family uses adjacent to residential uses. (m) Group homes - halfway houses. Zoning Map: (a) (b) Inconsistency with goals of Comprehensive Plan. Arbitrary application of commercial and industrial zoning, without regard for land use and ownership characteristics. Zoning Ordinance and Plan not always consistent. Ordinance is only partially clmmulative. Comprehensive Plan has not been updated in several years and thus does not reflect current or recent development or growth patterns of the City. Comprehensive goals and objectives need to be updated. 15. (a) (b) The Comprehensive Master Plan should by means of good planning practices identify the priorities that need to be pursued in regard to the establishment of goals and objectives formulated by the Plan in areas including but not limited to the following: Citizen involvement Housing 1. Public 2. Private (rental) 3. Multi-family'(small and large) 4. Demolition & rehabilitation -9- (c) Transportation 1. Public transportation 2. Highway study 3. Airport facilities (d) Public/Municipal facilities.and services 1. City/County health facilities 2. Coliseum/meeting facilities 3. Fire substation 4. Industrial park 5. City/County Joint Services (e) Economic study (f) Neighborhood study (g) Growth Plan 1. Future annexation with E.T.J. 2. Development within existing corporate limits. (h) Land uses - alternatives 1. Residential 2. Commercial 3. Industrial B. Project Requirements The following tasks at a minimum will be required of the ~elected consultant. Please describe in detail the program for your Lrm proposes to develop to complete these tasks, as well as any ~dditional tasks, you feel are essential to the success of this project. 1. Zoning Ordinance - Introduction and Scope of Project The consultant shall provide a general introduction or description of the purpose of a zoning ordinance and its relationship to a Comprehensive Plan. More specifically, the applicability for zoning-should be addressed. An outline of the scope of the project should clearly indicate what the ultimate product will be. 2. Coordination with City Zoning ~,d Inspections and Planning Departments. Working in close cooperation with City Staff, the consultant shall evaluate the existing Ordinance in relation to the identified problems (Section XIV-A). The examination and updating of the City's Comprehensive Plan is being undertaken to ensure linkage. Specify how this task is to be accomplished. 3. Legal Considerations Working in close cooperation with the City Attorney, indicate any legal implications of the project Specify how your recommendations are legally founded. Cite Texas Case Law in 'support of such. -10- 4. Evaluat£on and Reco~nendation Upon conclusion of research into the current zoning practices of the City of Plainview, the consultant shall prepare a detailed evaluation of the current Ordinance, especially highlighting its strengths and weaknesses. Describe your approach and the elements (i.e., text, district regulations, zone districts, and map) to be assessed. 5. Draft Ordinance In order to implement the recommendations, a draft Plan and Ordinance must be prepared for consideration by the City Council Especially in this final stage of.the project, the contracted consultant shall make any presentations to the City of Plainview City Council as may be deemed necessary. .6. Draft Document The Consultant shall prepare and provide fifty (50) copies of the draft document addressing tasks 1-5 for review and consideration by the City of PlainView City Council. 7. Final Document The Consultant shall prepare and provide final documents which incorporates all changes required as a result of the review of the draft documents, including the draft Ordinance, Plan, and all support documentation- (Also note required appendix.) One (1) reproducible original plus fifty (50) copies shall be supplied by the contractor. Should the new draft Ordinance and Plan be approved three (3) zoning maps shall be prepared to conform to the said ordinance. 8. P,,hlic Hearing Participation The Consultant shall be available for all public hearings before both the Planning and Zoning Commission and the Plainview City Council. APPENDIX State of the Art Annotated'Bibliography An annotated bibliography indicating all research references employed in support of this contract should be included in the final document. This summary should emphasize current problems opportunities and solutions pertaining to zoning as practiced today in Texas. -11-
