RESOLUTION NO. R90-1~6
A RESOLUTION OF THE CITY OF PLAINVIEW, TEXAS, REQUESTING
THE EPA TO CONSIDER REVISIONS TO PROPOSED SUBTITLE D
-REGULATIONS AND REQUESTING ASSISTANCE. `I'HRU THE TEXAS
DEPARTMENT OF HEALTH AND THE UNITED STATES CONGRESSIONAL
DELEGATION.
WHEREAS, the United .States Environmental Protection Agency has
proposed new regulations pursuant 'to Subtitle D of the Resource
Conservation and .Recovery Act (53 FED. REG. 33314, 8/30/88) which
would establish nation wide minimum standards for municipal solid
waste landf ills; and
WHEREAS, those regulations are designed to eliminate small
existing municipal landfills and encourage. large regional
state-of-the-art landfills; and
.WHEREAS, extremely low population densities in West Texas and
many of the other areas of the Western. United States make
compliance with the proposed Subtitle D Regulations a financial
impossibility; and.

~,,J; WHEREAS., in the ,arid portions of West Texas the extremely
small amount of normal precipitation combined with existing soil
conditions make the passibility of ground water contamination from
a landfill remote.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City
of Plainview, Texas,. that:
1. The City of Plainview is committed to environmentally safe
and. prudent disposal of municipal waste, but believes
that waste disposal requirements must be within the realm
of economic possibility.
2. The City of Plainview requests the Environmental Protection
Agency to consider revisions to proposed Subtitle D
Regulations which would authorize State regulatory agencies
sufficient flexibility to grant variances in national
standards in areas of extremely low population density,
upon a showing that the municipal landfill .facility does
nat. pose a significant threat to the environment or ground
water quality..
3. The Texas Department of Health, United States Senators
Bentsen and Gramm, and United States Congressman Larry
Combest are hereby requested to assist the City in
.obtaining modifications in the proposed Subtitle D
~~~ Regulations which would allow for an economical and

environmentally. prudent. waste disposal alternative in low
population density areas.
