MINUTES CITY COUNCIL MEETING City of Plainview The Plainview City Council met at 7:00 p.m., Tuesday August 22, 2000 in the Council Chambers of Plainview City Hall, 901 Broadway. Notice of this meeting was posted in City Hall at 4:00 p.m. on August 16, 2000. The Council met in Pre-Session at 6:30 p.m Mayor Lloyd C. Woods presided. Councilmembers present were: Sam Parker-District 1, Rey Rosas-District 3, Mike Hutcherson-District 4, Ross Owen-District 5, Bobby R. McGehee-District 6. Councilmembers Mary Jane Shanes-District 2 and Irene Favila-District 7, were absent. Staff members present were: James P. Jeffers-City Manager; Dale Simpson-Administrative Assistant; John Berry-Director of Public Works; Pat Hernandez-Municipal Court Judge; John Castro-Director of Community Services; Greg Zielinski-Code Administration; Wally Hatch-City Attorney; Gary Glass-Fire Chief, Will Mull-Police Chief; Norman Huggins-Director of Finance; and Karen McBeth-City Secretary. News media present: Richard Orr-Plainview Daily Herald. Guests present: Susan Wilson and Jim Wilson, 2701 West 14m; Steve Mason, HCR 1 Box 236A; Helen and Waylon Fields, Dr~ Tom Longnecker, 1107 Smythe; Steve Long, 3606 Red Oak Lane; and John Trischitti III and William Snook of Wayland Baptist University. OPEN MEETING Invocation - The Honorable Bobby McGehee Pledge of Allegiance - Girl Scouts Recognitions - Mayor Woods presented Certificates of Appreciation to Steve Long, John Trischitti III and William Snook of the Wayland Baptist University Mass Communications department for videoing City Council Meetings and the Mayor's television show for the past several years. 3. Consent Calendar - Councilmember Sam Parker moved to adopt the Consent Calendar as presented. Councilmember Ross Owen seconded the motion. Excused Absences were extended to Councilmembers Mary Jane Shanes and Irene Favila. e) Ordinance No. 00-3265. Building/Fire Super Board. An Ordinance of the City of Plainview, Texas amending Chapters 6, 10, & 20 of the Plainview Code of Ordinances; Severability clause; Cumulativeness clause; Conflicts clause; And effective date. An Ordinance of the City of Plainview, Texas authorizing the condemnation of private property to be used for the purpose of a permanent utility easement; Severability clause; Cumulativeness clause; Conflicts clause; And effective date. Kernell property. (First Reading). Approved. g) Ordinance No. 00-3269. An Ordinance of the City of Plainview, Texas, amending Section 12-122 of the Code of Ordinances, prohibiting the parking, stopping or standing of any motor vehicle on a portion of South Ennis Street, Plainview, Texas; Providing a penalty; Cumulativeness clause; Conflict clause; Severability clause; And effective date. (Second Reading). Approved REGULAR AGENDA ITEMS Zone Case 693. Specific Use Permit. Ordinance No. 00-3262. An Ordinance amending the zoning map of the City of Plainview, Texas by issuance of a Specific Use Permit to operate a Go-Kart Track (Commercial Amusement (outdoor)) in a General Commercial (C-3) Zoning District, said parcel of land being 1009 West 5th Street; Cumulativeness clause; Conflicts clause; Severability clause; And effective date. (Second Reading). There was no discussion regarding this Ordinance for second reading. Mayor Woods moved to approve Ordinance No. 00-3262 and Councilmember Mike Hutcherson seconded the motion. Councilmembers Parker, Rosas, Hutcherson, Owen, McGehee and Mayor Woods voted "yes" on the motion. None voted against. Zone Case 694. Ordinance No. 00-3263. 911 N. Columbia and 405 W. l0th Streets. An Ordinance amending the zoning map of the City of Plainview, Texas for rezoning lot 1, N33' of Lot 2 and a 40'x110' strip out of Sec. 40, JK-2, Block 64, Alexander-Westmoreland Addition from Retail (C-2) zoning district to a Commercial General Business (C-3) zoning district, Plainview, Texas; Cumulativeness clause; Conflicts clause; Severability clause; And effective date. (First Reading). Director of Community Services John Castro reviewed the rezoning ordinance explaining the property faces two streets, N. Columbia and l0th Streets. The proposed change will allow the owner to put in a used car lot, which will face the Columbia Street side, the remainder of the building will be used for construction storage. Landscaping will be added. The City received one response, and it was in favor of the proposed change. The Planning and Zoning Commission recommended approval. Councilmember Rey Rosas moved to approved Ordinance No. 00-3263 and Councilmember Ross Owen seconded the motion. Councilmembers Parker, Rosas, Hutcherson, Owen, McGehee and Mayor Woods voted "yes" on the motion. None voted against. 6. PubliC Hearing. Proposed 2000,2001 Budget. City Manager Jim Jeffers reviewed the proposed Budget of $13.6 million. The major portion of the budget is personnel (198 full time employees, half of which are public safety personnel), since the City is primarily a service organization. The remainder of the budget is for capital Minutes 00 0822 Page 2 of 4 136 improvements, supplies, maintenance and other expenses. The General Fund Revenue is projected at $8 million; the General Expenses is projected at $8.1 million. The proposed tax rate has declined steadily over the past ten years, the proposed tax rate is $.4375. Mr. Jeffers explained this tax rate will result in a homeowner of a $50,000 valued house paying $219; the owner of a $100,000 paying $438. This tax rate will generate approximately $2,519,100 in revenue. Solid waste, water and wastewater services are all fee generated. Mr. Jeffers reviewed the proposed $13 million improvements to the wastewater treatment plant. There was no public comment. Ordinance No. 00-3266. An Ordinance levying municipal ad valorem taxes for the City of Plainview, Texas for the year 2000, and directing the assessment and collection thereof; Severability clause; Cumulativeness clause; Conflicts clause; And effective date~ (First Reading). The proposed tax rate for 2001 is $.4375. There was no discussion and no public comment on this ordinance. Councilmember Ross Owen moved to approve Ordinance No. 00-3266 and Councilmember Rey Rosas seconded the motion. Councilmembers Parker, Rosas, Hutcherson, Owen, McGehee and Mayor Woods voted "yes" on the motion. None voted against. Ordinance No. 00-3267. An Ordinance adopting and approving the Budget for the fiscal year beginning October 1, 2000, and terminating September 30, 2001, and making such appropriations for each department, project and account. (First Reading). It is noted that Councilmember Mike Hutcherson has filed a Conflict of Interest on items pertaining to the Plainview/Hale County Airport and is not voting on that portion of the Budget and Councilmember Rey Rosas has filed a Conflict of Interest regarding items pertaining to the Municipal Court and is not voting on that portion of the Budget. There was no public comment and no discussion of this ordinance. Councilmember Rey Rosas moved to approve Ordinance No. 00-3267 and Councilmember Hutcherson seconded the motion. Councilmembers Parker, Rosas, Hutcherson, Owen, McGehee and Mayor Woods voted "yes" on the motion, respectively. None voted against. 9. Water Reclamation annual report. Director of Public Works John Berry gave the report. 10. Ordinance No. 00-3268. An Ordinance of the City of Plainview, Texas amending Section 25-42 of the Code of the City of Plainview, amending sewer rates; Severability clause; Cumulativeness clause; Conflicts clause; And effective rate. (First Reading). The existing wastewater treatment plan is aged and operating near capacity. Therefore $10 to $13 million of plant improvements are needed. In order to finance the improvements the minimum charge per month will be increased from $6.00 to $7.00. The charge per 1,000 gallons will be increased from $.44 to $1.20. The new revenues will be used to finance the needed improvements. Councilmember McGehee noted the largest sewer customer was the Wheeler and Formby units of the Texas Department of Criminal Justice. He also the maximum monthly residential sewer charge would be $23.80, since the residential sewer calculation is capped at 14,000 gallons. There was no public comment. Councilmember McGehee moved to approve Ordinance No. 00-3268 and Councilmember Owen seconded the motion. Mayor Woods and Minutes 00 0822 Page 3 of 4 137 Councilmembers Parker, Rosas, Hutcherson, Owen, and McGehee voted "yes." None voted against. 11. Adjournment. Mayor Woods moved to adjourn the meeting. Councilmember Owen seconded the motion, which carried unanimously. Mayor Woods declared the meeting ~ adjourned at 7:45 p.m. Passed and approved on September 12, 2000.
