RESOLUTION NO. R90-137
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF PLAINVIEW, TEXAS ADDRESSING THE NEED FOR A
POLICY STATEMENT IN REGARD TO OPEN MEETINGS.
WHEREAS, it is the continuing interest, desire and policy of
the City Council of the City of Plainview, Texas to comply with
the Open Meetings Law of the State of Texas; and
WHEREAS, the Texas Open Meeting Law is intended to promote
open decision making in government and to protect the public's
right to know about the workings of its government; and
WHEREAS, the Open Meetings Law also allows discussions of
certain topics and subjects to be closed to the public in the
interest of better government; and
WHEREAS, one such exception to the Open Meetings
requirement is that the public body may conduct a closed meeting
involving the appointment, employment, evaluation, reassignment,
duties, discipline, or dismissal of a public officer or employee
or to hear complaints or charges against such officer or
employee; and
WHEREAS, City Council recognizes that open and frank
discussions regarding the appointment of public officers and
employees would better achieve the purposes intended therein by
the Open Meetings Law.
NOW, T~RREFORE, BE IT RESOLVED by the City Council of the
City of Plainview, Texas that discussions regarding the
appointment, employment, evaluation, reassignment, duties,
discipline, or dismissal of a public officer or employee or to
hear complaints or charges against such officer shall take place
in executive session, unless otherwise directed by the Council or
law.
