HomeMy WebLinkAbout07-3482 ord489 ORDINANCE NO. 07-3482 AN ORDINANCE OF THE CITY OF PLAINVIEW PROVIDING FOR ACCEPTANCE OF A SPECIAL WARRANTY DEED FROM HAZEL ESPANEETA MCWILLIAMS FOR A PORTION OF LAND LOCATED ALONG THE HIKE AND BIKE TRAIL; CUMULATIVENESS CLAUSE; SEVERABILITY CLAUSE; CONFLICTS CLAUSE; AND EFFECTIVE DATE. WHEREAS, Hazel Espaneeta McWilliams is the owner of a tract of land described as being a 102' x 216.8' tract of land out of the Southeast '/ of Survey 40, Block JK-2 in the Town of Plainview, Hale County, Texas and located at 409 W. 2nd Street; and WHEREAS, Mrs. McWilliams has given notice of her intent to convey the said tract of land to the City of Plainview; and WHEREAS, the said tract of land provides a public purpose of providing property located adjacent to the Hike and Bike Trail that will allow public access and maintenance to such property; and WHEREAS, the City Council finds that the approval and acceptance of such tract of land will be in the best interest of the City of Plainview's citizens; and WHEREAS, the City Council further determines that it would not be detrimental or injurious to public health, safety or general welfare of the citizens of the City of Plainview, Hale County, Texas. NOW, THEREFORE, the City of Plainview hereby ordains that: SECTION I The Mayor is hereby authorized to accept from Hazel Espaneeta McWilliams a Special Warranty Deed on the property described as being a 102' x 216.8' tract of land out of the Southeast '/ of Surve~r 40, Block JK-2 in the Town of Plainview, Hale County, Texas and located at 409 W. 2n Street. SECTION II Provisions of this ordinance are cumulative and nothing herein shall prevent, alter or diminish the applicability or enforcement of other ordinances restricting, regulating or governing the subject matter herein. Ordinance No. 07-3482 McWilliams Land Gift Page 1 of 2 490 SECTION III If any section, subsection, sentence, clause, phrase, or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdictions, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions hereof. SECTION IV All ordinances or portions of any ordinance of the City of Plainview, Texas, in conflict herewith, are hereby amended to conform with the provisions hereof. SECTION V This ordinance shall be in full force and effect upon its passage as required by law. PASSED AND APPROVED on first reading this 22"d day of May, 2007.
