HomeMy WebLinkAboutR90-150ZONE CASE NO. 558 - Specific Use Permit Extension - J. C. Funderburk RESOLUTION NO. R90-150 A RESOLUTION OF THE CITY OF PLAINVIEW, TEXAS ACTING REQUEST OF J. C. FUNDERBURK, TO EXTEND THE SIX (6) MONTH TIME LIMIT FOR COMPLETING SPECIFIC USE PERMIT CONDITIONS. WHEREAS, on December 21, 1989, the City Council of the City of Plainview, Texas granted a Specific Use Permit to J. C. Funderburk in Ordinance No. 89-2811 to operate a private club serving alcoholic beverages within the City of Plainview; and WHEREAS, a Specific Use Permit for a club serving alcoholic beverages Places certain conditions and requirements on issuance of the Specific Use Permit; and WHEREAS, one of the requirements placed on a private club is that a permit from the State of Texas Alcoholic Beverage Commission should be obtained within six (6) months of the date of issuance of the Specific Use Permit by the City Council and any extension in the time limit is subject to the review and possible extension by the City Council; and WHEREAS, all requirements for issuance of the Specific Use Permit have been met except the requirement of the issuance of the State Alcoholic Beverage Permit; and WHEREAS, J. C. Funderburk has requested an extension of the six (6) month limitation in time to obtain the said permit due to the many restrictions that have been met, the large outlay of money that has taken place,and illness and bad health of the applicant. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Plainview that J. C. Funderburk be granted a sixty (60) day extension on his Specific Use Permit - club serving alcoholic beverages, Ordinance No. 89-2811 to allow for completion of the application and receiving a permit to sell alcoholic beverages from the State of Texas.
