HomeMy WebLinkAbout08 0722 min216 The Plainview City Council met on July 22, 2008 at 7:00 p.m. in the City Council Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting was posted in City Hall at 5:00 p.m. on July 18, 2008. Mayor John C. Anderson presided. Councilmembers present were: Cathy Waggoner-District 2, Belinda Pena- District 3, John N. Bertsch-District 4, Ron Trusler-District 5, Wendell Dunlap-District 6 and Roland Nash-District 7. Councilmember Kelvin Tipton-District 1 was absent. Staff members present were: Greg Ingham-City Manager, Leslie Pearce-City Attorney, John Castro-Director of Community Services, Will Mull-Police Chief, Dale Simpson- Director of Civil Service and Belinda Hinojosa-City Secretary. News Media Representative: Deborah Zacher-Plainview Daily Herald Councilmember John N. Bertsch delivered the invocation and led in the Pledge of Allegiance. Councilmember Trusler moved to adopt the consent calendar. The motion was duly seconded by Councilmember Dunlap and carried by unanimous vote. Items approved on the consent calendar included approval of the minutes of July 8, 2008 and July 17, 2008; granting of excused absence to Councilmember Kelvin Tipton; and the approval of financial reports. William Mull, Police Chief presented for consideration on first reading Ordinance No. 08- 3500, an Ordinance of the City of Plainview, Texas, Amending Section 24-158 of the Code of Ordinances to Establish a Maximum Rate of Speed For Vehicles Traveling Northbound and Southbound on U.S I-27 West and East Frontage Roads; Providing for a Penalty; Cumulativeness Clause; Conflicts Clause; Severability Clause; and Effective Date. The City requested a survey from TxDOT in late 2007. Due to growth in the area, the City requested the speed be changed to 45 mph on both the east and west side of the service road. The City received TxDOT's recommendation in early 2008. They recommended that the speed limit be 45 mph on the West service road from mile marker 49 to mile marker 50 (roughly 18th Street). They did not decrease the speed limit for the East service road since at the time of the survey there was very little on the east side of the service road. The City however has asked and been approved fora 5 mph variance from mile marker 49 to mile marker 50 because of the growth on that street which includes two additional churches, Pizza Hut and continuing construction of a medical center. This ordinance has been drafted by the City Attorney and proposes these speed limit changes. Mayor Anderson asked for public comment. There was no public comment. Councilmember Dunlap moved to approve Ordinance No. 08-3500 on first reading. The motion was duly seconded by Councilmember Pena. Mayor Anderson, Councilmembers Waggoner, Pena, Trusler, Dunlap and Nash voted "for" the motion. Councilmember Bertsch voted "against" the motion. The motion carried.
