HomeMy WebLinkAboutR25-666RESOLUTION ACCEPTING A PUBLIC RIGHT-OF-WAY FROM LOUIS DREYFUS COMPANY COTTON STORAGE LLC IN TRACTS F AND G OF COMPRESS ADDITION, AN ADDITION TO THE CITY OF PLAINVIEW, HALE COUNTY, TEXAS BEING A REPLAT OF LOTS 7-8, BLOCK 1, AND LOTS 3-8, BLOCK 2, A.L. MAUPIN ADDITION, AND ALL OF BLOCK 10, NOB -HILL ADDITION, TO THE CITY OF PLAINVIEW, HALE COUNTY, TEXAS AS DETAILED IN THE PLAT TO BE FILED WITH THE HALE COUNTY CLERK AND GENERALLY LOCATED BETWEEN ELM STREET AND IVY STREET WHEREAS, the City Council for the City of Plainview, Texas, as a home -rule municipality and pursuant to the constitution and laws of the State of Texas, including, but not limited to, Article 11, Section 5 of the Texas Constitution, Texas Local Government Code Chapter 212, and Chapter 10 of the Plainview Code of Ordinances, regulates the subdivision and platting of properties within the municipal limits of the City and its extraterritorial jurisdiction; and WHEREAS, Louis Dreyfus Company Cotton Storage LLC submitted a replat for tracts F and G of Compress Addition, an Addition to the City of Plainview, Hale County, Texas, being a replat of Lots 7-8, Block 1 and Lots 3-8, Block 2, A.L. Maupin Addition, and all of Block 10, Nab -Hill Addition, to the City of Plainview, Hale County, Texas (Case File No. P-25-005) in order to facilitate development of the property generally located between Elm Street, Ivy Street, E. 7th Street, and E. 10th Street, within the municipal limits of the City of Plainview (the "Property"); and WHEREAS, as part of the platting approval process and in order to fulfill the purposes outlined in Texas Local Government Code Chapter 212 and Chapter 10 of the Plainview Code of Ordinances, including, but not limited to, the harmonious development of the City, the provision of necessary municipal infrastructure, and the provision of adequate water, drainage, sewage, and other utilities, the City required the following public dedication: ■ an approximately 837.75 feet long public right-of-way, with a varying width of 38.59 feet and 64.42 feet, for future road development and right-of-way purposes, referred to as the "Public Dedication" and more particularly described in Exhibit "A" attached hereto and incorporated herein by reference; and WHEREAS, in accordance with Texas Local Government Code Section 212.011, accepting and approving a plat does not constitute an acceptance of any proposed dedication or other development; and WHEREAS, the City Council of the City of Plainview believes it would be in the best interest of the City and of the public health, safety, and welfare of its citizens to accept the Public Dedication outlined on the Property. Resolution R25-666 Page 1 of 3 w 0 o NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS, THAT: SECTION 1. The findings recitals outlined above are found to be true and correct and are hereby adopted and approved. SECTION 2. The City Council accepts the Public Dedication by Louis Dreyfus Company Cotton Storage LLC, outlined on the Property and as more particularly described in Exhibit 'A" attached hereto and incorporated herein by reference, granting to the City of Plainview a permanent and perpetual right-of-way for all purposes for which a public right-of-way is commonly used, including, but not limited to, the right to permit the public to use the Public Dedication as a public right-of-way, the right to construct and install streets and sidewalks within the Public Dedication, and the right to install or permit utilities within the Public Dedication as needed by the City or required by law. SECTION 3. By accepting the attached Public Dedication, the City Council recognizes that the Public Dedication and the rights granted therein shall be used for public purposes and the purposes expressly granted in such Public Dedication. SECTION 4. The Mayor is hereby authorized and directed to enter into and execute any such documents as necessary to affect and certify the acceptance of this Public Dedication.
