Speed Zone -East & West Frontage Roads of !-27
ORDINANCE NO. 08-3500
AN ORDINANCE OF THE CITY OF PLAINVIEW, TEXAS, AMENDING
SECTION 24-158 OF THE CODE OF ORDINANCES TO ESTABLISH A
MAXIMUM RATE OF SPEED FOR VEHICLES TRAVELING
NORTHBOUND AND SOUTHBOUND ON U.S I-27 WEST AND EAST
FRONTAGE ROADS; PROVIDING FOR A PENALTY;
CUMULATIVENESS CLAUSE; CONFLICTS CLAUSE; SEVERABILITY
CLAUSE; AND EFFECTIVE DATE.
WHEREAS, the U.S. I-27 West and East Frontage Roads for traffic traveling
northbound and southbound within the corporate limits of the City of Plainview, Texas
have become congested creating more traffic hazards for travelers; and
WHEREAS, the Texas Department of Transportation (TxDOT) performed a traffic
survey measuring speed rates of cars traveling on such Frontage Roads as well as
fatal, personal injury, and property damage accidents; and
WHEREAS, upon reviewing TxDOT's surveys and recommendations regarding
the maximum speed limits on U.S. I-27 West and East Frontage Roads for traffic
traveling northbound and southbound within the corporate limits of the City of Plainview,
Texas, the City Council determined that the maximum speed limits on such Frontage
Roads should be amended; and
WHEREAS, the City Council finds it in the best interest of the public safety of the
City of Plainview citizens to decrease the speed of 55 mph on both the East and West
Frontage Roads for approximately one mile as designated on TxDOT's traffic survey,
attached and incorporated as a part of this Ordinance, to 45 mph on the West Frontage
Road and 50 mph on the East Frontage Road; and
WHEREAS, the City Council further determined that such proposal would be in
the best interest of public health, safety, and general welfare, reducing traffic hazards
for travelers, specifically those contributing to fatal, personal injury, and property
damages.
NOW, THEREFORE, the City of Plainview hereby ordains that:
SECTION I
(a) The speed limit on U.S. I-27 West and East Frontage Roads also known as
Interstate Highway 27 service roads, within the City limits of Plainview, at the following
designated locations shall be amended in the Plainview City Code of Ordinances,
Section 24-158 and said speed limits shall be as follows:

(1) Beginning at U.S. I-27 State mile post 27.830 (currently Mile Marker
49) of the West Frontage Road North one (1) mile to State mile post
28.830 (currently Mile Marker 50) within the North City Limits, the
maximum legal speed limit for both southbound and northbound traffic of
said West Frontage Road shall be 45 mph., as established by the Texas
Transportation Commission within the corporate limits of Plainview, Hale
County, Texas.
(2) Beginning at U.S. I-27 State mile post 27.830 (currently Mile Marker
49) of the East Frontage Road North one (1) mile to State mile post
28.830 (currently Mile Marker 50) within the North City Limits, the
maximum legal speed limit for both southbound and northbound traffic of
said East Frontage Road shall be 50 mph., as established by the Texas
Transportation Commissions within the corporate limes of Plainview, Hale
County, Texas.
(b) Any person who shall violate or fail to comply with the provision of this
ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof, shall
be punished by a fine not to exceed Five Hundred and No/100 Dollars ($500.00).
SECTION II
All ordinances and parts of ordinances inconsistent with the provisions of this
Ordinance are repealed.
SECTION III

Severability is intended throughout and within this Section. If any provision,
including any section, paragraph, sentence, clause, phrase or word or the application
thereof to any person or circumstance is held invalid, the application to other persons or
under other circumstances shall not be affected thereby and the validity of this Section
in any and all other respects shall not be affected thereby.
SECTION IV
Provisions of this ordinance are cumulative and nothing herein shall prevent,
alter, or diminish the applicability or enforcement of other ordinances restricting,
regulating, or governing the subject matter herein.
SECTION V
All ordinances or portions of any ordinance of the City of Plainview, Texas in
conflict herewith, are hereby amended to conform with the provisions hereof.

SECTION VI
Should any section, subsection, or any portion hereof be deemed invalid for any
reason, such holding shall not render or invalidate any other section, sub-section,
sentence, provision, clause, phrase, or word severable therefrom and the same shall be
deemed severable for this purpose.
SECTION VII
This ordinance shall be of full force and effect upon its passage and publication
as required by law.
