SANITATION - REGIONAL LANDFILL CONTRACTS
RESOLUTION NO. R90-119
A RESOLUTION OF THE CITY OF PLAINVIEW, TEXAS, AUTHORIZING
THE MAYOR TO EXECUTE SOLID WASTE MANAGEMENT AGREEMENTS FOR
THE IMPLEMENTATION OF A REGIONAL LANDFILL.
WHEREAS, the Solid Waste Disposal Act Chapter 361, Health and
Safety Code, establishes the policy of the State to safeguard the
health, welfare, and the physical property of people, and to
protect the environment, through control and management of solid
wastes; and
WHEREAS, pursuant to this act, the Texas Department of Health
has established standards for the management and control of
municipal solid waste and requires and issues permits authorizing
and governing the construction, operation and maintenance of solid
waste facilities; and
WHEREAS, the U.S. Environmental Protection Agency pursuant to
the Federal Resource Conservation and Recovery Act, 42 U.S.C.
6901, e.t. seq. as amended, has adopted criteria for landfills
that dispose of municipal solid waste; and
WHEREAS, a regional landfill, serving several communities,
provides~ a more economical, efficient, and safe means for the
disposal of solid waste and offers greater opportunity for
complying with Federal and State requirements and safeguarding the
health, welfare, and physical property of the people, and to
protect the environment; and
WHEREAS, the comprehensive Municipal Solid Waste Management
Resource Recovery, and Conservation Act Chapter 363, Health and
Safety Code, authorizes a public agency to enter into contracts to
enable it to furnish or receive solid waste management services;
and
WHEREAS, the City of Plainview, Texas, has expressed an
interest in providing regional landfill facilities; and
NOW, THEREFORE, BE IT RESOLVED by the City of Plainview,
Texas, that the Mayor is hereby authorized to enter into Solid
Waste Management Agreements for the implementation of regional
landfill facilities.
