RESOLUTION NO. R26-703
A RESOLUTION APPROVING A CONTINGENT FEE CONTRACT WITH
PERDUE BRANDON FIELDER COLLINS AND MOTT, L.L.P. FOR THE
COLLECTION OF DELINQUENT MUNICIPAL COURT FINES AND FEES
WHEREAS, the City Council for the City of Plainview, Texas (the "City Council") in
an open meeting considered all the requirements related to a contingent fee contract as
listed in Section 2254.1036(a)(1) of the Government Code as to a Contract for the
Collection of Delinquent Fines and Fees due to the Municipal Court of the City of
Plainview, Hale County, Texas; and
WHEREAS, the City Council, pursuant to Section 2254.1036 of the Government
Code, hereby finds the following to be true as to the Contract by and between City of
Plainview, Texas and Perdue Brandon Fielder Collins & Mott, L.L.P.: (i) there is a
substantial need for the legal services specified in said Contract; (ii) these legal services
cannot be adequately performed by the attorneys and supporting personnel of the City of
Plainview, Texas; and (iii) these legal services cannot be obtained from attorneys in
private practice under a contract providing for only hourly fees, without regard to the
outcome of the matter, because of the nature of the matter for which these services will
be obtained or because the City of Plainview, Texas does not have the funds to pay the
estimated amounts required under a contract providing only for the payment of hourly
fees; and
WHEREAS, the City Council has determined that it is in the public interest to enter
into a Contract for the Collection of Delinquent Fines and Fees due to the Municipal Court
of the City of Plainview with the law firm of Perdue Brandon Fielder Collins & Mott, L.L.P.;
and
WHEREAS, the agenda posted for this meeting of the City Council contains an
agenda item for the consideration of entering into a contingent fee contract in accordance
with section 2254.1036(a)(1) of the Government Code.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLAINVIEW, TEXAS THAT:
Section 1
The facts and recitations contained in the preamble of this Resolution are hereby found
and declared to be true and correct.

Section 2
The proposed Contract for the Collection of Delinquent Fines and Fees due to the
Municipal Court of the City of Plainview with Perdue Brandon Fielder Collins & Mott, L.L.P.
is hereby approved.
Section 3
The Mayor is hereby authorized to execute said Contract for the Collection of Delinquent
Municipal Court Fines and Fees due to the City of Plainview, Texas.
