202 W. 5th Street, Plainview, Texas.
Mayor Charles Starnes presided. Members present Council Members Mary Elizabeth
Dickerson -District 1, Steve Martinez -District 2, Gary House -District 4, Daniel Rascon-
District 5, Evan Weiss -District 6 and Lorie Rodriguez -District 7. Council Member Gilbert
Garcia -District 3 was absent.

c) Conduct a public hearing regarding Case No. MH-26-02; Substandard structure
located at 909 West 16th Street, Plainview, Texas, Hale County.

5. Police Department Annual Report

6. Discussion and possible action regarding the Plainview Country Club Agreement,
including financial oversight requirements and potential amendments.
Presenter: Ted Chancellor, City Manager
The City of Plainview entered into an agreement with the Plainview Country Club in June
2023 for the operation and management of the Municipal Golf Course and Civic Center.
The agreement includes provisions requiring annual audited financial statements. Since
execution of the agreement, it has been determined that the cost of a full financial audit
for these operations is significant, estimated at approximately $30,000 annually. Given
the City's annual contribution of $100,000 toward the operation of these facilities, a full
audit would represent a substantial portion of the funding provided.
The initial audit requirement for May 1, 2024, was waived to allow time for implementation
of the agreement. In 2025, an independent financial review was completed in lieu of a full
audit, providing third -party oversight at a reduced cost. Staff recommends amending the
agreement to reflect a more practical and cost-effective financial oversight approach,
such as an annual independent financial review or internal control review, while
maintaining appropriate accountability and transparency.

Motion: Move to amend 1.06 to read The PCC shall provide an annual financial
review by an outside accounting firm and (a) to read Financial Review;
Motion by Council Member House, seconded by Council Member Martinez
Vote: 6-1. Mayor Starnes, Council Members Martinez, House, Rascon, Weiss and
Rodriguez. Council Member Dickerson voted against. Motion carried.
7. Consideration of Public Golf Rates at the Plainview Municipal Golf Course
Presenter: Monica Rodriguez, General Manager
Plainview Country Club, as the operator of the Municipal Golf Course, has proposed a
limited update to public golf rates for Council consideration.
The proposed change would increase the non-member private cart (trail fee) rate from
$15 to $20, aligning it with the current cost to rent a golf cart at the course. They also
propose the Non -Member PCC Golf Pass at a cost of $65 per month and $20 per
round.
The adjustment is intended to maintain consistency in pricing and support ongoing
course operations, while continuing to encourage membership participation.

Staff recommends approval of the proposed public golf rate adjustment.

Motion: Move to accept the proposal for the non-member golf pass and the visitor
trail fee.

8. A Resolution Authorizing the City Manager Execute a Settlement And Assignment
of Claims with a Subcontractor Who Provided Work On The Plainview Aquatic Center
Project. (Resolution R26-699)
Presenter: Jeff Johnston, Assistant City Manager
The City of Plainview entered a contract with USA Management/Construction in January
2019 for work related to the Plainview Aquatic Center project. Subsequent corrective work
was performed by Concrete Connections, including removal and replacement of surface
concrete due to deficiencies in the original pour.
USA Management/Construction has failed to provide payment to subcontractors for work
performed on the project. As a result, Concrete Connections has outstanding
compensation related to corrective work completed.
The proposed resolution authorizes a settlement and assignment of claims with Concrete
Connections in the amount of $4,000, which includes $3,900 for outstanding work and
$100 for completion of concrete repair.

10. An Ordinance of the City Council of the City of Plainview, Texas, Ordaining the
City's Participation in the Texas Enterprise Zone Program Pursuant to the Texas
Enterprise Zone Act, Chapter 2303, Texas Government Code (ACT), Providing Tax
Incentives, Designating a Liaison for Communication with Interested Parties, and
Nominating Wal-Mart Stores East, LP to the Office of the Governor Economic
Development & Tourism (EDT) through the Economic Development Bank (Bank) as an
Enterprise Project (Project). (Ordinance No. 26-3787 — First Reading)
a. Public Hearing
Presenter: Ted Chancellor, City Manager
Wal-Mart Stores East, LP has requested that the City of Plainview nominate its
Distribution Center robotics upgrade and facility expansion project for participation in the
Texas Enterprise Zone Program (EZP).
The EZP is a state -administered economic development program designed to encourage
private investment and job creation in economically distressed areas. The Wal-Mart
Distribution Center is located within a qualifying area based on federal census data and
is eligible for nomination. Upon state approval, the project may apply for refunds of state
sales tax paid on eligible expenditures, subject to program requirements. Participation in
the program requires formal nomination by the City and includes ongoing compliance
reporting. The program does not create a direct financial obligation for the City. The City
Council has previously approved local incentives for this project, including a tax
abatement and sales tax grant.
The City Council is required to conduct a public hearing and approve the ordinance on
two readings in order to meet state program deadlines.
Staff recommends approval of Ordinance No. 26-3787.
Mayor Starnes opened the public hearing at 7:37 p.m. There was no comment. The
public hearing was closed at 7:38 p.m.
Motion: Move to adopt Ordinance 26-3787 on first reading.
