A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW,
TEXAS ESTABLISHING LEGISLATIVE PRIORITIES AND ADOPTING A
LEGISLATIVE AGENDA FOR THE 89TH TEXAS LEGISLATURE
INCLUDING ANY SPECIAL CALLED SESSIONS AND THE INTERIM
WHEREAS, the City of Plainview, as a home rule city that derives its power from
the Texas Constitution, possesses the full power of self-government and is the most
direct, responsive and frequent point of contact between an elected governmental body
and the citizens it serves; and
WHEREAS, the City Council of the City of Plainview ("City Council") highest priority
is to preserve its ability to govern effectively and efficiently for its citizens, residents,
businesses and visitors; and
WHEREAS, many of the governmental services that the citizens of the City of
Plainview rely upon on a daily basis are provided for by their municipal government
including law enforcement, fire and emergency response and basic utility services; and
WHEREAS, the City Council finds legislative involvement to be a legitimate
exercise of its elected duties as the governing body serving those who live, work, visit,
and own property in the municipal limits and extra -territorial jurisdiction of the City of
Plainview; and
WHEREAS, the City Council understands that members of the Texas Senate and
the Texas House of Representatives benefit from learning of the positions of locally -
elected public officials charged with representing its citizens and providing essential
governmental services; and
WHEREAS, in order to preserve its ability to govern effectively and efficiently for
its citizens, the City Council finds it to be in the public interest to take positions on certain
issues that may come before the 89th Texas Legislature in 2025;
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS,
HEREBY RESOLVES:
1. THAT the attached "City of Plainview Legislative Agenda 2025" is hereby approved
and adopted and is incorporated as if fully set forth herein.
2. THAT members of the City Council are authorized and encouraged to meet with
area state representatives and senators to discuss the City's Legislative Agenda and
provide any information, assistance or support to state legislators to accomplish the City's
Legislative Agenda.

3. THAT the City Manager is directed to provide a copy of this resolution to Senator
Perry (Senate District 28) and Representative King (House District 88), as the state
legislators representing Plainview in the Texas Legislature.
4. THAT members of the City Council and City staff may work with peer cities in the
State, the Texas Municipal League and other appropriate entities to fulfill the City's
Legislative Agenda.
5. THAT the Mayor and City Manager shall take any necessary lawful action to
accomplish the City's Legislative Agenda including, but not limited to, meeting with area
state representatives and senators, peer cities in the State, the Texas Municipal League
and other appropriate entities to accomplish the City's Legislative Agenda.
6. THAT the Mayor and City Manager shall take any necessary action to promote
and inform the citizens of Plainview of the City's Legislative Agenda.
7. THAT it is imperative that state legislators fully understand the implications of
legislation they act upon and seek the input and advice from local governments on
legislative issues that have a direct impact on the local government's ability to self -govern
and serve their citizens efficiently and effectively.

During the 2023 Session, more than 8,000 bills or significant resolutions were filed;
more than 1,800 of them would have affected Texas Cities in some substantial way.
Over one thousand two hundred bills or resolutions passed and were signed into
law; more than 230 of them impacted cities. Legislators have filed over 1,100 bills
since pre -filing began last month. Those that are city -related are summarized each
week by the League in the Legislative Update.
As a part of the Texas Municipal League Grassroots Legislative Program, the City
of Plainview has provided legislative priorities to our elected state representatives,
Senator Charles Perry (Senate District 28) and Representative Ken King (House
District 88).
These legislative priorities serve as a guide to our staff as we work with our
legislators on various local issues that may have an impact on our community.

2025
The Plainview City Council identifies the following priorities for the Eighty -Ninth (89th)
Texas Legislative Session:
The City of Plainview supports:
• Appropriate efforts to support the continued growth, development and
redevelopment of Plainview
• Efforts to address the state's water challenges and related funding opportunities.
• Efforts to designate, fund and construct Interstate 27 north and south from its
current limits and replacement of the 24th street overpass, to support growth
throughout the state, to enhance safety, to enhance passenger and freight mobility
and to support international trade through Texas.
• Allow cities the option of using either an official newspaper or a website for the
publication of legal notices
• Changes to the sales tax refund and allocation process that converts the Texas
Comptroller of Public Accounts current ministerial process into a formal
administrative process.
• Efforts to require the Texas Comptroller of Public Accounts to automatically
provide city specific, local sales tax information to the particular subject city without
the need for a request under the Texas Public Information Act.

• Full funding for the Texas Recreation and Parks Account local grant program.
• Continued state funding for mental health treatment.
• Efforts to require marketplace providers or facilitators of short-term rentals to remit
the local portion of the HOT tax directly to the appropriate municipality.
• Full restoration and increase of state funding for mental health treatment.
• Promotion of pay-as-you-go financing for capital investments and improvements
through authorization of a dedicated property tax rate that is classified similar to
the debt service tax rate in property tax calculations.
The City of Plainview will oppose:
• Legislation that would diminish or restrict an elected City Council's ability to provide
necessary and required services to its residents and community.
• Increased pass -through or regulatory fees on cities that are collected for or on
behalf of the state.
• Imposition of mandates that do not provide for a commensurate level of
compensation.
• Limits on effective municipal participation in the legislative process and the ability
to hire representatives with public funds to represent the City in accordance with
this duly adopted legislative agenda on matters that would impact the City or our
residents.
• Limits on Municipal Home Rule Authority or local control.
• Limits on municipal authority commonly known as preemption or super
preemption bills.
• Removal of city original jurisdiction in utility rate -making proceedings or removal of
the ability to recover reasonable expenses involved in rate -making proceedings,
including contested cases.
