Mayor Charles Starnes presided. Council Members present were Mary Elizabeth Dickerson -District 1, Steve Martinez -District 2, Mike McDonough -District 3, Gary House - District 4, Daniel Rascon-District 5, Evan Weiss -District 6 and Lorie Rodriguez -District 7. Staff members present were Jeffrey Snyder -City Manager, Slater Elza-City Attorney, Courtney White -City Attorney, Jeff Johnston -Assistant City Manager, Isauro Gutierrez - Director of Information Technology, Derrick Watson -Police Chief, Bobby Gipson -Fire Chief, Valessa Gutierrez -Interim Finance Director/HR Manager, Melinda Brown - Community Engagement Manager, and Belinda Hinojosa-City Secretary. An Ordinance of the City of Plainview, Texas, Adopting and Approving the Budget for the Fiscal Year Beginning October 1, 2024 and Terminating September 30, 2025, a Classification and Compensation Plan For All Employees, and Making Such Appropriations for Each Department, Project and Account; Authorizing the City Manager to Make Certain Transfers of Funds; Providing a Savings Clause; Providing a Severability Clause; Findinq and Determining that the Meetings at Which the Ordinance is Passed are Open to the Public as Required by Law; and Providing an Effective Date. An Ordinance of the Citv of Plainview, Texas, Setting and Levvinq the Municipal Ad Valorem Tax Rate for the Year 2024; Apportioning Said Levy Amongst the Various Funds and Items for Which Revenue Must be Raised; Fixing the Times in Which Said Taxes Shall be Paid: Providing for a Penalty, and Interest and any Additional Penalty on Taxes Not Timely Paid: Providing a Savings Clause; Providing a Severability Clause; and Providing an Effective Date. Texas By Amending the Fees, Rates and Service Charges for Providing Municipal and Governmental Services Found in Appendix A and in Chapter 10 "Subdivision Regulation"; Providing for a Penalty Not To Exceed $500.00 for Each Offense; Providing an Effective Date; Providinq a Savings Clause; Providing a Repealer And Providing For Publication. An Ordinance of the Citv of Plainview Amendina Ordinance No. 23-3753 to Appropriate Funds in the General Fund and Various Revenue and Capital Funds Pursuant to Section 5.07 (A) And (D) of the Plainview City Charter Allowing for Supplemental Appropriations in the 2023-2024 Budget; Providing a Savings Clause; Providina a Severabilitv Clause: and Providina an Effective Date. An Ordinance of the City Council of the City of Plainview, Texas: Annexing the 445 Hereinafter Described Territory to the City of Plainview, Hale County, Texas, and Extending the Boundary Limits of Said City so as to Include Said Hereinafter Described Property Within Said City Limits, and Granting to all the Inhabitants of Said Property all the Rights and Privileges of Other Citizens and Binding Said Inhabitants by all of the Acts, Ordinances, Resolutions, and Regulations of Said City; Adopting a Written Agreement Regarding Services for the Annexed Property; Providing Repealer and Severability Clauses; and Providing an Effective Date. A Resolution by the City of Plainview, Texas ("City") Denying Southwestern Public Service Company's Proposed Surcharge in Connection With Final Rates Approved Related to its Statement of Intent Submitted on About February 8, 2023: Authorizing the City's Continued Participation With Other Cities in the Alliance of Xcel Municipalities "AXM") And Participation in Related Rate Proceedings; Authorizing the Hiring of Attorneys and Consultants; Requiring Reimbursement of Reasonable Legal and Consultant Expenses; Finding that the Meeting Complies With the Open Meetings Act; Making Other Findings and Provisions Related to the Subject (Resolution R24-647) Presenter: Jeffrey Snyder, City Manager Staff recommends approval of Resolution denying SIPS proposed surcharge allowing attorneys to discuss with SIPS what a more appropriate interest rate should be. Public Comment: None Motion: Move to approve Resolution R24-647 Motion by Council Member Rascon, seconded by Council Member McDonough Vote: 8-0. Motion carried. 11. Authorize the Professional Services Agreement with AMD Engineering for the North Quincy Street Reconstruction Project Presenter: Jeffrey Snyder, City Manager TxDOT is planning to reconstruct State Highway 194 from SW 3rd Street to the Interstate. As a part of this project, TxDOT will reconstruct a portion of North Quincy Street that intersects with State Highway 194 through the rail crossing. City Council Minutes September 24, 2024 Page 4 of 5 446 This would allow us to rebuild the remaining portion of North Quincy Street to 24th Street. The total estimated cost of the project is $750K. There are funds set aside in the Street Improvement and Capital Improvement Fund to support this project. Public Comment: None Motion: Move to authorize the Professional Services Agreement Motion by Council Member House, seconded by Mayor Pro Tern Weiss Vote: 8-0. Motion carried. 12. Convene into executive session pursuant to Texas Gov't Code 551.074 to deliberate the appointment, employment, evaluation, reassignment, duties, discipline or dismissal of a public officer or employee, or to hear a complaint or charge against an officer or employee. City Manager. The Mayor recessed the meeting at 6.55 p.m. The Mayor called the meeting back in open session at 7.02 p.m. Jeffrey Snyder submitted his resignation as City Manager effective January 3, 2025. Motion: Move to accept the resignation reluctantly Motion by Council Member McDonough, seconded by Council Member Dickerson Vote: 6-1. Mayor Starnes, Council Members Dickerson, McDonough, House, Rascon and Rodriguez voted "for" the motion. Mayor Pro Tern Weiss voted "against" the motion. Council Member Martinez abstained.
