RESOLUTION NO. R90-203
A RESOLUTION OF THE CITY OF PLAINVIEW, TEXAS
GRANTING A REQUEST OF RONNIE SHACKLEFORD FOR
A VARIANCE FROM THE SUBDIVISION REGULATIONS
REQUIRING PARCELS OF LESS THAN TEN ACRES TO
BE SUBDIVIDED.
WHEREAS, Ronnie Shackleford has presented to the City a
request for a variance under Section 7.13 of the Plainview
Subdivision Regulations, also known as Ordinance No. 89-2807; and
WHEREAS, Ronnie Shackleford has presented to the City a
survey of the land in question and is attached to this Resolution
and marked Exhibit A; and
WHEREAS, Ronnie Shackleford has advised the City that the
land is presently being used for agricultural purposes, will
continue to remain for agricultural use, and that the land is
within the 100 year flood plain and cannot be economically used
for any other purpose; and
WHEREAS, Ordinance No. 89-2807 provides that any person
owning a tract of land within the city limits or within the
extraterritorial jurisdiction of the City who may hereafter
divide the same into two or more parts for the purpose of laying
out any subdivision or tract of land comply with the provisions
within said ordinance; and
WHEREAS, Ordinance No. 89-2807 also provides for a variance
from the provisions of the ordinance where a subdivider can show
that a provision of the regulations would cause unnecessary
hardship if strictly adhered to and' where because of some
condition peculiar to the site, a departure may be made from the
subdivision regulations without destroying the intent of such
provisions; and
WHEREAS, the Planning and Zoning Commission has considered
this request for a variance under Section 7.13 of Ordinance No.
89-2807 and has recommended that it be approved based upon the
conditions recited above.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Plainview, Texas that Ronnie Shackleford be granted a
variance from the terms and conditions set forth in Ordinance No.
89-2807 requiring the platting of a plot of land of less than ten
acres for the property identified on the attached survey, and
incorporated by reference herein, for the reasons of conditions
peculiar to the site and that such a variance is done without
destroying the intent of the subdivision regulations.
