Hall, 202 W. 51" Street, Plainview, Texas.
Mayor Charles Starnes presided. Members present Council Members Mary Elizabeth
Dickerson -District 1, Steve Martinez -District 2, and Gilbert Garcia -District 3, Gary House -
District 4, Daniel Rascon-District 5, Evan Weiss -District 6 and Lorie Rodriguez -District 7.
Staff members present were Ted Chancellor -City Manager, Jeff Johnston -Assistant City
Manager, Matthew Murray -City Attorney, David Ellis -Director of Information Technology,
Neil Weems -Director of Public Works, Gabe Carrillo -Police Captain, Bobby Gipson -Fire

4. An Ordinance of the City Council of the City of Plainview, Texas, Approving a
Tariff Authorizing an Annual Rate Review Mechanism ("RRM") as a Substitution for the
Annual Interim Rate Adjustment Process Defined by Section 104.301 of the Texas
Utilities Code, and as Negotiated Between Atmos Energy Corp., West Texas Division
("Atmos West Texas" or "Company") and the Steering Committee of Cities Served by
Atmos West Texas: Requiring the Company to Reimburse Cities' Reasonable
Ratemaking Expenses; Adopting a Savings Clause; Determining that this Ordinance was
Passed in Accordance with the Requirements of the Open Meetings Act; Declaring an
Effective Date; and Requiring Delivery of this Ordinance to the Company and Legal
Counsel for the Steering Committee. (Ordinance No. 26-3785 — Second Reading)
Since this was the second of two readings, the Council chose to forego staff briefing and
ask for public comment.

8. Consider the Award of Bid with Freeman Paving of Vernon, TX for the 2026 Seal
Coat Project and authorize the City Manager to sign the necessary documents.
Presenter: Tim Crosswhite, Capital Improvement Program Manager
The City received three bids for the project. Freeman Paving of Vernon, Texas submitted
the lowest responsive and responsible bid at $3.90 per square yard, for a total
construction cost of $286,580. Engineering services are estimated at $25,110.40. The
total project cost remains within the approved budget of $350,000 in the Street
Department.
Approval of this item will award the construction contract and authorize the City Manager
to execute the agreement.

9. Consider the Change Order with Freeman Paving for the 2026 Seal Coat Project
and authorize the City Manager to sign the necessary documents.
Presenter: Tim Crosswhite, Capital Improvement Program Manager
The proposed change order adds West 7th Street from Yonkers to Ennis, increasing the
construction cost by $27,300. The revised construction total is $313,880, with total project
costs, including engineering, estimated at $338,990.40. The expanded scope remains
within the approved budget of $350,000 and allows the City to complete additional
roadway improvements within the current fiscal year.
Staff recommends approval of the change order with Freeman Paving and authorization
for the City Manager to execute the necessary documents.

10. A Resolution of the City of Plainview, Texas Requesting Financial Assistance from
the Texas Water Development Board: Authorizing the Filing of an Application for
Assistance; and Making Certain Findings in Connection Therewith (Resolution R26-698)

In May 2023, the City of Plainview submitted a Project Information Form to the Texas
Water Development Board (TWDB) to evaluate potential treatment options for lithium in
the City's water system.
Lithium has been identified by the Environmental Protection Agency as a priority
emerging contaminant under the Fifth Contaminant Candidate List. While regulatory limits
have not yet been established, recent monitoring conducted through the Unregulated
Contaminant Monitoring Rule indicates the presence of lithium in several of the City's
groundwater wells, as well as in raw water supplied by the Canadian River Municipal
Water Authority. The source is believed to be naturally occurring within regional
groundwater. This project will evaluate feasible treatment options and include pilot testing
to determine the most effective approach for long-term water quality management.

Staff recommends approval of Resolution No. R26-698.
