Mayor Charles Starnes presided. Council Members present were Mary Elizabeth Dickerson -District 1, Steve Martinez -District 2, Mike McDonough -District 3, Gary House - District 4, Daniel Rascon-District 5, Evan Weiss -District 6 and Lorie Rodriguez -District 7. Consider Maximum Proposed Property Tax Rate that can be considered for Fiscal Year 2024-2025 and Schedule Public Hearings Presenter: Jeffrey Snyder, City Manager The Council is setting the maximum proposed property tax rate that can be considered for the upcoming fiscal year. The public hearing and first reading of the Ordinance to adopt the Property Tax Rate and Budget is scheduled for Tuesday, September 10. The second and final reading to adopt the Property Tax Rate and Budget will be on Tuesday, September 24. Public Comment: None Motion: Move to consider a proposed tax rate of $.7740 for the FY 2024-2025 Budget and schedule the public hearing on the tax rate and budget for Tuesday, September 10tn, 2024 at 6:30 p.m. at City Hall, 202 W. 5tn Street. Texas and Amendinq the Zoning Map of the City of Plainview as Set Out in �14.02.003 of the Code of Ordinances By Changing From Rural Agriculture ("RA") Zoning District to General Commercial Business ("GC") Zoning District a 1.94 Acre Tract Out of a 95.36 Acre Tract Blk JK2, Abstract 2180,G.C.& S.F.R.R. (Ordinance No. 24- 3764 — Second Reading) Presenter: Jeff Johnston, Assistant City Manager Staff recommends the City Council consider approval of the Ordinance to rezone the property located at 4201 Olton Road from Rural Agriculture (RA) to General Commercial (GC). An Ordinance of the City Council of the City of Plainview Texas, Approving a Negotiated Settlement Between the Executive Committee of Cities Served by Atmos West Texas ("Cities") and Atmos Energy Corp., West Texas Division Regarding the Company's 2024 Rate Review Mechanism Filing; Declaring Existing Rates to be Unreasonable; Adopting Tariffs That Reflect Rate Adiustments Consistent With the Negotiated Settlement, Finding the Rates to be Set by the Attached Settlement Tariffs to be Just and Reasonable and in the Public Interest; Approving an Attachment Establishing a Benchmark for Pensions and Retiree Medical Benefits; Approvinq an Attachment Regarding Amortization of Regulatory Liability; Requiring the Company to Reimburse Cities' Reasonable Ratemakinq Expenses; Determining That this Ordinance was Passed in Accordance with the Requirements of the Texas Open Meetings Act; Adopting a Savings Clause; Declaring an Effective Date; and Requiring Delivery of this Ordinance to the Company and the Cities' Legal Counsel. (Ordinance No. 24-3765 — First Reading) Presenter: Jeffrey Snyder, City Manager On or about April 1, 2024, Atmos filed a rate request pursuant to the RRM Tariff adopted by Cities. The Company claimed that its cost of service in a test year ending December 31, 2023, entitled it to a $6.7 million increase to the WTX Cities. This was reduced to $5.8 million due to limitations in the RRM tariff. After a review of consultant's report and negotiations with Cities' representatives, Atmos agreed to a rate increase of $4.3 million plus revenue related taxes within the Cities, with an Effective Date of October 1, 2024. The impact of this increase in revenues to an average residential customer's bill is an increase of approximately $1.27 per month. A Resolution of the City Council of the City of Plainview, Texas: Adopting Designating One Mailing Address and One Electronic Mail Address for Purposes of Receiving Public Information Requests. (Resolution R24-641) Presenter: Belinda Hinojosa, City Secretary This would set one mailing address, one electronic mailing address and website address for the submittal of public information requests. Public Comment: None Motion: Move to adopt Resolution R24-641 Motion by Council Member McDonough, seconded by Council Member Rodriguez Vote: 8-0. Motion carried. 8. Resolution for Texas Department of Agriculture Community Development Block grant to authorize Mayor to sign Citizen Participation Plan and Grievance Procedures, Excessive Force, Fair Housing, Section 504 Grievance Procedures, Code of Conduct policies, and Violence Against Women Act, Section 3 Policy required with the use of any HUD funds, Limited English Proficiency Plan and Activity to affirmatively furthering Fair Housing choice. (TXCDBG GRANT #CDM23-0226) (Resolution R24-644) Presenter: Tim Crosswhite, Capital Improvement Program Manager This Resolution is a part of the requirements under the Texas Department of Agriculture Community Development Block Grant Program for the Downtown Streetscape Construction Project, Phase 2. Review and take possible action over Civil Rights Resolution and presentation on A1024 Section 3 Presentation to Local Community for TxCDBG grant #CDM23-0226". The City of Plainview in consideration for the receipt and acceptance of federal funding, agrees to comply with all federal rules and regulations including those rules and regulations governing citizen participation and civil rights protections. Award of Bid for Runway Crack Seal Project City Council Minutes August 27, 2024 Page 4 of 5 430 Presenter: Tim Crosswhite, Capital Improvement Program Manager The City received one bid from Calco Services LLC in the amount of $96,000. Staff recommends approval. Public Comment: None Motion: Move to award bid for Runway Crack Seal Project Motion by Council Member House, seconded by Council Member McDonough Vote: 8-0. Motion carried. 10. Authorize Change Order No. 1 for Airport Runway Crack Seal Project Presenter: Tim Crosswhite, Capital Improvement Program Manager In order to maximize the RAMP reimbursement, staff recommends a change order for an additional $14,000. Convene into executive session in accordance with Tex. Gov't Code W1.071 to seek the advice about pending or contemplated litigation, settlement offers or on matters in which duty of the attorney under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas conflicts with Tex. Gov't Code Ch. 551 Mayor recessed the meeting at 7:08 p.m. Mayor Starnes called the meeting back in open session at 7:31 p.m. and announced no action. 12.
