HomeMy WebLinkAbout00 0523 min MINUTES CITY COUNCIL MEETING City of Plainview May 23, 2000 The Plainview City Council held a meeting at 7:00 p.m., Tuesday, May 23, 2000 in the Council Chambers of the Plainview City Hall at 901 Broadway~ The Council met in Pre-Session at 6:30 p.m. Mayor Lloyd C~ Woods presided. Councilmembers present were Sam Parker-District 1; Mary Jane Shanes-District 2; Mike Hutcherson-District 4; Bobby McGehee-District 6; and Irene Favila-District 7. Councilmember Rey Rosas-Precinct 3 and Councilmember Ross Owen-Precinct 5 were absent. Staff members present: Jim Jeffers-City Manager; John Castro-Director of Community Services; Wally Hatch-City Attorney; John Berry-Director of Public Works; Norman Huggins-Director of Finances; Dale Simpson-Civil Service Director; Will Mull-Police Chief} Gary Glass-Fire Chief, Greg Zielinski-Code Enforcement; and Karen McBeth-City Secretary. CounCilmember Irene Favila moved to adopt the Consent Calendar as presented. Councilmember Mike Hutcherson seconded the motion. The motion carded unanimously. a) b) c) d) Minutes of May 4 and May 9, 2000 were approved. Departmental Reports were accepted. Expenditures were approved. Excused Absences were granted to Councilmember Rey Rosas and Councilmember Ross Owen for this meeting. e) Appoint Economic Development Oversight Committee. John Bertsch was appointed to the committee. f) Minutes 00 0523 Ordinance No. 00,3253. An Ordinance of the City of Plainview, Texas amending Ordinance No. 99-3230 to appropriate additional funds in the General Fund in the Page 1 of 4 100 g) 1999-2000 Budget for the Ports-to-Plains project, (Second reading) Ordinance was approved. Award of bids: Water Transmission Line; Bids were received from Amarillo Utility Contractors in the amount of $755,055.00, Armstrong Construction in the amount of $740,880.00, L.A Fuller & Sons in the amount of $698,882100, Morton Irrigation, Inc: in the amount of $639,916.00, and Utility Contractors of America in the amount of $614,727.50. The bid was awarded to Utility Contractors of America for $614,72T 50. Property Tax sale: 405 West l0th sold to Kevin Whisenant for $3,755.0; 2103 Columbia sold to Aaron Borden for $550.00; 111 Givens sold to Roy J. Thompson for $800.00; 911 Columbia sold to Arthur D Watson for :$3,755.00; and 1001 N Columbia sold to Joe Nevares for $5,250.00. REGULAR AGENDA ITEMS Zone Case 689. Ordinance No. 00-3250. An Ordinance amending the zoning map of the City of Plainview, Texas for closing a portion of Utica Street, between 6th and 7th Streets, lying East of lots 107, inclusive, Block 57, and 7th Street beginning at the intersection of Utica and 7ta Streets thence West to the alley between blocks 57 and 58. All lots are located in the College Hill Addition, Hale County, Plainview, Texas; Cumulative clause; Conflicts clause; Severability clause; And effective date. ( Second reading) There were no comments or discussion regarding this ordinance. Mayor Woods moved that Ordinance No. 00-3250 be approved. Councilmember Irene Favila seconded the motion. Councilmembers Parker, Shanes, Hutcherson, McGehee, Favila and Mayor Woods voted "yes" on the motion. None voted against. Ordinance No. 00-3252. An Ordinance of the City of Plainview, Texas amending Chapter 19, Signs, of the Plainview Code of Ordinances; Severability claUse; Cumulativeness clause; Conflicts clause; And effective date. (Second reading) Greg Zielinski, Code Enforcement, reviewed the proposed changes regulating signs. Provisions regulating signs have not been updated since 1988. The changes are limited to controlling the height of pole signs, the clearance under pole signs (must be 8') and regulating portable display signs. The portable display signs will be permitted for only 60 days. They must be correctly electrified. Mayor Woods asked for public comment. Larry McNutt, owner of Broadway Auction House, said a portable sign is very valuable to his business, when he is having a sale at a house, or an estate, sometimes for one or two days. He asked if he would have to pay for a permit each time he uses one at a different location. Mr. Castro said yes. Mr. McNutt said this would be quite costly. Minutes 00 0523 Page 2 of 4 101 Stan Payne, 1812 W. 5th St., via a letter, told the Council he has the same concern. His "portable" sign has been there for 20 years. Mr. Zielinski said businesses have until September 1, 2000, then they will have to be permitted, each time for only 60 days. James Odom, 3509 Kirchwood, said these signs are basically for people with small, family businesses and it is not fair. The Mayor asked for Council comments. Councilmember McGehee asked if there was any significance between very portable, and the "portable" signs that seem to stay forever? He asked if they were permitted to a location, or to a person? Mr. Zielinski said they are permitted to a location, and must be re-permitted each time they are moved, or every 60 days if left in the same location. Councilmember Shanes asked if she were to get a "portable" sign, permit it, and re-permit it every 60 days, that it can go on forever? Mr. Zielinski said yes. Mrs. Shanes stated this does not solve the ugly sign problem down 5th Street. Mr. Castro said his department is looking into the truly portable signs, such as those used by auctioneers. Councilmember Hutcherson said he felt this should be restudied and maybe do a different type of permitting for auctioneers and the like. Councilmember Sam Parker asked if a temporary sign could be made permanent? Mr. Zielinski said yes, put it on a pole, put it 8 feet off the ground and pay a $20 permit fee. Councilmember Hutcherson asked if the pole type signs were permitted? Mr. Zielinski said yes. He said the only signs that were not permitted were painted on, or bolted to the building. Mayor Woods said the City has received many complaints about the portable signs on 5th Street, noting they are poorly kept and they are located too close to the roadway. Mayor Woods said the Council needs to consider how the City looks. Councilmember McGehee asked City Attorney Wally Hatch if the ordinance could be passed, excluding the "portable sign" portion? Mr. Hatch said yes, that part could be deleted and the remainder of the ordinance adopted. Councilmember McGehee made a motion that Ordinance No. 00-3252 be approved, excluding the portion covering portable signs for further study. Councilmember Hutcherson seconded the motion. Mayor Woods and Councilmembers Parker, Shanes, Hutcherson McGehee and Favila voted "yes" on the motion, none voted against. Zone Case No. 688 (3418 Olton Road). Ordinance No. 00-3254. An Ordinance amending the zoning map of the City of Plainview by issuance ora Specific Use Permit to operate an Arcade in a General Business (C-3) zoning district, address being 3418 Olton Road; Cumulativeness clause; Conflicts clause; Severability clause; And effective date. (Second reading) Wally Hatch, City Attorney, said the Council can apply some restrictions to arcades, but only where zoning is concerned. There was no discussion. Mayor Woods moved that Ordinance No. 00-3254 be approved. Councilmember Shanes seconded the motion. Councilmembers Parker, Shanes, Hutcherson, McGehee, Favila and Mayor Woods voted "yes" with none voting against. 7. Closed Session. (1 .) To discuss or deliberate regarding commercial or financial information that 102 the City of Plainview has received from a business prospect that the City of Plainview seeks to have locate, stay, or expand in or near territory of the City of Plainview in which the City of Plainview is conducting economic development negotiations; And/or (2.) to deliberate the offer of financial or other incentive to a business prospect described by Subdivision (1) [Star Career Training and Hi-Plains Millwright and Supply, Inc.] [Texas Gov't. Code Ann. Section 551.086] Councilmember Parker moved to move into Closed Session. Councilmember Hutcherson seconded the motion, which passed unanimously. The Council moved into Closed Session at 7:38 p.m. The Council reconvened in Open Session at 8:23 p.m. 8. Declaration of a portion of Block 15, Lots 1 through 9, of the McClelland Addition as Surplus Property. Mayor Woods moved this property be declared surplus property. Councilmember Hutcherson seconded the motion. Councilmembers Parker, Shanes, Hutcherson, McGehee, Favila and Mayor Woods voted "yes" on the motion. None voted against. 9. Consider economic development inducements for Hi-Plains Millwright and Supply, Inc. Councilmember Favila moved the City Manager be authorized to offer inducements within the parameters discussed in Closed Session. Councilmember Shanes seconded the motion. Councilmembers Parker, Shanes, Hutcherson, McGehee, Favila and Mayor Woods voted "yes" on the motion. None voted against. 10. Consider economic development inducements for Star Career Training. Councilmember Shanes moved the City Manager be authorized to offer inducements within the parameters discussed in Closed Session. Councilmember Favila seconded the motion. Councilmembers Parker, Shanes, Hutcherson, McGehee, Favila and Mayor Woods voted "yes" on the motion~ None voted against. 11. Adjournment. Mayor Woods moved to adjourn the meeting. Councilmember Irene Favila seconded the motion. The motion carried unanimously. Mayor Woods adjourned the meeting at 8:21 p.m. Passed and approved on June 13, Karen McBeth, City Secretary 2000.
