ORDINANCE NO. 01-3308
An Ordinance of the City of Plainview, Texas creating a Retired
Senior Volunteer Program Community Advisory Group; establishing
terms of members; defining powers and duties; defining the
organizational structure; establishing a policy on expenditures;
cumulativeness clause; conflicts clause; severability clause; and
effective date.
WHEREAS, the City of Plainview is the new sponsor for the Retired
Senior Volunteer Program;
WHEREAS, the City of Plainview is required to create a community
advisory group to advise the City on the RSVP program;
WHEREAS, RSVP provides worthwhile services to the citizens of
Plainview and the region;
NOW THEREFORE, the City of Plainview hereby ordains:
Section I. Created; Compensation
There is hereby created a RSVP Community Advisory Group to be composed of
fifteen (15) members appointed by the City Council. As nearly as is reasonably
possible, the membership shall be fairly representative of all the several
economic, religious, cultural, ethnic and racial groups comprising-the population
of the City. The Community Advisory Group shall serve without compensation.
Section II. Terms of Members; Fillin,q Vacancies
Each member of the Community Advisory Group shall be appointed to serve a
term of three years or until a successor is appointed and qualified; provided
however, that on the initial Advisory Group five (5) members shall be appointed
for a term of one (1) year; five (5) members shall be appointed for a term of two
(2) years; and five (5) members shall be appointed for a term of three (3) years.
Each year thereafter, the City Council shall appoint five (5) to fill expiring terms,
each of said appointments to be for a term of three (3) years. In the event any
member of the Advisory Group resigns or terminates her/his service for any
cause, the City Council shall appoint a qualified successor to fill such unexpired
term. The City Council reserves the right to remove members from the Advisory
Group.

Section III. Powers and Duty
The RSVP Community Advisory Group shall have the following duties:
(a)
to advise and consult with the City Manager on matters
involving volunteer opportunities for senior citizens;
(b)
to promote and encourage volunteerism in the community
and region.
Section IV. Or.qanization
Members of the RSVP Community Advisory Group shall be sworn to uphold the
Constitution and the Laws of the United States and the State of Texas and the
Charter of the City of Plainview. Immediately following their appointment and
annually thereafter, the Advisory Group shall meet to elect a chairperson, vice
chairperson and secretary. The Advisory Group shall adopt rules and
regulations, subject to the approval of the City Manager, pertaining to the
performance of its duties and the time and frequency of its meetings.
Section V. Source of Funds for Expenditures
The City of Plainview RSVP Community Advisory Group shall not make any
expenditures of any money, nor incur any liability during any current year beyond
the amount of money appropriated or set apart in the annual budget for the City
of Plainview RSVP Community Advisory Group as authorized and approved by
the City Council for such purpose.
Section VI. Severability
If any section, subsection, sentence, clause, phrase, or portion of this ordinance
is, for any reason, held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct, and independent
provision and such holding shall not effect the. validity of the -remaining provisions
thereof.
Section VII. Cumulativeness
Provisions of this ordinance are cumulative and nothing herein shall prevent,
alter, or diminish the applicability or enforcement of other ordinances restricting,
r. egulating, or governing the subject matter herein.
Section VIII. Conflicts
All ordinances or portion of any ordinance of the City of Plainview, Texas, in
conflict herewith, are hereby amended to cOnform with the provisions hereof.

Section IX. Effective Date
This ordinance shall be of full force and effect upon its passage.
Passed and Approved on first reading this 9th day of October, 2001.
