A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF
PLAINVIEW, TEXAS, APPROVING A PLAN TO CONSTRUCT
A VEGETABLE WASH WATER HOLDING POND AND GRANTING'
PLAINS GOLD FARMS, INC., D/B/A WALKER BROTHERS PRODUCE,
(WALKER BROS.), PERMISSION TO CONSTRUCT SAID FACILITY
AND TO DISCHARGE SETTLED WASH WATER INTO MUNICIPAL
DRAINAGE CHANNEL.
WHEREAS, Plains Gold Farms, Inc., d/b/a Walker Brothers
Produce, (Walker Bros.) has prepared plans for and proposes to
construct a vegetable wash water holding pond on its property
located near the intersection of East Seventh and Ivy Streets, in
Plainview, Texas, and to discharge settled wash water therefrom into
an adjacent municipal drainage channel; and
WHEREAS, Walker Bros. is making application to the Texas Water
Commission for a permit to discharge said wash water into the
municipal drainage channel and Running Water Draw; and
WHEREAS, Walker Bros. has discharged similar wash water into
the drainage ways in the City of Plainview during the past
twenty-seven or more years; and
WHEREAS, it is imperative that Walker Bros. be able to
continue the discharge of said wash water in order to continue to
conduct its business at said location.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of
the City of Plainview, Texas that Plains Gold Farms, Inc., d/b/a
Walker Brothers Produce, (Walker Bros.), be and is hereby granted
permission to construct the proposed vegetable wash water holding
pond and to discharge settled wash water therefrom into the adjacent
municipal drainage channel provided that:
1) Walker Bros. obtains the necessary permit, or permits, from
the Texas Water Commission to discharge said wash water into the
drainage channel and Running Water Draw; and
2) Walker Bros. agrees to abide by and comply with any permit
granted by the Texas Water Commission, or its successor, and to
abide by and comply with any and all applicable federal, state, and
local laws. and regulations; and
3) Walker Bros. maintains said wash water facility and
operation in such a manner as to not create a nuisance or hazard to
the public; and
4) Walker Bros. agrees to hold the City of Plainview harmless
for any damages arising from or due to its maintaining and operating
said wash water facilities and agrees to maintain insurance
providing liability protection for said activity; and

5) Walker Bros. agrees to remove any silt or other debris
which may accumulate in the municipal drainage channel as a result
of the drainage of said wash water.
6) Walker Bros., and its successors or assigns, agree to abide
by and comply with the provisions of this Resolution. Walker Bros.
agrees to provide appropriate notice to any prospective successor or
assignee regarding the provisions of this Resolution.

hereby certify that the above Resolution was adopted by the
Plainview City Council on December 8, 1987.
