HomeMy WebLinkAboutR87-256071 RESOLUTION NO. R87-256 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS ADOPTING THE BY-LAWS OF THE COMMISSION ON HUMAN RELATIONS. WHEREAS, Ordinance No. 86-2657, adopted October 28, 1986 created a Commission on Human Relations; and · WHEREAS, Section 5 of Ordinance No. 86-2657 states "the o o~ ~r~.~es_A~d regulations, subject to the 3 ~unuxx, per=aining to t~e performance of its duties and the time and frequency of its meetings;,, and WHEREAS, the Commission has submitted the proposed By-Laws for consideration by the City Council; and WHEREAS, a copy of said proposed By-Laws with additions and deletions are attached and hereby made a permanent part of this Resolution. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Plainview, Texas that the attached By-Laws for the Commission on Human Relations are hereby adopted. ARTICLE I NAME The name of the organization is the City Relations Commission. of Plainview Human ARTICLE II PURPOSES OF COMMISSION The Human Relations Commission shall serve as. the duly constituted instrumentality of the City Council of Plainview for the purpose of providing a means by which all citizens of Plainview may be assured equal enjoyment of all rights, privileges, and remedies in the protection of their person, property, livelihood and freedoms, and equal opportunity to pursue their respective aspirations, to enjoy the benefits of their individual labors, and to equally share in the commo~benefits of society without regard to race, creed, color, sex ornational origin. Included in such PUrposes are the following objectives: 1. To promote equality of opportunity for all citizens. 2.citizens. To promote understanding, respect and good-will among all 3. To facilitate orderly social change by serving as reacting agent of change within the community. To prevent violence and reduce tensions. To serve as a resource of objective information. ARTICLE III POWERS AND DUTIES The Commission shall have such powers and duties as established by the Code of Ordinances of the City of Plainview and as may be delegated by the City Council and the City Manager. These powers and duties ; include: Section 1. City Manager on discrimination. To advise and consult with the City Council and the matters involving racial, religious or ethnic Section Z. To recommend to the City Council and the City Manager measures designed to eliminate prejudice and discrimination. Section 3. cooperation of relations· To promote and encourage communications between and all groups interested in bettering community ARTICLE IV COMPOSITION OF COMMISSION Section 1. Appointment. In accordance with City Ordinance No. 86-2657, the Commission shall be composed of seven (7) members appointed by the City Council. The Commission may recommend to the 2 of 12 City Council person to be appointed to the Commission. Any citizen of the City of Plainview may seek appointment to the Human Relations Commission. Section 2. shall be appointed to serve a term of three (3) successor is appointed and qualified. However, Commission, two (2) members shall be appointed for a term of one year; two (2) members shall be appointed for a term of two (2) years and three (3) members shall be appointed for a term of three (3) years. Each year thereafter, the City Council shall appoint to fill expiring terms, each of such appointments to be for a term of three (3) years. Any Commission member may be reappointed to serve a second three-year term not to exceed a total of six (6) consecutive years. In the event any member of the Commission resigns or terminates his service for any cause, the City Council shall appoint a qualified successor to fill such unexpired term. Any member appointed to the Commission to fill an unexpired term in excess of eighteen (18) months of a three (3) year term shall be considered to have served a full three-year term. Section 3. Qualification. Members of the Plainview Human Relations Commission shall be sworn to uphold the Constitution and the laws of the United States of American and the State of Texas and the Charter of the City of Plainview. As nearly as is reasonably possible, the membership shall be fairly representative of all of the several economic, religious, cultural, ethnic and racial groups which comprise the population of the City of Plainview. ARTICLE V TERM OF COI~MISSION The term of the Commission shall be continuing and anniversary date shall be the first day of January of each year. ARTICLE VI the OFFICERS OF COMMISSION Section 1. Officers of Commission. The officers of the Commission shall be a Chairperson, Vice-Chairperson, and Secretary. These officers are to be elected from the membership of the Commission. Section Z. Duties and Responsibilities. A. Chairperson. The Chairperson shall preside at all meetings of the Commission and Executive Committee; shall be responsible for the general administration of the Commission,s affairs, and the presentation of implementation of its recommendations, resolutions and policies before the public; and shall have, hold and exercise 4 of 12 such powers and perform such duties as provided for herein or by the Commission or by the City Council. B. Vice-Chairperson. The Vice-Chairperson, in the absence or upon the resignation or disability of the Chairperson, shall perform the duties and exercise the powers of the Chairperson and shall perform such other duties as the Commission or Chairperson may from time to time prescribe. meetings of approve the Secretary. The Secretary shall give or cause to be given written notice to all regular or special meetings of the Commission and shall perform such other duties as may be prescribed by the Commission or Chairperson. Subject to the provisions of Article VII, Section C-2, immediately above, the agenda shall provide a time when the Chairperson or any Commission member may bring before the Commission any business that he/she feels should be considered by the Commission; however, until the item is officially listed on the agenda, no action shall be taken. Such matters need not be stated in detail, but shall inform the Commission members of the substance of all action to be considered. Any person desiring to present a subject for the Commission,s consideration shall advise the Chairperson of that fact not later than 12:00 noon on the Wednesday preceding the meeting at which time he/she desires the subject to be considered. Any person who wishes to address the Commission without having so placed the matter on the agenda may do so only upon the consent of a majority of Commission members present and voting. 9 of 12 B. In the event more than one nominee is proposed for election to any Commission office, voting shall be by secret ballot and the ballots shall be counted by the City Manager, or his representative, who shall inform the Chairperson only of the nominee elected· ARTICLE VII INTERPRETATION Any ambiguity in, conflict between, or interpretation of any of the provisions of these By-Laws shall be reconciled and construed in a manner which will most nearly give effect to the general and purposes expressed herein. All such questions 11 of 12 intents shall be referred to the entire membership of the Commission, and the Commission shall, by resolution duly adopted on the affirmative vote of the majority of the Commission members, set forth such interpretation or construction hereof as shall fully dispose of such question as may be raised.
