WHEREAS, the City Council for the City of Plainview, Texas (the "City") pursuant
to the constitution and laws of the State of Texas, including, but not limited to, Article 11,
Section 5 of the Texas Constitution, Title 7, Subtitle A and Chapters 51 and 552 of the
Texas Local Government Code, Texas Transportation Code Sections 311.001 and
545.356, and the general powers outlined in the Plainview City Charter, has exclusive
control over the City's highways and streets and may by ordinance alter the speed limits
of a street or highway within the City's municipal limits; and

NOW THEREFORE, BE IT ORDAINED
TEXAS, THAT:
SECTION 1. The findings and recitals outlined above are found to be true and correct
and are hereby adopted and approved.
SECTION 2. Section 12.07.005 "School zones" of the Code of Ordinances, City
Plainview, Texas is hereby replaced in its entirety and amended to be and read a
follows:

AN ORDINANCE AMENDING CHAPTER 12 "TRAFFIC AND
VEHICLES," ARTICLE 12.07 "SPEED," SECTION 12.07.005 "SCHOOL
ZONES" OF THE CODE OF ORDINANCES, CITY OF PLAINVIEW,
TEXAS TO CLARIFY AND REVISE THE PORTIONS OF CITY STREETS
DESIGNATED AS SCHOOL ZONES; PROVIDING FOR A PENALTY NOT
TO EXCEED $500.00 FOR EACH OFFENSE; PROVIDING AN
EFFECTIVE DATE; PROVIDING A REPEALER; PROVIDING A SAVINGS
CLAUSE; AND PROVIDING FOR PUBLICATION.
WHEREAS, the City Council for the City of Plainview, Texas (the "City") pursuant
to the constitution and laws of the State of Texas, including, but not limited to, Article 11,
Section 5 of the Texas Constitution, Title 7, Subtitle A and Chapters 51 and 552 of the
Texas Local Government Code, Texas Transportation Code Sections 311.001 and
545.356, and the general powers outlined in the Plainview City Charter, has exclusive
control over the City's highways and streets and may by ordinance alter the speed limits
of a street or highway within the City's municipal limits; and
WHEREAS, the City Council for the City of Plainview Texas, in accordance with
the above -referenced authority and Section 12.07.005 of the Code of Ordinances, City of
Plainview, Texas, previously established a maximum speed limit of thirty-five (35) miles
per hour on certain City streets described and designated as school zones within the
City's municipal limits; and
WHEREAS, due to changes in the Plainview Independent School District, new
school locations and resulting traffic patterns, the City Council for the City of Plainview,
Texas finds it necessary to revise the portion or portions of City streets declared as school
zones; and
WHEREAS, the City Council for the City of Plainview, Texas finds that revising the
portion or portions of City streets declared as school zones is reasonable and beneficial
for the public health, safety and general welfare of the citizens of the City.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PLAINVIEW, TEXAS, THAT:
SECTION 1. The findings and recitals outlined above are found to be true and correct
and are hereby adopted and approved.
SECTION 2. Section 12.07.005 "School zones" of the Code of Ordinances, City of
Plainview, Texas is hereby replaced in its entirety and amended to be and read as
follows:

(2) It shall be unlawful for any person to operate any automobile, motorcycle, motor
scooter or any type of motor vehicle which is self-propelled in a school zone at a speed
greater than as provided by section 12.07.005(1) during the times indicated by section
12.07.005(1), or when the school zone traffic signal control light is flashing, or when
children are present in the school zone.
SECTION 3. Penalty. Any person found in violation of any provision of this Ordinance
shall be guilty of a misdemeanor and upon conviction thereof shall be fined in accordance
with the general penalty provision found in Section 1.106 of the Code of Ordinances, City
of Plainview, Texas.
SECTION 4. Effective Date. This ordinance shall take effect immediately from and after
its passage and publication as may be required by governing law.
SECTION 5. Repealed. All other terms and provisions of the Code of Ordinances, City
of Plainview, not in conflict herewith and not hereby amended shall remain in full force
and effect.
SECTION 6. Severability. If any provision, section, subsection, sentence, clause or the
application of same to any person or set of circumstances for any reason is held to be
unconstitutional, void or invalid or for any reason unenforceable, the validity of the
remaining portions of this ordinance or the application thereby shall remain in effect, it
being the intent of the City Council of the City of Plainview, Texas in adopting this
Ordinance No. 26-3783 Page 3 of 4
ordinance, that no portion thereof or provision contained herein shall become inoperative
or fail by any reasons of unconstitutionality of any other portion or provision.
SECTION 7. Publication. The City Secretary of the City of Plainview is hereby
authorized and directed to cause publication of the descriptive caption of this Ordinance
as an alternative method provided by law.
