HomeMy WebLinkAbout04.23.07 BA MinutesBOARD OF ADJUSTMENT MINUTES 4/23/07 BOARD MEMBERS PRESENT: Kenny Brown, John Bickel, James Crossland, Max Browning, Mark Hardin, Larry Gould STAFF MEMBERS PRESENT: John Castro -Director of Community Services, Katy Seals - CommuniTy Services Secretary OTHER GUESTS PRESENT: Reynaldo Nunez and Jessie Irlas Kenny Brown called the meeting to order at 7:00 P. M. FIRST ITEM ON THE AGENDA : SWEAR IN MEMBERS: None SECOND ITEM ON THE AGENDA: Approval of March 2007 minutes. Larry Gould made motion to approve minutes as presented. James Crossland seconded. Motion carried unanimously. THIRD ITEM ON THE AGENDA: BA Case # 1532 The request of Reynaldo Nunez for a variance of seventeen (17) feet of the required twenty-five (25) foot front setback and three (3) feet of the required five (5) foot side setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 13'X24' carport in a Single Family (R-2) Zoning District, and being Block 4, South 410' of Lots 5&6, Highland Addition, Plainview, Hale CounTy, Texas the same being 1009 Fresno Street. Reynaldo Nunez is present to answer questions from the Board with John Castro translating for him. John Castro showed. the Board pictures of the property and a site plan of where the proposed carport would be placed. There were no signed responses from the neighborhood, but John Castro received a phone call from the next door neighbor. This neighbor was concerned if the carport extended to the curb, it would interfere with entering and exiting his driveway. John Castro said he told the neighbor that the carport would only extend six (6) feet and not all the way to the curb. James Crossland asked if the carport would cover the door on the side of the house and Reynoldo Nunez saial it would not cover the door. Kenny Brown asked what materials would be used for construction of the carport and Reynoldo Nunez said it would be made of steel. Kenny Brown asked which direction would water drain from the carport and Reynoldo Nunez said it would drain toward the street. Max Browning made a motion to approve the variance based on this being the or.~ly logical place for a carport with the stipulation that the driveway have an impermeable surface within six months. John Bickel seconded. Motion carried unanimously FOURTH ITEM ON THE AGENDA: BA Case # 14133 The request of Jesse Irlas for a variance of twenTy-five (25) feet of the required twenTy-five (25) foot front setback and four (4) foot of the required five (5) foot side setback as stated in Section 34 of the CiTy of Plainview Zoning Ordinance to construct an 16'X17'4" carport with a 4'X14'6" overhang along the front of the structure covering the entryway in a Single Family (1Z-2) Zoning District, and being Block 79, South 22' of Lot 1 and all of Lot 2, Highland Addition, Plainview, Hale County, Texas the same being 1507 Houston Street. Jessie Irlas is present to answer questions from the Board. John Castro showed the Board pictures of the property and a site plan where the proposed carport and overhang would be placed. He told the Board there is part of an empty lot beside the Board of Adjustment April 23, 2007 Minutes house that belongs to a different property owner. There was one res neighborhood and it was in favor of the request. Kenny Brown asked what materials would be used to construct the carport and Jessie Irlas said it would be made of steel. James Crossland made a motion to approve the variance based on this being the only logical place for the carport and the positive response from the neighborhood and added the stipulation that the driveway be covered with an impermeable surface within six (6) months.
