RESOLUTION NO. R87-293
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PLAINVIEW, TEXAS APPROVING AN AGREEMENT PERMITTING
CONSTRUCTION OF CERTAIN IMPROVEMENTS UPON A PORTION
OF A CITY STREET LOCATED AT 512, 514 AND 516 ASH
STREET; AND AUTHORIZING THE MAYOR TO EXECUTE SAID
AGREEMENT ON BEHALF OF THE CITY OF PLAINVIEW.
WHEREAS, Hale County Abstract Company owns property located at
512, 514 and 516 Ash Street Plainview, Texas more properly
described as: ' ·
Lots 7, 8 and 9, Block 18, Original Town; and
WHEREAS, Hale County Abstract Company is about to begin a
renovation and addition project on said property; and
WHEREAS, the renovation and addition project will encroach upon
City right-of-way to the extent that five-inches (5") of the West
front of the building on the above described property will encroach
City right-of-way for a distance of seventy-five feet (75'); and
WHEREAS, Chapter 21 of the Code of the City of Plainview, Texas
provides that it shall be unlawful to place, maintain or erect any
structure over, on or across any public property without the
express permission of the City Council as expressed by Resolution
passed by the City Council in Regular Session; and
WHEREAS, on October 1, 1987, Mr. James Robison, acting on of
behalf and as an authorized agent of Hale County Abstract Company,
requested a street use permit for the above described property
Code;pursuant and to the provisions of Chapter 21 of the Plainview City
WHEREAS, the City Council of the City of Plainview, Texas finds
it to be in the best interest of the City of Plainview and its
citizens to grant such permit as requested subject to the
conditions hereafter stated. '
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of
the City of Plainview, Texas :
(1) that permission be granted to Hale County Abstract Company
to construct the renovations and improvements as has been heretofore
described upon the City right-of-way pursuant to the provisions of
the Plainview City Code and the execution of a street use permit
agreement.
(2) that Hale County Abstract Company shall indemnify and hold
harmless the City from any and all liability occasioned by the
encroachment upon and across said public right-of-way.

(3) that Hale County Abstract Company shall, at it own
expense, maintain said improvements in a good state of repair and
shall not, in the installation or maintenance of said structure,
saidcreate public or permit right-of-way, an unsafe of hazardous condition upon or across
(4) that the Mayor is hereby authorized to enter into the
street use permit agreement on behalf of the City Council and the
City of Plainview.
