R90-168 A Resolution Of the City of Plainview, Texas, authorizing the Mayor to execute an agreement with the Plainview Optimist S~.,er Baseball program for the purpose of extending their current lease. WHEREAS, the Plainview Optimist Summer Baseball program currently has leased the six (6) formal playing fields at the intersection of Southwest Second and Beech and South of Running Water Draw, all of which are located in the Broadway Street Park area; and WHEREAS, the said lease expires on September 1, 1990; and WHEREAS, the Plainview Noon Optimist Club has requested in writing that the said lease be extended until December 1, 1990 for the purpose of operating a Fall baseball program for the youth of Plainview; and WHEREAS, the Plainview Noon Optimist Club has operated the Summer baseball program for the youth of Plainview and operated concession stands in designated park areas to benefit this program for many years; and WHEREAS, the City of Plainview desires that the Plainview Noon Optimist Club have an opportunity to conduct a Fall baseball program and operate concession stands for the selling of cold drinks and confections and other types of food in conjunction with this program; and WHEREAS, a copy of a proposed agreement extending the current lease agreement and concession agreement are attached to this Resolution and hereby made a permanent part thereof. NOW THEREFORE BE IT RESOLVED by the City Council of Plainview, Texas, that the Mayor is hereby authorized to execute an agreement extending the current lease agreement and concession agreement with the Plainview Optimist Summer Baseball program which was executed January 23, 1990 and which was to expire September 1, 1990. Under the extension, the said lease will expire December 1, 1990 with all other provisions to remain unchanged and remain in force until that date. Ridlehuber, Mayor 1 of 2 ATTEST: Carla Reese, City Secretary APPROVED AS TO CONTENT: Carl Holland, Superintendent of Parks APPROVED AS TO FORM: David Blackburn, City Attorney 2 of 2 STATE OF TEXAS COUNTY OF HALE EXTENSION OF LEA~E AGREE~RNT CITY OF PLAINVIEW PLAIN-VIEW OPTIMIST SUMMER BASEBALL PROGRAM W~RREAS, the City of Plainview, Texas and the Plainview Optimist Summer Baseball Program have executed a lease on January 23, 1990 for use of the six (6) formal playing fields located in Broadway Street Park for the purpose of operating a Summer youth baseball program; and WHEREAS, the City of Plainview and the Plainview Optimist Summer Baseball Program have also executed an agreement to operate concessions in the Broadway Street Park in conjunction with their Summer youth baseball program; and WHEREAS, the said lease and agreements were to expire on September 1, 1990; and WHEREAS, the Plainview Noon Optimist Club who operate the Plainview Optimist Summer Baseball Program have formally requested that the said lease and agreements be extended until December 1, 1990 for for the purpose of operating a Fall baseball program for the Youth of Plainview; and WHEREAS, the City Council of the City of Plainview feels that it would be in the best interest of the City of Plainview that such a program be operated by the Plainview Noon Optimist Club. NOW THEREFORE, in order to accomplish this purpose, it is agreed by and between the City of Plainview and the Plainview Optimist Summer Baseball Program that each acting by and through its officers that the lease and agreements executed between both organizations on January 23, 1990 be extended to expire December 1, 1990 with all other provisions of the 1990 Lease Agreement and Concession Agreement being unchanged. This instrument once signed will become a permanent part and will be attached to the 1990 Lease Agreement between the City of Plainview and the Plainview Optimist Summer Baseball Program and a part of 1990 Concession Agreement with the Plainview Optimist Summer Baseball Program.
