RESOLUTION NO. R24-646
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW,
TEXAS: SETTING A DATE, TIME, AND PLACE FOR A PUBLIC HEARING
ON THE PROPOSED ANNEXATION OF CERTAIN PROPERTY BY THE
CITY OF PLAINVIEW, TEXAS; AUTHORIZING THE MAYOR TO HAVE
AFFECTED PERSONS NOTIFIED AND PUBLISH NOTICE OF SUCH
PUBLIC HEARING; AND DIRECTING CITY STAFF TO INVENTORY CITY
SERVICES EXTENDED TO SUCH PROPERTY IN A PRELIMINARY
MUNICIPAL SERVICE PLAN AND PROVIDE AN UPDATED MAP.
WHEREAS, State Street Housing Development, LP owns a 2.62-acre tract of land
located in Section 27, Block JK-2, G.C. & S.F. RR. CO. SURVEY, Abstract No. 25, Hale County,
Texas, and more particularly described on the Exhibit A attached to this Resolution (the
"Property"); and
WHEREAS, State Street Housing Development, LP, through Salem Clark
Development and its representative Kelly Garrett, has requested the City of Plainview, Hale
County, Texas to annex the Property under Subchapter C-3 (Annexation of Area on Request
of Owners) of Chapter 43 of the Texas Local Government Code ("Subchapter C-3"); and
WHEREAS, Section 43.0673 of the Texas Local Government Code requires the
governing body of a municipality to conduct a public hearing before it may adopt an
ordinance annexing an area under Subchapter C-3.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLAINVIEW, TEXAS THAT:
SECTION I
On Thursday, September 19, 2024, at 11:30 a.m. at Plainview City Hall, the Plainview
City Council will hold a public hearing in accordance with Texas Local Government Code
Section 43.0673, giving all interested persons the right to appear and be heard on the
proposed annexation by the City of Plainview, Texas, of the following property, which is fully
described on the attached Exhibit A:
a 2.62 acre tract of land located in section 27, block JK-2, G.C. & S.F. RR. CO.
SURVEY, abstract No. 25, Hale County, Texas, which is adjacent to its incorporated
city limits.
SECTION II
In accordance with Texas Local Government Code Sections 43.905 and 43.9051,
written notice by certified mail shall be sent to each public school district located in the area
proposed for annexation and to each public entity (as defined by Section 43.9051) that is

located in or provides services to the proposed annexed area.
SECTION III
In accordance with Texas Local Government Code Section 43.0673(d), notice of the
public hearing shall be posted on the City of Plainview's Internet website and published in a
newspaper having general circulation in the city and in the area proposed for annexation.
SECTION IV
Furthermore, the City Council directs that a written agreement regarding services be
developed in accordance with Texas Local Government Code Section 43.0672,

BEGINNING AT A 1/2" IRON ROD WITH CAP MARKED "AMO ENGINEERING", FOUND IN THE
NORTH LINE OF 16TH STREET, DEDICATED WITH THE PLAT OF WAL-MART SUPERCENTER
ADDITION, LOTS 1-3, BLOCK 1 & LOTS 1-2, BLOCK 2, AS DESCRIBED BY THE MAP, PLAT
AND/OR DEDICATION DEED THEREOF RECORDED IN VOLUME 1002, PAGE 4678 OF THE
OPRHCT, AT THE SOUTHWEST CORNER OF STONEBRIDGE, TRACT "A", AS DESCRIBED BY
