Hall, 202 W. 5th Street, Plainview, Texas.
Mayor Charles Starnes presided. Members present Council Members Mary Elizabeth
Dickerson -District 1, Steve Martinez -District 2, Gilbert Garcia -District 3, Daniel Rascon-
District 5, Evan Weiss -District 6 and Lorie Rodriguez -District 7. Council Member Gary
House -District 4 was absent.
Staff members present were Jeff Johnston -Assistant City Manager, David Ellis -Director
of Information Technology, Neil Weems -Director of Public Works, Derrick Watson -Chief
of Police, Tim Crosswhite-Capital Improvement Program Manager, Vannesa Rincon-
Interim Director of Finance, Christine Lockridge-Communications Manager and Belinda
Hinojosa-City Secretary.

4. An Ordinance of the City of Plainview Granting a Special Use Permit ("SUP") to
Operate an Indoor Amusement Redemption Game Room in the General Commercial
("GC") Zoning District at 1010 W. 5th Street, Plainview, Texas Pursuant to Sections
14.04.003 and 14.13.004 of the Code of Ordinances, City of Plainview, Texas: Providing

a Penalty, Effective Date, a Savings Clause, and a Severability Clause; and Providing for 87
Publication (Ordinance No. 26-3782 — Second Reading)

Spin Loco has submitted its application for an indoor amusement game room to be
located at 1010 W 5th St. The location and application were presented to the Planning
and Zoning Board (P&Z) for review. The P&Z voted 4 - 1 in favor of recommending final
approval by the City Council.
There was no public comment.
Motion: Move to adopt Ordinance No. 26-3782 on second reading.
Motion by Mayor Pro Tern Weiss, seconded by Council Member Rodriguez
Vote: 7-0. Motion carried.
5. Resolution Accepting An Underground Utility Easement and a Pedestrian Access
Easement From Efrain Calvillo and Vacating a Sewer Line Easement In McDonalds
Plainview Tract 'A," an Addition to The City of Plainview, Hale County, Texas Located in
Section 40, Block JK-2, G.C. & S.F. RR. Company Survey, Abstract Number 517, as
Detailed in the Plat to be filed in the Official Public Records of Hale County, Texas and
Being a Portion of that Certain Tract of Land Conveyed to Efrain Calvillo as Described in
Special Warranty Deed Recorded as County Clerk's File Number 2022-000592 of the
Official Public Records of Hale County, Texas and Generally Located South of W. 5th
Street and West of Joliet Avenue (Resolution R26-688)

On December 11th and on January 8th, the Planning and Zoning Commission approved
the preliminary and final plats for McDonalds Plainview Tract "A" Addition. Along with the
approval of the plat, an existing 20' sewer line easement was proposed to be vacated by
the city due to its location being in the center of the plat. This would lead to the
improvements being constructed over a main city sewer line. The new 10' underground
utility easement for the Council to accept runs along the south side of the property, east
to west approximately 162' then up north on the west side of the property approximately
130'. It is also proposed that Council accepts a 5' Pedestrian Access Easement along the
entire east side of the property, north to south.
Motion: Move to adopt Resolution R26-688
Motion by Mayor Pro Tern Weiss, seconded by Council Member Martinez
Vote: 7-0. Motion carried.
