A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PLAINVIEW, TEXAS RATIFYING AGREEMENTS WITH MRS. NOLEN
OLDFIELD AND MR. & MRS. RALPH NAFZGER PERTAINING TO
THE SO%PrHWEST~IPd) PROJECT.
WHEREAS, the City Council duly enacted on the 14th day of
April, 1987, an ordinance determining the necessity for and
ordering the improvement of a portion of Southwest Third Street;
and
WHEREAS, the City Council has made an agreement with the
Texas Department of Highways and Public Transportation, pursuant
to Ordinance' No. 87-2694, whereby the Department has prepared
the plans and specifications for the construction of said
improvements; and
WHEREAS, the City Council held a public hearing on the 23rd
day of June at 7:30 p.m. in the Council Chambers at 901 Broadway
at which time and place all interested persons were given the
opportunity to appear and be heard in regard to the improvements
project; and
WHEREAS, Mr. & Mrs. Ralph Nafzger and Mrs. Nolen Oldfield
did so appear and make the Council aware of problems and
concerns with their respective properties in relation to the
improvement project, specifically:
· the city's need for an easement at the Southwest
corner of the Nafzger property, as such is set out
within the the Engineer's Roll, and
· substantial damages to Mrs. Oldfield's fence,
shrubbery, and other real and personal property.
WHEREAS, the Council has entered into negotiations with Mr.
& Mrs. Nafzger and Mrs. Oldfield and have agreed to the terms
hereinafter stated as complete and full compensation for any and
all damages with respect to their properties and the Southwest
Third Improvement Project.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and the City
Council of the City of Plainview that an easement be conveyed to
the City of Plainview, as such easement is determined to be
necessary by the City Engineer and approved by the Nafzger's or
their authorized representative, for the purchase price of
$2,500.00 and that Mrs. Nolen Oldfield be paid $7,200.00 as
compensation for damages to her property.
