R25-685 A RESOLUTION OF THE CITY OF PLAINVIEW, CITY COUNCIL AUTHORIZING THE FILING OF A GRANT APPLICATION WITH THE OFFICE OF THE GOVERNOR, CRIMINAL JUSTICE DIVISION THROUGH THE SOUTH PLAINS ASSOCIATION OF GOVERNMENTS FOR BULLET -RESISTANT COMPONENTS FOR LAW ENFORCEMENT VEHICLES; AUTHORIZING THE MAYOR AND/OR CITY MANAGER TO ACT ON BEHALF OF THE CITY OF PLAINVIEW IN ALL MATTERS RELATED TO THE APPLICATION; AND AGREEING TO COMPLY WITH THE TERMS AND CONDITIONS OF THE GRANT IF AWARDED. WHEREAS, State funds have been authorized by H.B. 2217 Section 772.013 passed during the 89th Regular Session and appropriated under H.B. 500 Section 1.34 for Trusteed Programs within the Office of the Governor; and WHEREAS, the announcement of the availability of these funds has been made on October 15t", 2025, by the Office of the Governor of the State of Texas and through the South Plains Association of Governments; and WHEREAS, the projects must begin on or after March 1st, 2026 and may not exceed a 12-month period; and WHEREAS, Funds may only be used for obtaining and installing bullet -resistant windshields, side windows, rear windows and door panels compliant with the National Institute of Justice (NIJ) Level IIIA or higher into motor vehicles used by peace officers; and WHEREAS, The City of Plainview agrees that there are no applicable matching funds for the said project as required by the grant application; and WHEREAS, The City of Plainview agrees that in the event of loss or misuse of the Office of the Governor funds, The City of Plainview assures that the funds will be returned to the Office of the Governor in full. WHEREAS, The City of Plainview designates Chief Derrick Watson as the grantee's authorized official. The authorized official is given the power to apply for, accept, reject, alter or terminate the grant on behalf of the applicant agency. WHEREAS, the City Council of the City of Plainview believes it to be in the best interest of the citizens of the City of Plainview to authorize Chief Derrick Watson to apply for such funds from the Office of the Governor to equip motor vehicles used by peace officers(as defined by Article 2A.001,Texas Code of Criminal Procedure) directly employed by the Plainview Police Department in discharging the officers' official duties in the City of Plainview Texas. Resolution R25-685 Pagel of 2 110 NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS, HEREBY RESOLVES: 1. THAT the Chief Derrick Watson is authorized to request funding from State funds authorized by H.B. 2217 Section 772.013 through the Office of the Governor, and act on behalf of the City of Plainview in all matters related to the grant application and any subsequent grant contract and grant project that may result. 2. THAT Chief Derrick Watson of the City of Plainview is hereby authorized to administer and oversee all matters relating to such grant application and to execute all necessary documents related to such grant application and grant acceptance. 3. THAT in the event the City of Plainview is awarded such grant, the City of Plainview, to the best of its ability, agrees to comply with the terms and conditions of the grant.
