A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PLAINVIEW, TEXAS APPOINTING THE MEMBERS OF THE
BOARD OF DIRECTORS OF TAX INCREMENT REINVESTMENT
ZONE NUMBER ONE (TIRZ #1), HISTORIC DOWNTOWN
PLAINVIEW, TEXAS; APPOINTING ONE MEMBER OF THE
BOARD TO SERVE AS CHAIRPERSON FOR THE CURRENT
YEAR; AND PROVIDING FOR OTHER MATTERS RELATING TO
SUCH BOARD.
WHEREAS, on May 8, 2018, the City Council of the City of Plainview, Texas
adopted Ordinance No. 18-3677, which created Tax Increment Reinvestment
Zone #1, Historic Downtown Plainview, Texas (the "Zone") and established a
Board of Directors for the Zone as authorized and in accordance with the Tax
Increment Financing Act (the "Act"), Chapter 311 of the Texas Tax Code, Vernon's
Texas Code Annotated; and
WHEREAS, Section 3 of Ordinance No. 18-3677 creating the Zone states:
Section 3. Board of Directors
A board of directors ("Board") for the Zone is hereby created. The Board shall
consist of seven (7) members who shall serve for terms of two (2) years each. The
Board shall be appointed as follows:
3.1 Of the seven (7) Board members, Council shall appoint five (5) members,
with three (3) of the five (5) Council appointees being specifically comprised
of one (1) member from the Plainview Chamber of Commerce, one (1)
member from the Plainview -Hale County Economic Development
Corporation and one (1) member as a citizen representative (must live
inside City limits). Hale County may, but is not required to, appoint two (2)
members. Council shall appoint members as is necessary to fill the
remaining positions, if Hale County does not appoint their allotment. All
members appointed to the Board shall meet the eligibility requirements as
set forth in Section 311.009 of the Texas Tax Code. Such members may be
members of the City Council.
3.2 Council shall annually designate a member of the Board to serve as
chairperson of the Board, and the Board shall elect from its members a vice
chairperson or other officers as it considers appropriate.

WHEREAS, Section 311.009(e) of the Texas Tax Code states that "To be eligible
for appointment to the board by the governing bod of the municipality, an individual
must be at least 18 years of age and:
(A) be a resident of the county in which the zone is located or a county
adjacent to that county; or
(B) own real property in the zone, whether or not the individual resides in the
county in which the zone is located or a county adjacent to that county.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Plainview
that:
The City Council of the City of Plainview hereby appoints the following
individuals and accepts Hale County's appointments, all meeting the requirements
of Section 311.009(e) of the Texas Tax Code, to the Board of Directors of the Zone
until June 30, 2025, commencing on the effective date of this resolution:

Position 5 (Hale County Appointee) Judge David Mull

Position 7 (Chamber Appointee) Hari Krishna
Phyllis Wall is hereby designated to serve as Chairperson of the Board
of Directors of the Zone, serving until June 30, 2025, and that each year thereafter,
the City Council of the City of Plainview shall appoint one voting member of the
Board of Directors of the Zone to serve as Chairperson for a one-year term that
begins on July 1st

This resolution shall take effect immediately from and after its final date of
passage, and it is accordingly so ordered.
