HomeMy WebLinkAbout01 1023 minThe Plainview City Council met on October 23, 2001, at 7:00 p.m. in the Council Chambers of Plainview City Hall, 901 Broadway. The Council met in pre-session at 6:30 p.m. The agenda for this meeting was posted at City Hall at 10:00 a.m. on October 16, 2001. Mayor Lloyd C. Woods presided. Councilmembers present were: Sam Parker-District 1, Mary Jane Shanes-District 2, Mike Hutcherson-District 4, Ross Owen- District 5, Buddy McGehee-District 6 and Irene Favila-District 7. Councilmember Rey Rosas-District 3 was absent. Staff present were: James P. Jeffers-City Manager, John Berry-Director of Public Works, John Castro-Director of Community Development, Gary Glass-Fire Chief, Wally Hatch-City Attorney, William Mull-Chief of Police, Dale Simpson-Director of Civil Service, Matthew Tsakanikas-Main Street Coordinator, Greg Zielinksi-Code Enforcement Officer, and Belinda Hinojosa-City Secretary. News media representative present were: Richard Orr-Plainview Daily Guests present were: Ken Halbleib, Rollie Hyde, Chris LeFevre, Robert Edwards, Pat Karrh, President of the Chamber of Commerce, Brian Thomas, Convention & Visitors Bureau Director, Jim Ferrell, Executive Vice President of the Chamber of Commerce and Brian Pohlmeier, 1st Vice President of the Chamber of Commerce Councilmember Shanes delivered the invocation. The Girl Scouts led in the Pledge of Allegiance. Councilmember Favila moved that the Consent Calendar. be approved as presented. The motion, duly seconded by Councilmember Owen, carried by unanimous vote. Items approved on the Consent Calendar included: approval of the minutes of October 9, 2001 and October 18, 2001; receipt of departmental reports; and approval of expenditures. The Council reappointed Irma Luna to the Parks Advisory Board. The Council approved passage of Resolution 01-106, a Resolution of the City Council of the City of Plainview, Texas supporting the passage of Constitutional Amendment Proposition 15. The Council approved upon second reading Ordinance No. 01-3308, an Ordinance of the City of Plainview, Texas creating a Retired Senior Volunteer Program Community Advisory Group; establishing terms of members; defining powers and duties; defining the organizational structure; establishing a policy on expenditures; cumulativeness clause; conflicts clause; severability clause; and effective date. The Council approved signing of the RSVP Letter of-Understanding with Wayland Baptist University to provide office space, utilities and phone service to RSVP. It provides for six months written notice should any party wish to end the agreement. The Council nominated Councilmember McGehee and Councilmember Shanes to the Hale County Appraisal District Board. Pat Karrh, President of the Chamber of Commerce, Brian Thomas, Convention & Visitors Bureau Director, Jim Ferrell, Executive Vice President of the Chamber of Commerce and Brian Pohlmeier, 1st Vice President of the Chamber of Commerce presented information on the 2001-2002 hotel/motel Budget. Councilmember Owen moved that the Council approve the Budget. The motion duly seconded by Councilmember Hutcherson, carried by unanimous vote. City of Plainview City Council Minutes October 23, 2001 Page 1 of 2 Mr. Zielinski presented Ordinance No. 01r3307, an Ordinance of the City of Plainview, Texas amending Chapters 6, 10 and 20 of the Plainview Code of Ordinances to provide for registration and bonding of contractors and to adopt the most recent addition of the National Electrical Code, Severability Clause, Cumulativeness Clause; Conflicts Clause; and Effective Date. He advised that the ordinance has three parts: update 1999 National Electrical Code, require annual registration of contractors with a $10.00 fee, and require a surety bond. Cliff Jernigan of 3604 Grandview expressed opposition to the requirement of bonding. Ken Halbleib of 1410 Holiday, Jerry Ulmer of 206 Amarillo, and Robert Edwards of 1503 West 21st all voiced their disapproval of both bonding and registration. Kip Pritchard voiced his approval for the ordinance. Councilmember Owen moved that Ordinance No. 01-3307 be approved with an annual $10.00 registration fee, update of National Electrical Code and the removal of the requirement of the surety bond. Councilmember Hutcherson seconded the motion. Councilmember Shanes moved that the Council amend the prior motion to approve update of the National Electrical Code and to remove requirement of registration and the requirement of a bond. Councilmember Favila seconded the motion. Councilmembers Shanes, Favila and Parker voted "for" the motion. Mayor Woods, Councilmembers McGehee, Hutcherson, Owen voted "against" the motion. The motion failed for a lack of majority. The Council then proceeded to vote on the original motion. Mayor Woods, Councilmembers McGehee, Hutcherson, Owen and Parker voted "for" the motion. Councilmembers Shanes and Favila voted "against" the motion. The motion carried. Mr. Castro presented Ordinance No. 01-3309, an Ordinance amending City of Plainview Code of Ordinances Chapter Five, "Animals and Fowl", relating to leaving animals unattended in vehicle; providing for severability clause; cumulativeness clause; conflicts clause; and effective date. The Community Relations Commission recommended passage of the Ordinance. The City of Lubbock had recently passed a similar type of ordinance. Councilmember Shanes moved that the Council approve passage upon first reading of Ordinance No. 01-3309. The motion duly seconded by Councilmember Parker, carded by unanimous vote. Police Chief Will Mull presented information on the 911 mapping system. Mary Jane Shanes made the motion to adjourn. The motion was duly seconded by Rey Rosas and carried by unanimous vote.
